NO. 46 OF THE ZONING ATLAS OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION FROM R- 3 MULTIFAMILY MEDIUM -DENSITY RESIDENTIAL WITH AN SD-3 COCONUT GROVE MAJOR STREETS OVERLAY AND SD-2 COCONUT GROVE CENTRAL COMMERCIAL DISTRICT TO 0 OFFICE WITH AN SD-3 OVERLAY FOR THE PROPERTY LOCATED AT APPROXIMATELY 3250 MARY STREET, MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED HEREIN; MAKING FINDINGS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Zoning Board, at its meeting of April 27, 1998, Item No. 2, following an advertised hearing, adopted Resolution No. ZB 1998-0050, by a seven to one (7-1) vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: y F � • Section 1. The Zoning Atlas of. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Page 46, Article 4, Section 401, Schedule of District Regulations, is hereby amended by changing the zoning classification from R-3 Multifamily Medium Density Residential with an SD-3 Coconut Grove Major Streets Overlay and SD-2 Coconut Grove Central Commercial District to 0 Office with an SD-3 Overlay for the property located at 3250 Mary Street, Miami, Florida, more particularly described as Lots 4, 5 and 7 of Block 10 of EDWARD PENT HOMESTEAD, more particularly legally described in Exhibit "A" attached hereto and made a part hereof, according to the Plat thereof, as recorded in Plat Book "Al' at Page 45, of the Public Records of Dade County, Florida. Section 2. It is hereby found that this zoning classification change: (a) is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) is not contrary to the established land use pattern; (c) will not create an isolated district unrelated to adjacent and nearby districts; (d) is not out of scale with the needs of the neighborhood or the City; (e) will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) is necessary due to changed or changing conditions; -z- 11774 (g) will not adversely influence living conditions in the neighborhood; (h) will not create or excessively increase traffic congestion or otherwise affect public safety; (i) will not create a drainage problem; (j) will not seriously reduce light and air to adjacent area; (k) will not adversely affect property value in the adjacent area; (1) will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; and (m) will not constitute a grant of special privilege to an individual owner so as to compromise the protection of the public welfare. Section 3. Page No. 46 of the Zoning Atlas, made a part of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by reference and description in said Ordinance, is hereby amended to reflect the changes made necessary by this Amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. -3- .11774 Section 6. This Ordinance shall become effective simultaneously with its companion Comprehensive Plan amendment (Ordinance No.11773 ), which takes effect thirty-one (31) days after final reading and adoption thereof pursuant to Section 163.3187(3)(c), Fla. Zoning Board Resolution No: ZB 1998-0050 f1774 a\-.-aas 71".6 TED )-171 ZONING FACT SHEET F Case Number: 1998-0095 27-Apr-98 Item No: 2 Zoning Board: Approval with conditions Vote: 7-1 Appellant: N/A City Commission: Passed First Reading on May 26, 1998. 11774 ANALYSIS FOR ZONING CHANGE Approximately 3250 Mary Street CASE NO: 1998-0095 Pursuant to Article 4, Section 401 and Article 22 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal for an amendment to page 46 of the Zoning Atlas has been reviewed as follows: The request is to change the zoning designation as follows: Portions of lots 4, 5 and 7 of block 10 of "EDWARD PENT HOMESTEAD" as described in the attached legal description "Exhibit A", an approximately 1.36 acre parcel (complete legal description on file with the Hearing Boards Office) from SD-2 "Coconut Grove Central Commercial District" as the southern portion of the parcel is presently zoned and R-3 "Multi -family Medium Density Residential" with an SD- 3 "Coconut Grove Major Streets Overlay" as the northern portion of the lot is zoned, to O "Office". The following findings have been made: L It is found that the subject proposal for the rezoning of property involves an extension of an existing district boundary, involves over 40,000 square feet of net land area and has over 200 feet of linear frontage on one (1) street, thus complying fully with Section 2214.1. of Ordinance 11000, as amended, the zoning ordinance of the City of Miami, the section establishing size limitations (minimum requirements) for rezoning applications. 2. It is found that the proposed change does not conform with the adopted Miami Comprehensive Neighborhood Plan and does require a plan amendment. Specifically the amendment needed is to the Future Land Use Map and it has been applied for simultaneously with the subject application. 3. It is found that contingent on the approval of the accompanying Land Use Designation change request the proposed change will be in harmony with the established land use pattern. 4. It is found that the proposed change is related to the abutting office district, which is located kitty-corner from the subject property to the south-east. 11774 Page 1 of 3 5. It is found that the change requested is not out of scale with the with the needs of the neighborhood or the city so long as development of the subject site remains at the same or similar density it presently holds. An office -type use has existed on the site for some time now which functions well and conforms to the general scale of the surrounding area contributing positively to it. 6. It is found that the proposed change maintains the same or similar population density pattern and thereby does not significantly increase or overtax the load on public facilities. 7. It is found that existing property boundaries are illogically drawn in relation to the existing conditions on. the property proposed for _ change. The office building presently occupying the southern portion of the lot is located on an appropriately zoned site, since office uses are allowed within the SD-2 zoning district; however, the existing surface parking lot occupying the northern, R-3 zoned, . portion of the property is a legal non -conforming characteristic of use which was once permitted. 8. It is found that the present conditions make the passage of the proposed change necessary due to the legal non -conforming status of a portion of the property. 9. It is found that the proposed change has no effect on the living conditions in the neighborhood. 10. It is found that the proposed change has potentially, but not necessarily, a slightly greater impact on traffic but does not, predictably affect public safety to a greater extent than the existing classification. 11. It is found that the proposed change has a similar impact on drainage as the existing classification. 12. It is found that the proposed change has a similar impact on light and air to adjacent areas as the existing classification. 13. It is found that the effect the proposed change will have on the abutting properties.' value will depend on how the property owners avail themselves of the development rights acquired by the proposed change. All things remaining constant, however, the subject proposal on its own has potentially, but not necessarily, a slightly negative impact on the property value for the north abutting property. 14.It is found that the proposed change may contribute to the improvement or .development of adjacent property in accord with existing regulations. It is significantly less likely that the proposed change will have the effect of stalling improvement or development of abutting properties. 11774 Page 2 of 3 15. It is found that the proposed change conveys the same treatment to the individual owner as to owners within the same classification and the immediate area. 16. It is found that there are substantial reasons why the use of the property is unfairly limited under the existing zoning, due to the mixed zoning of a unified site creating a development hardship for the property owner. Based on these findings, the Department of Planning and Development is recommending approval of the application subject to the following condition: . I. That the SD-3 overlay designation extant on the northern portion of the lot be extended to include the remainder of the property thus rendering the whole site, subject of this application, a part of the SD-3 Coconut Grove Major Streets Overlay District .
