AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING CHAPTER 31/ARTICLE II OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED. "LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS/OCCUPATIONAL LICENSES," BY AMENDING THE SCHEDULE OF OCCUPATIONAL LICENSE TAXES WHICH SETS FORTH THE CLASSIFICATIONS AND RATE SCHEDULE FOR THOSE PERSONS OR ENTITIES DOING BUSINESS IN THE CITY OF MIAMI; MORE PARTICULARLY BY AMENDING SECTION 31-50 OF SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 31, Article II, Section 31-50, of the Code of the City of Miami, Florida (the "Code"), as amended, establishes a schedule of occupational license taxes; and WHEREAS, the City of Miami, pursuant to Chapter 205, Florida Statutes, and Chapter 31 of the Code, is empowered to impose and collect an occupational license tax for the privilege of doing business in.the jurisdiction of the City; and WHEREAS, in response to enabling legislation set forth in Section 205.0535, Florida Statutes (1997), the City Commission, from time to. time, establishes an Occupational License Equity Study Commission ("Study Commission") to publicly meet and study the City's existing occupational license classification system gg I 11825 and rate structures, and make recommendations to the City Commission; and WHEREAS, the Study Commission, established pursuant to Resolution No. 98-856, adopted September 8, 1998, which consists of five (5) City Commission appointed representatives of the City of Miami's business community, held publicly advertised meetings to discuss and study the existing occupational license classifications and rates; and WHEREAS, the recommendations of the Study Commission regarding the rate schedule for occupational licenses have been received and considered by the City Commission; and WHEREAS, the City Commission, after careful consideration of this matter, and not withstanding the recommendations.. 'of the... Study Commission deems it advisable and in the best interest of the general welfare of the City of Miami to (1) allow the prevailing occupational license taxes for most classifications to remain at the existing rates; (2) decrease the assessment of occupational license taxes for certain classifications; and (3) provide for. the assessment of occupational license taxes for newly created classifications as set forth herein; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference - 2 - 11825 thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 31/Article II of the Code of the City of Miami, Florida, as amended, entitled "LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS/OCCUPATIONAL LICENSES" is hereby amended in the following particulars as follows:!/ "Chapter 31 LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS ARTICLE II. Occupational Licenses Sec. 31-50. Schedule of license taxes established. (The amendments set forth on Attachment -No. 1, attached hereto, shall be made a part of and incorporated herein.) Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of �i Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. - 3 - 11825 this Ordinance are hereby repealed. Section 5.
