COMMISSION AMENDING CHAPTER 2/ARTICLE XI OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS", TO ESTABLISH THE PARKS ADVISORY BOARD; TO SET FORTH SAID BOARD'S PURPOSE, POWERS, AND DUTIES; TO PROVIDE FOR MEMBERSHIP, QUALIFICATIONS, TERMS OF OFFICE, FILLING OF VACANCIES, OFFICERS, MEETINGS,. QUORUM AND ATTENDANCE REQUIREMENTS, AND ASSIGNMENT OF STAFF, AND TO PROVIDE FOR THE "SUNSET" REVIEW OF SAID BOARD EVERY FOUR YEARS; MORE PARTICULARLY BY ADDING TO ARTICLE XI NEW DIVISION 11, AND BY AMENDING SECTION 2-887 AND 2-892 OF SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission wishes to establish a Parks Advisory Board to provide for broad public input on issues of park programs, operations, expansion and other funding needs which, impact the quality of park services available in the City of Miami; and WHEREAS, the provisions of City Code Section 2-833 require that all City boards be created by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY • • OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as' if fully set forth in this Section. Section 2. Chapter 2, Article XI", entitled "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS", is hereby amended in the following particulars:'/ "Chapter 2 ADMINISTRATION ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS DIVISION 2. STANDARDS FOR CREATION AND REVIEW OF BOARDS GENERALLY Sec. 2-887. Quorum requirements. A quorum for all boards' meetings; except for meetings of the Bayfront Park Management Trust, International Trade Board, Urban Development Review Board, a-nd Affirmative Action Advisory Board; and the Parks Advisory Board, shall consist of 50 percent plus one of the board's total membership. the decision of a majority of the board members present and voting at a meeting at which a quorum is present shall be the decision of the board. �i words and/or figures stricken through shall be deleted. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. It is the intention of the City Commission that the provisions of this Ordinance shall .become and be made a part of the Code of the City of Miami, Florida, as amended, which provisions may be renumbered or relettered and that the word - 7 - 11833 "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such intention. Warshaw -= City Manager -RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Ordinance amending Chapter 2/Article XI of the Code of the City of Miami, Florida, as amended, entitled "Administration/Boards, Committees, Commissions, to establish the Parks Advisory Board. This Ordinance sets forth the board's purpose, powers, and duties and provides the terms of office, officers, and meetings. It further provides quorums, requirements for membership, attendance, and filling of vacancies, as well as requirements for the 'Sunset' review of said board every four years, by adding new division 11, consisting of sections 1160 through 1163 and amending section 2-892 of the City Code. BACKGROUND: The City of Miami Commission directed the Parks and Recreation Department to prepare all. documentation related to the establishment of a Parks Advisory Board. This board is to provide for a broad public input on issues of park_ programs, operations, expansion, and other funding needs which impact the quality of park services available in•the City of Miami. Pursuant to the proposed Ordinance the Parks Advisory Board purpose, powers, and duties would be as follows: 1. To serve in an advisory capacity to the City Commission. 2. To provide periodic review of budget, programming, beautification, security and physical improvements as needed for all City of Miami park and recreational facilities and other public spaces managed or owned by the City of Miami. 3. To submit an annual written report to the Mayor, Commissioners, and the City Manager scheduled to be heard at a City Commission Meeting and to hold an annual public review meeting. 11833 Honorable Mayor and Members of:the City Commission ordinance Establishing Park Advisory Board Page 2 4. To make regular .site visits to parks and consult with schools and neighborhood groups regarding ways of. enhancing the parks to benefit all residents., 5. To seek outside funding from foundations and other sources for park beautification, purchase or redesign of additional parkland,. and equipment with assistance of `.City staff . 6., To oversee the 'possible creation and function of a Miami Park Trust for the purpose of receiving donations to be used for enhancement of specific park projects. 7'.. To hold periodic -meetings and. public programs at which. maximum feasible' public participation will be encouraged. 8. To assure that the design of parks appeal to people of both genders and all ages with' particular attention to.the needs of people of diverse class and cultural background. 9. To -assure that adequate,.park space is provided to the public pursuant to the City's Master Plan- which may be revised to reflect greater- equity to each residential .neighborhood rather than mere citywide compliance. It is therefore recommended that the City Commission adopt the attached Ordinance establishing the Parks Advisory, Board.
