HomeMy WebLinkAboutO-11791J-97-233 4/15/97 ORDINANCE NO. 117.91 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, C-2 LIBERAL COMMERCIAL DISTRICT, TO CLARIFY THAT RESIDENTIAL USES ARE CONDITIONALLY PERMISSIBLE; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of April 30, 1997, Item No. 3, following an advertised hearing, adopted Resolution No. PAB-30-97 by a vote of five to zero (5-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the.City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY 11791 OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the• City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:1' ARTICLE 4. ZONING DISTRICTS Sec. 401. Schedule of district regulations. C-2 Liberal Commercial. Intent and Scale: The liberal commercial category allows commercial activities which serve. the needs of other businesses, require extensive loading facilities, and often benefit from proximity to industrial areas. The district is also intended to allow a mix of office with retail uses. Hotels, motels+ a•ad rescue missions and residential facilities of a density ec mal to R - 3 _ or higher are the only residential uses allowed in this district. The district permits four (4) types of uses which'`'distinguish C-1 from C-2, including wholesaling, light assemblage, secondhand 1' Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. .The remaining provisions are now in effect and remain unchanged. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the -3- 11791 • C remaining provisions of this Ordinance shall not be affected. Section 5. RECOMMENDATION BACKGROUND AND The proposed modification seeks to clarify the inclusion of ANALYSIS residential uses conditionally to the list of uses currently allowed in the "C-2 Liberal Commercial" zoning classification; the necessary findings which must be made in order to allow residential uses are as follows: 1) the proposed residential development- must be of a density equivalent to R-3 or higher, 2) it must be a logical extension or continuation of existing residential development; and 3) that there are adequate services and amenities in the adjacent area to accommodate the needs of the potential residents. This amendment is being sought in recognition by the City of Miami that there are a substantial number of scattered properties designated "C-2 Liberal Commercial' which are either surrounded by residential areas, or situated in such a way that mid- to high density residential uses are a logical extension of an adjacent residential area.
