HomeMy WebLinkAboutO-11798J-99-464 5/11/99 ORDINANCE NO. 11798 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 11557, ADOPTED OCTOBER 14, 1997, WHICH ESTABLISHED INITIAL RESOURCES AND APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED, "STOP VIOLENCE AGAINST WOMEN", TO INCREASE SAID APPROPRIATIONS, IN THE AMOUNT OF $114,755, CONSISTING OF A GRANT FROM THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS FOR $80,000 AND IN -KIND SERVICES MATCH OF $34,755; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT, AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; FURTHER ALLOCATING $34,755 FROM.THE POLICE DEPARTMENT GENERAL OPERATING BUDGET AS IN -KIND MATCHING FUNDS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, pursuant to Ordinance No. 11557, adopted October 14, 1997, a special revenue fund entitled "Stop Violence Against Women" was established to appropriate funds, in the amount of. $150,000,. for the continuation and .expansion of a comprehensive set of strategies in the fight against. domestic violence using projects such as DVI REACT; and WHEREAS, the Florida Department of Community Affairs has approved an additional grant award in the amount of $80,000 contingent upon a in -kind service match by the City of Miami in 11798 the amount of $34,755, and WHEREAS, it is the desire of the City Commission to accept said grant; and WHEREAS, any purchases shall comply with established procurement procedures; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 2 of Ordinance No. 11557, adopted on October 14, 1997, is hereby amended in the following particulars:` FUND TITLE: STOP VIOLENCE AGAINST WOMEN RESOURCES: Florida Department of Community Affairs Department of Police General Operating Budget In -kind Service APPROPRIATIONS: Stop Violence Against Women $1gQ' QQQ $230, 000 $-;-93-a $111, 7 8 7 $22tea $341, 787 Section 3. The City Manager is hereby authorized to accept the grant from the Florida Department of Community Affairs 1' words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The. remaining provisions are now in effect and remain unchanged. Section 4. Funds in the amount of $34,755 are hereby allocated from the Police Department General Operating. Budget, for the required in -kind matching funds. Section 5. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this.Ordinance shall not be affected. Section 7. This Ordinance is hereby declared.to be an emergency measure on the grounds of urgent. public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 8. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote The herein authorization is further subject to compliance with all: requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable city Charter and code provisions. 3 - 11798 of not less than four -fifths of the members of the Commission. FLORIDA INTER -OFFICE MEMORANDUM To: The Honorable Mayor and Members �,,. ; �,-;� of the City Commission DATE: FILE: SUBJECT: Proposed Emergency Ordinance FROM: �Vo4a.;Ia rshaw REFERENCES: STOP Violence Against Women City Manager Grant ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance, amending Ordinance No. 11557, which established initial resources and initial appropriations for a Special Revenue Fund entitled: "STOP Violence Against Women," accepting an additional grant from the Florida Department of Community Affairs, in the amount of $80,000 with a required match of $34,755 by the City of Miami, totaling $114,755. The City's matching contribution will come from in -kind services consisting of salaries and benefits for three (3) Detectives assigned to the Rapid Enforcement And Containment Tracking Team (REACT) for investigation of domestic violence cases. BACKGROUND The STOP Violence Against Women Grant will provide critical second year funding for the continuation of law enforcement and prosecution strategies, and victim services involving violent crimes against women. The Domestic Violence Intervention (DVI) REACT project has established a multi -disciplinary approach to the intervention of domestic violence by utilizing the strength of two professions to interact in an organized and focused fashion. Police Officers are utilized for investigation and arrest, while Advocates provide immediate support and intense short term follow up case management with victims. The grant funds will be used towards the payment of salaries, professional services of three (3) Victim advocates and program operating expenses. The current project funding will expire on May 31, 1999.
