AN ORDINANCE AMENDING CHAPTER 2/ARTICLE XI OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS", AND CHAPTER 22, ENTITLED "GARBAGE AND OTHER SOLID WASTE" TO CREATE THE COMMERCIAL SOLID WASTE MANAGEMENT ADVISORY COMMITTEE, SETFORTH SAID COMMITTEE'S FUNCTION AND REQUIREMENTS FOR MEMBERSHIP, PROVIDE FOR TERMS OF OFFICE, FILLING OF VACANCIES, OFFICERS, RULES OF PROCEDURE, MEETINGS, QUORUMS, AND ATTENDANCE REQUIREMENTS, ASSIGNMENT OF STAFF, FILING OF OFFICIAL RECORDS AND THE ANNUAL REPORT, AND TO PROVIDE FOR THE "SUNSET" REVIEW OF. SAID COMMITTEE EVERY FOUR YEARS; MORE PARTICULARLY BY AMENDING SECTION 2-892 AND BY ADDING NEW ARTICLE VII TO CHAPTER 22 OF SAID CODE, CONSISTING OF SECTIONS 22-170 THROUGH 22-174; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Resolution No. 99-297, adopted April 27, 1999, the City Commission directed the City Attorney to' draft an ordinance which establishes a Commercial Solid Waste Management Advisory Committee to the City of Miami for the purpose of advising on issues related to solid waste management within the City; and WHEREAS, the provisions of City Code Section 2-833 require that all City boards be created by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY 118 4 91 OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 2/Article XI entitled "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS/"Sunset" review of boards.", is hereby amended in the following particulars:l' "Chapter 2 ADMINISTRATION ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS DIVISION 1. GENERALLY Sec. 2-892. "Sunset" review of boards. Commencing with the year 1995, each city board shall be reviewed in the following manner: (4) The following boards shall initially be reviewed in the following years and shall be reviewed every four years thereafter: 1999: 1 words and/or figures stricken through shall be deleted. All ordinances or parts of ordinances or resolutions insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. The City Commission directed that the said proposed Ordinance be modified to include language that would prohibit said Committee members from discussing issues related to pricing which would be in violation of any local, state or federal law. Section 3 of the attached proposed second reading ordinance has been modified to incorporate said language as directed by providing a provision to be included in the City Code as Subsection 2-171(b) [located on Page 3 of the draft ordinance]. BACKGROUND For the past several months, at the direction of the City Commission, the Administration has taken a series of steps to transition the manner in which commercial solid waste service is provided in the City of Miami. An in-house working committee, which also included representatives of the private waste hauler sector and City Commission input via workshops held at City Hall, was created to recommend the manner in which the City would regulate commercial haulers. A recommendation from that group to establish a nonexclusive franchise system was approved in concept. The City commission, by Resolution No. 99-297 adopted on April 27, 19999, directed the City Attorney to develop an Ordinance to insure continued private hauler involvement in the regulation of commercial solid waste services.
