AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2, ARTICLE II, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADMINISTRATION/CITY COMMISSION/TIME AND PLACE OF MEETING", TO CHANGE THE DAY AND TIME CITY COMMISSION MEETINGS SHALL BE HELD FROM TUESDAYS AT 10:00 A.M. TO THURSDAYS AT 9:30 A.M.; MORE PARTICULARLY. BY AMENDING SECTIONS 2-32 AND 2-33 OF SAID CODE; FURTHER DIRECTING THAT THE PRESENTATION OF "PROTOCOL ITEMS" BE SCHEDULED AT 9:20 A.M., OR TEN MINUTES PRIOR TO THE COMMENCEMENT OF REGULAR CITY COMMISSION MEETINGS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Motion 99-963, adopted November 16, 1999, the City Commission directed the City Attorney to prepare legislation to change the commencement of regular meetings of the City Commission from the second and fourth Tuesdays of each month at 10 A.M. to the second and fourth Thursdays of each month at 9:30 A.M.; and WHEREAS, the City Commission further directed that all "Protocol Items" be scheduled to begin at 9:20 A.M., ten minutes prior to the commencement of regular City Commisision meetings; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY • OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 2, Article II, Section 2-32, of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:" "Chapter 2 ADMINISTRATION ARTICLE II. CITY COMMISSION Sec. 2-32. Time and place of meeting. (b) Regular meetings of the city commission shall be held on the second and fourth Tiles ys Thursdays of each month except during the month of August and unless otherwise provided by city commission action. All regular meetings of the city commission shall convene promptly at 10!99 9:30 a.m. At the first meeting of the month, matters to be considered shall be generally limited to those matters not arising from or under the provisions of. Ordinance Number 11000, as amended, the comprehensive zoning ordinance for the City of Miami. At the second monthly meeting, matters to be considered shall be generally limited to those matters arising from or under the provisions of Ordinance Number 11000. Further, all public hearings on land use ordinances, including those involving ten (10) acres or more, may be held before 5:00 p.m. unless the City Commission, state law or administrative rule specifically provide otherwise. Nothing herein shall preclude consideration of any matter at any meeting whether or not such matter 1' Words and/or figures stricken through shall be deleted. Order of procedure. business and rules of (i) Unless impractical to do so, all portions of the agenda shall be scheduled to be heard at 3-9-.99 9:3Q a.m. on the date of the city commission meeting. The agenda portion entitled "consent agenda" shall be scheduled among the initial items for commission consideration. Consent agenda items that are removed from the agenda prior to city commission consideration shall automatically be scheduled as a regular agenda item at the next regularly scheduled meeting of the city commission, unless, by an unanimous vote of all commissioners present, the city commission considers such consent item as a regular item at the same meeting. Section 3. The presentation of "Protocol Items" are hereby directed to be scheduled at 9:20 A.M., or ten minutes prior to the commencement of regular City Commission meetings. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City -3- 11865 of Miami. Section. 7. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 8. FROM: Alejandro Vilarello, City At DATE: December 3, 1999 RE: Proposed Emergency rdi ce-December 14, 1999 City Commission Meeting Amend Code to change he days and time Commission Meetings are scheduled and setting the time that'T otocol Items" are presented (J-99-1015) At the November 16, 1999 City Commission meeting, pursuant to Motion 99-963, the City Commission directed the City Attorney to prepare an ordinance to amend the Code of the City of Miami, Florida, as amended (the "Code"), to change the days and time, effective January 2000, that regular meetings of the City Commission are held from the second and fourth Tuesdays of the month, commencing at 10:00 A.M., to the second and fourth Thursdays of the month, commencing at 9:30 A.M. The City Commission further directed that all presentations of "Protocol Items" be scheduled to begin at 9:20 A.M., or ten minutes prior to the commencement of regular City Commission meetings. The attached proposed ordinance will, if adopted, .amend Sections 2-32 and 2-33 of the Code to incorporate the City Commission's directives relating to the change in days and time regular meetings of the City Commission are held. The legislation is submitted for your consideration as an emergency ordinance so that the provisions of the amendments are effective in time for the first regular meeting of January to be scheduled for the second Thursday of the month, which is January 13, 2000. Further, the ordinance will, upon adoption, direct that "Protocol Items" be scheduled for presentation at 9:20 A.M., or ten minutes prior to the commencement of regular City Commission meetings. Since "Protocol Items" are not veritable agenda items, the directive fixing the time at which they are presented will not be codified in the City Code, but will be adopted and observed as official City Commission policy.
