AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING SECTION 6 OF ORDINANCE NO. 11705, AS AMENDED, THE ANNUAL APPROPRIATIONS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30, 1999, THEREBY REVISING PREVIOUSLY APPROVED PUBLIC FACILITIES CAPITAL IMPROVEMENT PROJECTS AND INCREASING APPROPRIATIONS TO CAPITAL IMPROVEMENT PROJECT NO. 324002, ENTITLED "ORANGE BOWL RAMPS FROM $250,000 TO $900,000; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission adopted Ordinance No.. 11705, as amended, the Annual Appropriations Ordinance, on September 28, 1998, establishing revenues, appropriations, and annual budget allocations for Capital Improvement Projects for the City of Miami, Florida, for Fiscal Year ending September 30, 1999; and WHEREAS, the latest inspections of the Orange Bowl Stadium indicate that portions of the stadium pedestrian ramps and some structural steel framing members are deteriorating due to the effects of subtropical salt air environment; and WHEREAS, said deterioration presents a threat to the safety and welfare of the public, thereby requiring prompt remediation; and WHEREAS, the City Manager has made a written finding that repair of the Orange Bowl Stadium ramp decking and structural steel framing members constitute a valid, public emergency which 41768 requires the immediate procurement of the required professional services, materials, goods, and/or equipment to protect the health, safety and welfare of the public; and WHEREAS, pursuant to Ordinance No. 11705, as amended, $250,000 was appropriated to Capital Improvement Project. No. 324002; and WHEREAS, said funds are not sufficient for- necessary structural repairs and professional services required and must now be increased to cover the costs related to the City Manager's finding of a valid public emergency; and WHEREAS, previously approved Public Facilities Capital Improvement Projects will be deferred until Fiscal Year 2000 and the available funding will be reappropriated for the work required at the Orange Bowl Stadium; and WHEREAS, appropriations to Capital Improvement Project No. 324002 entitled "Orange Bowl Ramps" must be increased from $250,000 to $900,000; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully. set forth in this Section. Section 2. Section 6 of Ordinance No. 11705, as amended, adopted September 28, 1998, the Annual Appropriations Ordinance - 2 - 11768 • • for Fiscal Year ending September 30, 1999, is hereby amended in the following particulars.4/ "Section 6. The following appropriations are made for implementation of all municipal capital improvements of the City of Miami, Florida, including new capital improvement projects scheduled to. begin during Fiscal Year 1998-99. The appropriations which are designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The sources of revenues to support the appropriations are identified and being set forth for seven program ( I- VII ) areas based upon use or functional category within said areas: THE FOLLOWING APPROPRIATIONS IN ALL CAPITAL PROJECTS ARE., IN THE THOUSANDS OF DOLLARS. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and. - 4 - 117008 duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. Warshaw REFERENCES: City Manager ENCLOSURES: RECOMMENDATION: j E 5 1999 FILE Orange Bowl Stadium Emergency Appropriations Ordinance It is respectfully recommended that the City Commission adopt the attached EMERGENCY ORDINANCE amending Section 6 of Ordinance No. 11705, as amended, the Annual Appropriations Ordinance for the fiscal year ending September 30, 1999; thereby revising previously approved scheduled Capital Improvement Projects in the Public Facilities program area and increasing the appropriations to the existing Capital Improvement Project No. 324002 entitled "Orange Bowl Ramps" from $250,000 to $900,000. BACKGROUND: Inspections of the Orange Bowl Stadium indicate that portions of the stadium ramps and some structural framing members show deterioration from corrosion and are in need of immediate repairs. The City Manager has made a written finding that these needed repairs constitute a valid public emergency to protect the safety and welfare of the public. In order to cover the cost of the work under the City Manager's finding of a valid public emergency, the existing funding of $250,000 for Orange Bowl Stadium ramps repairs needs to be increased. The attached Emergency Ordinance increases the funding for the emergency repairs to the stadium ramps and certain structural framing members from $250,000 to $900,000.
