ORDINANCE NO.-
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 11395, AS
AMENDED, WHICH ESTABLISHED A SPECIAL REVENUE
FUND ENTITLED "VICTIMS OF CRIME ACT"; TO
INCREASE SAID APPROPRIATIONS..IN THE AMOUNT OF
$48,000, CONSISTING OF A GRANT FROM THE STATE
OF FLORIDA, OFFICE OF THE ATTORNEY GENERAL;
AUTHORIZING THE CITY MANAGER TO ACCEPT SAID
GRANT, AND TO EXECUTE THE NECESSARY
DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR THIS PURPOSE; AUTHORIZING THE
CITY MANAGER TO EXPEND MONIES FROM THIS FUND
FOR NECESSARY EXPENSES TO CONTINUE THE
OPERATION OF THE PROGRAM; FURTHER CORRECTING
SCRIVENER'S ERRORS IN ORDINANCE NOS.. 11637
AND 11697 TO ACCURATELY REFLECT THE AMOUNTS
APPROPRIATED TO SAID FUND BY EACH ORDINANCE
INCLUDING REQUIRED IN -KIND SERVICES, AND TO
SPECIFY THE AMOUNTS OF EACH GRANT; CONTAINING
A REPEALER PROVISION, SEVERABILITY CLAUSE,
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Ordinance No. 113'95, adopted
September 12, 1996, a special revenue fund entitled: "Victims -of
Crime Act," was established to appropriate funds in the amount of
$31,661, consisting of a grant from the State of Florida, Office
of the Attorney General, toward the payment of salaries,
reporting requirements, and training of the Victim Advocate
Program; and
WHEREAS, pursuant to Ordinance 11572 adopted on
November 26, 1997, Ordinance No. 11395 was amended to accept

additional grant monies in the amount of $7,980.08 for a total
appropriation to said fund in the amount of $39,641.08; and
WHEREAS, pursuant -to Ordinance No. 11637, adopted on
April 14, 1998, Ordinance No. 11395 was further amended to accept
additional grant monies in the amount of $60,000.00 conditioned
upon a required in -kind service match of $15,000 which was not
reflected in said Ordinance, for a total appropriation of
$114,641.08; and
WHEREAS, pursuant to Ordinance - No. 11697, adopted
September 28, 1998, Ordinance No. 11395 was further amended to
accept grant monies in the amount of $35,000.00; and
WHEREAS, the State of Florida, Office of the Attorney
General, has approved an additional award, in the amount of
$48,000.00, for the continued operation of said Program with a
required in -kind service match, in the amount of $12,000 (25%),
which will come from services of employees assigned to the Police
Department's Assault Detail; and
WHEREAS, it is now necessary to amend Ordinance No. 11395,
as amended, to appropriate the additional grant funding and to
correct scriveners errors in amendatory Ordinances Nos. 11637 and
11697 to accurately reflect all appropriations of grant funds and
required City matching funds or services; and
WHEREAS, any purchases for the expenditure of said funds

must comply with applicable City Code purchasing requirements;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Ordinance No. 11395 and its amendatory
Ordinances, Ordinance Nos. 11637 and 11697, are hereby amended to
accurately reflect the amounts appropriated to said fund by each
Ordinance, and to specify the required amounts for matching
in -kind services.
Section 3. Section 2 of Ordinance No. 11395, adopted
September 12, 1996, is hereby further amended in the following
particulars:l/

Attorney General, in a form acceptable to the City Attorney, for
acceptance of said monies for the operation of said program.
Section 5. The Department of Police is authorized to
expend monies from this Fund for the operation of said program.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety and property of the City of
Miami.
Section 7. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of

limited to those prescribed by applicable City Charter and Code

two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 10. This Ordinance shall become effective
immediately upon adoption and signature of the Mayor.3/

It is respectfully recommended that the City Commission adopt the attached Emergency
Ordinance, amending Ordinance No. 11395, as amended, which established initial resources and
initial appropriations for a Special Revenue Fund entitled: "Victims of Crime Act", thereby
increasing said appropriation in the amount of $48,000, consisting of a grant from the State of
Florida, Office of the Attorney General.
BACKGROUND:
The Miami Police Department responded last year to approximately 100,000 calls for service
where there was a victim of a crime. Approximately 7,000 of these calls were domestic violence
incidents. All these victims have certain mandated rights in our state. The department's Victim
Advocate Program enables these victims to be referred to available services. The State of Florida,
Office of the Attorney General, has committed an additional $48,000, toward the payment of
salaries, reporting requirements, and training for the continuance of this successful program. The
total dollar amount does not include a required in -kind service match, in the amount of $12,000
(25%), which will come from services of employees assigned to the Police Department's Assault
Detail. The Grant period is from October 1s`, 1999 to September 30'h, 2000.
This Ordinance is being presented on an emergency basis in order to insure that funds are available
for the payment of program expenses, otherwise, this program will be unable to operate.

match in the amount of $15,000; and

Describe the service area community and how the applicant agency will meet the identified victim
assistance needs. Issues which should be addressed include: area population, geographic
characteristics, crime statistics, existing and non -existing victim services in the community. (Response

4: Statement of need
The City of Miami Police Department provides services to individuals living in a
compact area of Miami -Dade County. The City is the fourth poorest in the United States
and has a crime rate that is the highest in the state of Florida. The city had 94 homicides,
171 sexual batteries, and 5451 aggravated assaults in -1998.
To address the needs of victims of crime the Police Department budget pays for one full
time advocate for victims of homicide and one full time Domestic Violence
Administrator who helps organize victim services and community' coordination. There
are advocates in the Domestic Violence Unit funded by STOP Violence monies.
Miami -Dade County and the City of Miami have dedicated significant resources to assist
victims of domestic violence. However, the City of Miami Police Department recognizes
the need to increase advocacy for victims of other crime. This grant will continue critical
funding.outreach and advocacy for victims of violent crime in Miami.
Part 5: Project Proposal
a. Narrative of project
The City of Miami Police Department currently has VOCA funded advocates working
with volunteers who provide support and advocacy for victims of violent crime. The
victim advocates funded through this grant will continue to develop services for victims
of non -fatal violent crimes. They will provide advocacy for victims of assault, sexual
assault, hate crimes, child abuse, work place violence, and boy friend girlfriend domestic
violence not covered by Florida law. They will also assist tourist who are victims of
crime.
Victims of violent crime in the City of Miami often live in an area that places them at risk
for ongoing assault and threats. The project will work from a philosophy of Restorative
Justice through the use of a team approach to intervention and assistance. The advocates
will be in partnership with specially trained detectives. This team will assess each case
for risk and devise strategies to permanently abate the threat to the victim, advocate for
the victim swift and complete police response, assist with issues regarding the court
process and provide referrals to any needed service.
This team will examine each case to see if it is part of any for repetitive pattern of assault.
When cases of repeat violence are located the team will move to identify the nature of the
violence and identify predatory elements in the community. The sworn personnel will
use enforcement powers and the advocate shall work with the victims to increase their

safety, provide access to resources and communicate concerns to the detective. The
project hopes to reduce future victimization through the use of intense focused responses
to current victims of violent crime.
b. Coordination of services
This project shall interact with the City of Miami Police Department Safe Zone Project.
This effort combines resources from the Safespace shelter, City Police Department,
Miami -Dade Public Schools and the Domestic Violence Court. The project is led by the
City of Miami Police Department. The basic concept calls for the development of a
coordinated effort to reduce crime in a targeted area with a school as epicenter.
Personnel from the partner agencies will provide'a wide range of community education
regaraing identification and management of violent crime. As victims are identified the
advocates will be called upon for direct assistance to the victims..
c. Goals and Objectives
Goal One: Enhance the quality and quantity of services to victims of violent crimes.
Objective one: Between October 1, 1999 and September 30, 2000, the program will
provide direct services to 1000 victims of non -sexual violent crimes.
Objective two.- Between October 1, 1999 and September30 2000; the program will
provide direct services to 200 victims of sexual assault.
Goal Two: The project will expand services to meet the immediate needs of victims.
Objective One: The project will recruit, train and supervise five volunteers to expand
capacity of program's direct service provisions to victims.
Objective Two: The project will increase services to victims of child abuse by providing
services to 100 children.
d. Volunteers
The City of Miami Police Department has a Community Affairs. Unit that actively
recruits volunteers. The Current VOCA funded project has drawn in from this
pool. We currently have two volunteers who work 8 hours a week each. These
volunteers call victims and assess needs, follow up on identified high -risk cases and assist

e. Victim Compensation forms
All the victim advocates are trained to assess each victim for needs and eligibility for
victim compensation. As the case is opened and eligibility requirements are established
the advocate shall make appropriate arrangements for the victim to get assistance. This
will involve setting an appointment for the victim to come in. Should the victim be
unable to come to us we will go to them.
f. Continuation of funding
The City of Miami Police Department has made a substantial commitment to developing
ongoing services for victims of crime. The Department has created a City funded
advocate in the Homicide Unit. In addition they are providing City Funds for the
Domestic Violence Administrator who is responsible for developing a coordinated
intervention plan for victims of violent crime.
