ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. --11463, AS
AMENDED, WHICH ESTABLISHED A SPECIAL REVENUE
FUND ENTITLED "LOCAL LAW ENFORCEMENT BLOCK
GRANT PROGRAM"; THEREBY PROVIDING FOR AN
INCREASE TO SAID FUND, IN THE AMOUNT OF
$47,732.04 FOR THE MONTH OF MAY, REPRESENTING
INTEREST EARNED FROM SECOND YEAR GRANT
FUNDING MONIES; PROVIDING FOR THE
APPROPRIATIONS TO SAID FUND OF ANY INTEREST
EARNED FOR FISCAL YEAR 1998-1999, AUTHORIZING
THE CITY MANAGER TO EXECUTE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR.APPROPRIATION OF SAID INTEREST;
FURTHER CORRECTING SCRIVENER'S ERRORS IN
ORDINANCE NOS. 11463, 11547, 11680, 11686 AND
11783 TO ACCURATELY REFLECT THE AMOUNTS
APPROPRIATED TO SAID FUND. BY EACH ORDINANCE
AND TO SPECIFY THE AMOUNTS OF EACH GRANT;
CONTAINING A REPEALER PROVISION, SEVERABILITY
CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Ordinance No. 11463, adopted. March 20,
1997, a special revenue- fund entitled "LOCAL LAW ENFORCEMENT
BLOCK GRANT PROGRAM" was established to appropriate funds, in the
amount of $3,033,834.00, received as a grant from the United
States Department of Justice, Bureau of Justice Assistance, Local
Law Enforcement Block Grant I, which required matching funds from
the City; and
WHEREAS, Ordinance No. 11463 was amended on
September 23, 1997, pursuant to Ordinance No. 11547, to

appropriate additional funds received as a grant from the U.S.
Department of Justice, in the amount of $3,254,220.00 and the
City's matching required funds in the amount of $361,580.00, for
Local Law Enforcement Block Grant II; and
WHEREAS, pursuant to Ordinance No. 11686, adopted July 21,
1998, Ordinance No. 11463 was further amended to reflect an
appropriation of the City's required matching funds in the amount
of $337,093, for Law Enforcement Block Grant I and to appropriate
monies received in the amount of $79,616.00 as a result of
accrued interest earnings for Local Law Enforcement Block
Grant I; and
WHEREAS, pursuant to Ordinance No. 11686, adopted July 21,
1998, Ordinance No. 11463 was further amended to appropriate
interest earned. from Local Law Enforcement'Block'Grant II funding
monies, in the amount of $82,755.18; and
WHEREAS, pursuant to Ordinance No. 11783, adopted
April 27, 1999, Ordinance No. '11463 was again amended to
appropriate additional interest earned from Local Law Enforcement
Block Grant II funding monies, in the amount of $107,907.10; and
WHEREAS, it is now necessary to amend Ordinance No. 11463,
as amended, to appropriate additional interest from Local Law
Enforcement Block Grant II funding monies, 'in the amount of
$47,732.04; and
WHEREAS, Ordinance No. 11463, and amendatory Ordinance
Nos. 11547, 11680, 11686, and 11783 are further amended to

correct scriveners errors to accurately reflect all
appropriations of grant funds, required City matching funds, and
interest earned, by each ordinance and to specify the amount
appropriated to each Block Grant, and
WHEREAS, it is the desire of the City Commission to
authorize the City Manager to appropriate any interest earned to
said account through September 30, 1999; and
WHEREAS, any purchases .for the expenditure of said funds
must comply with applicable City Code purchasing requirements;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The. City Manager is hereby authorized!' to
accept interest earned from Local Law Enforcement Block Grant II
funding in the amount of $47,732.04 and to enter into the
necessary contracts) and/or agreements (s), in a form acceptable
to the City Attorney for acceptance of the aforesaid monies for

the operation of said Program.
Section 3. Ordinance No. 11463, and its amendatory
Ordinances, Ordinance Nos. 11547, 11680, 11686, and .11783, are
hereby amended to accurately reflect the amounts appropriated to
said fund by each Ordinance, to specify the amounts appropriated
to each Block Grant..
Section 4. The City Manager is hereby authorized'I to
accept and appropriate interest earned for Local Law Enforcement
Block Grant II for the fiscal year ending September 30, 1999, and
to enter into the necessary contract(s) and/or agreements(s), in
a form acceptable to the City Attorney for acceptance of the
aforesaid monies for.the operation of said Program.
Section 5. The Special Revenue Fund established pursuant
to Ordinance No. 11463, as amended is hereby amended in the
foll.owing particulars:-'/

Section 6. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 7. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 8. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity of the
City of Miami to make the required and necessary payments to its
employees and officers, payment of its debts, necessary and
required purchases of goods and supplies, and to generally carry
on the functions and duties of municipal affairs.
Section 9. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote

of not less than four -fifths of the members of the Commission.
Section 10. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.4/

It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance
amending Ordinance No. 11463, as amended, adopted March 20`'', 1997, entitled "Local Law
Enforcement Block Grant Program" by increasing the total amount appropriated by $47,732.04, to
reflect additional interest accrued from second year grant funding monies, for a total appropriation
to said fund, in the amount of $7,304,737.32. This Emergency Ordinance also provides for the
appropriation of any additional interest that will be accrued through the expiration of the grant
period, which is September 30'h, 1999.
Additionally, it is necessary to correct an omission by reflecting the appropriation of interest
accrued from first year grant funding monies, in the amount of $79,616.00, which was appropriated
by Ordinance No. 11680, adopted on July 14", 1998.
BACKGROUND
The Department of Police received a Local Law Enforcement Block II Grant administered by the
U.S. Department of Justice, Bureau of Justice Assistance (BJA), for a total of $7,304,737.32
(including interest accrued and matching funds). This grant has accrued additional interest totaling
$47,732.04, which is available to be expended but requires appropriation.
In addition, Ordinance No. 11783, adopted on April 27', 1999, omitted the interest accrued from
first year grant funding monies, in the amount of $79,616.00. It is necessary to correct the
omission set forth in said Ordinance, to reflect the correct amounts appropriated to the "Local Law
Enforcement Block Grant Program".
