AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 10544, AS AMENDED, THE
MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN 1989-
2000 BY AMENDING THE "INTERPRETATION OF THE
FUTURE LAND USE MAP" SECTION OF THE GOALS,
OBJECTIVES AND POLICIES, IN ORDER TO ADD TWO
NEW LAND USE CLASSIFICATIONS ENTITLED
"RESTRICTED PARKS AND RECREATION" AND "MARINE
FACILITIES"; CONTAINING A REPEALER PROVISION
AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE -DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of May 20, 1998, Item No. 5, following an advertised hearing,
adopted Resolution No. PAB 50-98 by a vote of five to zero (5-0),
RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as
hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI$ FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this

Section 2. Ordinance No. 10544, as amended, the Miami
Comprehensive Neighborhood Plan 1989-2000 is hereby amended by
amending the text of the Goals, Objectives and Policies of said
Ordinance as follows:l'
"INTERPRETATION OF FUTURE LAND USE MAP
Conservation: This land use designation is restricted
to environmentally sensitive areas which are to be left
in an essentially natural state. Only activities which
reinforce this character are allowed. Public access to
these areas, including off-street parking, may be
limited when unregulated access may present a threat to
wildlife and plant life within such areas.

Recreation`: This land use designation only allows
public parks and recreation uses.
within parks, such recreation uses permit educational
and cultural facilities such as museums, art galleries
and exhibition space, and marine and marina facilities.
Supporting social and entertainment services
(restaurants, cafes, retailing), public health (clinics
and' daycare centers) and public safety (police
facilities) and entertainment facilities may also be
permissible provided that such activities and
facilities are an integral part of the parks design or
of the recreational function.
Section 3.` All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions .of

this Ordinance are hereby repealed.
Section 4. If any section, part of section,:, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.z/

This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately
upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.

Analysis for Amendment to the Comprehensive Plan
to Create New Land Use Classifications
Application No. 98 - 028
The proposed amendment to the "Interpretation of Future Land Use Map" of the
Goals, Objectives and Policies of the Miami Comprehensive Neighborhood Plan
1989-2000 is in order to create two new land use classifications within the plan.
The new land use classifications being proposed at this time are as follows:
1. Restricted Parks and Recreation: The primary intent of this land use
classification is to conserve the green space of a park while allowing
access and uses which will not interfere with the preservation of any
significant environmental features which may exist within the park in
question.
This land use designation only allows open space and park uses with
limited recreational uses. Such limited recreational uses shall only be
permissible when deemed to be an integral part of a parks character
and when designed and integrated within the park in such a manner so
as to conserve the openness or green space of the park. Some of the
recreational uses deemed to be appropriate include nature trails,
interpretive centers, picnic areas, playgrounds, canoe trails and
launches, small concession stands, restrooms, and other. passive
recreational uses whose scale and manner of operation are similar in
nature to those described herein.
Lands under this designation with specific qualities that make them
desirable for commercial photography shall be allowed to be used in
this manner conditionally, and only when it is determined that
conducting such commercial photo shoots will not endanger significant
environmental features within the area.
2. Marine Facilities: This land use designation is intended to apply to
waterfront properties which are primarily public properties and
intended to be developed and utilized in a manner which will facilitate
public access to waterfront activities. Permissible uses within this
designation include marine and marina facilities, marine stadiums,
waterfront specialty centers (including restaurants, cafes, and retailing),
recreational activities including water theme parks, cultural,
educational and entertainment facilities and accessory hotel
accommodations with maximum. Floor Area, Ratio (FAR) limitations
between the range of 0.65 to. 1.72 upon demonstration that the

application of the higher limitations will not adversely effect access.
Permanent living facilities are not permitted within this classification.
The primary purpose for the creation of these new land use categories is to apply
them to Virginia Key.
The "Restricted Parks and Recreation" category is being proposed in
response to concerns that our Comprehensive Plan has no land use
classification which accommodates a simple passive park. Our Plan jumps from
the "Conservation" category which is intended for environmentally sensitive
areas, to the "Recreation" category which allows major public and recreational
facilities such as the new Arena. The "Restricted Parks and Recreation" category
is intended to be a "pure" parks category which allows traditional park uses only.
The "Marine Facilities" category is being proposed to address the very unique
situation of public waterfront properties intended to be developed in a manner
which will facilitate public access to waterfront activities which include a hotel
component while prohibiting permanent living facilities.
The Department of Planning and Development is recommending approval of this
amendment finding that both categories have value for applications within the
City of Miami and merit inclusion in the Comprehensive Plan.

The City of Miami on March 13 1999 ado ted Ordinances 11773
11775 11777 11779 11781 and
11782 amending the Future Land Use Map and the Text of the Miami Comprehensive Neighborhood
Plan 1989-2000 (MCNP), except that the effective date of the Ordinances is contingent upon the
procedures in Chapter 163.3189 F.S., i.e., DCA compliance review. This package is composed of
Amendments 97-22, 97-23, 98-3, 98-5, 98-6 and 98-11. Pursuant to the requirements of Chapter
163.3187 (1) F.S. 1993 and Rule 9J-11.011, Florida Administrative Code, and the direction of the
Department of Community Affairs (DCA), I am pleased to provide you with one (1) copy of these
documents with the required backup documents consisting of:
a) A response to the checklist provided by the Department of Community
Affairs (DCA), through Rule 9J-11.006, F.A.C. (Attachment A);
b) Analysis of the availability of, and demand on, public facilities (Attachment B);
c) Analysis of the compatibility of the proposed land use change with the land use element goals,
objectives and policies, as well as those of other affected elements (Attachment C);
d) A map illustrating the boundary of the subject property and its location in relation to surrounding
streets, and thoroughfare networks; and the present land use designations of the property and
abutting properties, when applicable (Attachment D);
e) A copy of support documents on which recommendations are based (Attachment E);
