ORDINANCE N0. 11755
AN ORDINANCE AMENDING SECTION 2-612, ARTICLE
V. OF THE CODE OF THE CITY OF MIAMI, FLORIDA,
AS AMENDED("CITY CODE"), ENTITLED "CONFLICTS
OF INTEREST", TO ALLOW EMPLOYEES OF THE CITY
OF MIAMI TO PARTICIPATE IN THE COMMUNITY
DEVELOPMENT BLOCK GRANT ASSISTED SINGLE
FAMILY REHABILITATION LOAN PROGRAM WITHOUT
SEEKING A WAIVER THEREFOR, SUBJECT TO SAID
EMPLOYEE MEETING CERTAIN CRITERIA; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY
CLAUSE; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, City of Miami employees wishing to participate in
the City of Miami Community Development Block Grant Assisted
Single Family Rehabilitation Loan Program, administered by the
Department of Community Development, are required, by City Code,
to seek a waiver, by Resolution, allowing them to do so; and
WHEREAS, the City Commission wishes to remove the waiver
requirement for city employees wishing to participate in the
above program provided said employee meets certain participation
criteria as herein set forth; and
WHEREAS, to accomplish this, it is necessary to amend the
City Code;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 2-612 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:l/
"ARTICLE V. CONFLICTS OF INTEREST
Sec. 2-612. Transacting business with city;
appearances before city boards,
etc.
(a) No person included in section 2-611 shall•
enter into any contract or transact any business
with the city or any person or agency acting for
the city, or shall appear in representation of any
third party before any board, commission or agency
of which such person is a member, and any such
contract, agreement or appearance entered in
violation of this section shall render the

this Ordinance are hereby repealed.

Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof2/.

by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately

The attached Ordinance is being placed on the January 12, 1998, Commission Meeting
Agenda at the request of the City Commission made at its meeting of November 17, 1998.
This Ordinance allows a City of Miami employee to participate in the Community
Development Block Grant Assisted Single Family Rehabilitation Loan Program ('Program")
without the necessity of seeking a waiver at a public hearing. The employee, however, must meet
certain eligibility requirements for participation in the Program as set forth in the attached
Ordinance.
