AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 38/ARTICLE I OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "PARKS AND RECREATION/IN GENERAL," TO PROVIDE THAT THE ADMISSION FEES AT VIRGINIA KEY PARK BE PAID ONLY BY THOSE PERSONS USING BEACH FACILITIES; MORE PARTICULARLY BY AMENDING SECTION 38-9 OF SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to directives at the July 13,. 1999 City Commission Meeting, the City Manager and City Attorney were directed to address the issue of fees currently charged to non - beach users at Virginia Key, and to consider alternatives for said fees, such as a rebate or reimbursement system; and WHEREAS, a specification' that the fees charged at Virginia Key Park be paid by those persons using beach facilities only can be achieved by amending Section 38-9 of the City Code for said purpose; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY 11820 • va OF, MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 38/Article I of the Code of the City of Miami, Florida, as amended, entitled "Parks and Recreation/In General," is hereby amended in the following particulars:" "Chapter 38 PARKS AND RECREATION Article I. In General Sec. 38-9. Park fees for use of Virginia Key Park. "Park fees" for use of the h a h fa iliti -, are hereby established for the City of Miami's Virginia Key Park and shall be assessed upon park users for entry to the park, as follows: (1) Daily pass: a. Three dollars for city residents and $5.00 for nonresidents per automobile or van (a passenger -carrying vehicle designed for a capacity of not more than 16 passengers). b. One dollar for city residents and $2.00 for nonresidents per individual/walk-in. (This shall also allow entry of a person 1 Words and/or figures stricken through shall be deleted. (2) Fees for use of any'designated' picnic areas by groups shall be established by the city manager. (3) Terms, fees and conditions shall be negotiated and established by the city manager for the use, by park permit only, of the southern park area which is serviced by a public bathroom and food service concession facility. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote 3 - 1182.0 of not less than four -fifths of the members of the Commission. Section 7. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.2/ PASSED AND ADOPTED BY TITLE ONLY this 27th day of July 1999. The code amendment for your consideration here sets forth the purpose of the fee charged as being "for use of the beach facilities", thereby exempting those who do not use the beach facilities from paying it.
