. IORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION ESTABLISHING A SPECIAL REVENUE
FUND ENTITLED: "WORKFORCE INVESTMENT ACT
("WIA") PROGRAM (PY' 99) "; APPROPRIATING FUNDS
FOR ITS OPERATION IN THE ESTIMATED AMOUNT OF
$857,390 CONSISTING OF A GRANT FROM THE
U.S. DEPARTMENT OF LABOR, THROUGH THE SOUTH
FLORIDA EMPLOYMENT AND TRAINING CONSORTIUM;
AUTHORIZING THE CITY MANAGER TO ACCEPT SAID
GRANT, AND TO EXECUTE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR SAID PURPOSE; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Congress of the United States adopted the
Workforce Investment Act of 1998 to establish programs to
prepare unskilled adults for entry into the labor force and to
afford job training to economically disadvantaged persons and
other individuals facing serious barriers to employment, who
require special needs for training; and
WHEREAS, the City of Miami is operating the Department of
Community 'Development/Office of Workforce Development in PY 199
to meet the mandate of the aforementioned legislation; and
WHEREAS, the South Florida Employment and Training
Consortium has awarded the City $857,390, pursuant to the
Workforce Investment Act ("WIA"), to establish a one -stop center

to provide intensive and core services for training and job
placement assistance for economically disadvantaged adults and
dislocated workers;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

The following Special Revenue Fund
is hereby
established

resources are hereby appropriated as
described
herein:

APPROPRIATION: WORKFORCE INVESTMENT ACT (WIA) PROGRAM)

Section 3. This appropriation is contingent upon funding
by the South Florida Employment and Training Consortium ("SFETC")

and the City Manager's acceptance thereof.
Section 4. The City Manager is hereby authorized" to
accept the grant from the U.s. Department of Labor, through the
SFETC and to execute all necessary documents, in a form
acceptable to the City Attorney, for the acceptance of said
grant.
Section 5. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 6.
If
any section, part
of section, paragraph,
clause, phrase or
word
of this Ordinance
is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions and

duties of municipal affairs.
Section 8. The requirement of reading this Ordinance on
two separate .days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 9. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.2/

effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the
City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance
which establishes a special revenue fund entitled the Workforce Investment Act (WIA) Program and
appropriates funds for the operation of this program in the amount of $857,390 from the U.S.
Department of Labor through the South Florida Employment and Training Consortium (SFETC).
BACKGROUND:
The Department of Community Development/Office of Workforce Development has prepared
legislation appropriating funds and establishing the following special revenue fund as a result of a
grant award from the South Florida Employment and Training Consortium (SFETC).
The Consortium (SFETC) has awarded the City $857,390 to operate a One -Stop Center to.provide
Intensive Services and/or Core Services to train and assist in job placement activities for
economically disadvantaged adults and dislocated workers.
This program is operated and administered by the Department of Community Development/Office
of Workforce Development. The proposed legislation is presented as an Emergency Ordinance to
ensure the continuation of these critical employment services to economically disadvantaged City
residents because the existing contract expires September 29, 1999.
Adoption of the proposed legislation establishes the above referenced new special revenue fund and
appropriates funds as outlined above. This legislation also authorizes the City Manager to accept
the grant award and enter into an agreement with the South Florida Employment and Training
Consortium (SFETC). i
