AN ORDINANCE OF THE MIAMI CITY COMMISSION ACCEPTING A 'GRANT FROM THE MIAMI-DADE CULTURAL AFFAIRS COUNCIL FOR THE MANUEL ARTIME PERFORMING ARTS CENTER, AND ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "ARTIME CENTER IMPROVEMENTS" AND APPROPRIATING FUNDS FOR SAID PROJECT IN THE AMOUNT OF $145,000, AS REFLECTED IN A GRANT AWARD AGREEMENT OFFERED TO THE MANUEL ARTIME PERFORMING ARTS CENTER BY THE MIAMI-DADE CULTURAL AFFAIRS COUNCIL; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AWARD AND EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT ACCEPTANCE OF SAID GRANT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Manuel Artime Center for the Performing Arts in Little Havana ("Artime Center"), offers the community cultural programs such as dance, theater, opera and symphony presentations; and WHEREAS, the Artime Center is in need of facilities improvements such as the repair of rain gutters, interior and exterior walls, air conditioning system, painting, acoustical consulting and upgrading the sound system; and WHEREAS, the Miami -Dade Cultural Affairs Council awarded the • Center a $145,000 grant to fund facility improvements; and WHEREAS, said grant will be administered through the Miami -Dade Cultural Affairs Council; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following new Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: "Artime Center Improvements" RESOURCES: Miami -Dade Cultural Affairs Council $145,000 APPROPRIATIONS: Miami -Dade Cultural Affairs Council $145,000 Section 3. The City Manger is hereby authorized!' to The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. - 2 - 11848 accept the aforementioned grant and execute the necessary documents, in a form acceptable to the City Attorney, to implement acceptance of said grant. Section 4. All ordinances o`r parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, -part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof." PASSED ON FIRST READING BY TITLE ONLY this 12th day of October , 1999. This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. BACKGROUND: On August 12, 1999, the Director of the Department of Conferences, Conventions and Public Facilities received notification from the Miami -Dade Cultural Affairs Council approving a previously filed grant application from the Manuel Artime Center for $145,000 for capital improvements. These funds, in conjunction with forthcoming CDBG 1999-2000 matching funds, will be used to repair the rain gutters, replace the air conditioning, repair interior drywalls and perform interior and exterior painting to the Manuel Artime Center, a City -owned facility located at 900 S.W.
