I 1 `-' 3 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 53/ARTICLE IV, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "CONVENTION CENTER OF THE CITY OF MIAMI/UNIVERSITY OF MIAMI, JAMES L. KNIGHT", BY CHANGING THE RATE SCHEDULE FOR THE USE AND OCCUPANCY OF AND THE SERVICES FURNISHED OR TO BE FURNISHED IN CONNECTION WITH THE MIAMI CONVENTION CENTER; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami retained Globe Facilities Service to recommend a schedule of rents, rates, fees and charges for the use, occupancy and -services furnished or to be furnished in connection with the Miami Convention Center for each fiscal year; and WHEREAS, the firm of Globe Facility Services, as Consultants, performed research and submitted a schedule of rents, rates, fees and charges for the use, occupancy and services furnished or to be furnished in connection with the Miami Convention Center which schedule is found to be acceptable as reflected in the herein ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the 1-4834 Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 53/Articles III, of the Code of the City of Miami Section 53-181, as amended, is hereby amended in the following particulars:•' "Chapter 53 STADIUMS AND CONVENTION CENTERS ARTICLE IV. The schedule of rents, rates, fees and charges for the use or occupancy of and for the services furnished or to be furnished in connection with the Convention Center of the City of. Miami/University of Miami James L. Knight International Center, also known as the "Miami Convention Center," is established as {^1�^• listed below. Rental fees for space rental within the Miami Convention Center may be reduced, subject to the approval of the Executive Director of Miami Convention Center, to match or lower the amount charged by a competing facility if such change in charges causes an event to be booked at the Miami Convention Center. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. 6 - 11834 Honorable Mayor Joe Carollo and - JUL 12 jgy Members of the City Commission _ _ = IM10Warshaw City Manager 12 Ordinance Changing Sec. 53-181 of City Code Amending Rate Schedule at Miami Convention Center RECOMMENDATION It is respectfully requested that the City Commission adopt the attached Ordinance amending Section 53-181 of the City Code to modify rental rates and charges at the Miami Convention Center. BACKGROUND The trust indenture for the Miami Convention Center requires the rates and charges be reviewed each year. In compliance with the trust indenture, the Department of Public Facilities reviewed the rates and charges for comparable facilities in South Florida. As a result of this analysis it is recommended that the attached rates and charges be amended to effectively compete with comparable facilities. The proposed rate changes include a 5% increase in the rental of the theater for general sessions, a reduction in the percent of gross sales charged for concert performances, a 15% discount for non-profit events, and a standard charge for ancillary uses such as coffee breaks. Additionally, it is recommended that the department director be authorized to negotiate rental rates if such rates result in securing the business for the Miami Convention Center. In the past the Center has lost business due to the inability to match or reduce rental fees charged by competing facilities seeking the same business. In order to meet the demands of promoters negotiating competitive rates for top performances it is essential to have the' ability to negotiate rental rates in a very competitive market.
