AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 11590, ADOPTED JANUARY 13, 1998, BY CHANGING THE NAME OF THE SPECIAL REVENUE FUND ESTABLISHED BY SAID ORDINANCE TO "FEMA/USAR GRANT AWARD" AND APPROPRIATING ADDITIONAL FUNDS CONSISTING OF TWO GRANTS FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) IN THE AMOUNTS OF $80,000 FOR FY. 197-98 AND $83,740 FOR FY 198-99, FOR A TOTAL APPROPRIATION OF $163,740, FOR THE PURCHASE OF EQUIPMENT, AND TRAINING, MANAGEMENT, AND ADMINISTRATION OF THE SOUTH FLORIDA URBAN SEARCH AND RESCUE (USAR) PROGRAM; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO ACCEPT SAID GRANTS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN.EFFECTIVE DATE. WHEREAS, the South Florida Urban Search and Rescue ("USAR") Program ("Program") was awarded a grant from the Federal Emergency Management Agency ("FEMA"), in the amount of $76,500, for operation of the Program for FY 196-97; and WHEREAS, pursuant to Ordinance No. 11590, adopted January 3, 1998, a special revenue account entitled "FEMA/USAR Grant Award (FY '96-97)" was established and the above funds were appropriated therein; and WHEREAS, the USAR Program has received additional grant funds from FEMA, in the amounts of $80,000.00 for FY '97-98 and $83,740 for FY 198-99, for the continued operation of the 11793 Program; and WHEREAS, it is now appropriate to accept said grants, execute the necessary acceptance documents, and appropriate said grant funds; and WHEREAS, said grant funds will be used by the Department of Fire -Rescue for the purchase of specialized equipment, training, management and administration of the USAR Program; NOW,THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Section 2 of Ordinance No. 11590 is hereby amended in the following particulars)/: �i Words and/or figures stricken through shall be deleted. 'Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. The City Manager is hereby authorize&1 to accept the aforementioned grant 'and to execute the necessary documents, in a form acceptable to the City Attorney, with FEMA for said purpose. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or, in conflict with the provisions of this Ordinance are hereby repealed. Section 5. 1 If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. BACKGROUND: The South Florida Urban Search and Rescue (USAR) Program was awarded a FEMA grant for operation of the Program for FY `96-97 in the amount of $76,500. Pursuant to Ordinance No. 11590, adopted January 13, 1998, a special revenue fund for the above grant was established and the funds were appropriated therein. The Department of Fire -Rescue has received two additional grant awards for the continued operation of the USAR Program, as specified above, and it is now timely to accept and appropriate said grant funds.
