ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 13/ARTICLE IV, OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "DEVELOPMENT IMPACT AND OTHER
RELATED FEES/INTERIM PROPRIETARY AND GENERAL
SERVICES FEE", TO PROVIDE THAT THE INTERIM
PROPRIETARY AND GENERAL.SERVICE FEE SHALL BE
PAID IN FULL PRIOR TO' THE ISSUANCE OF A
CERTIFICATE OF OCCUPANCY OR CERTIFICATE OF
COMPLETION AND COLLECTED BY THE DIRECTOR OF
PLANNING, BUILDING AND ZONING DEPARTMENT;
MORE PARTICULARLY AMENDING SECTIONS 13-138,
13-139 AND 13-144 OF SAID.CODE; CONTAINING A
REPEALER PROVISION; A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Chapter 13/Article IV, of the Code of the
City of Miami, Florida, as amended, entitled "Development Impact
and Other Related Fees/Interim Proprietary And General Services
Fee", is hereby amended as follows:1'
"CHAPTER 13
1' Words and/or figures stricken through shall be deleted. Underscored
words and/or figures shall be added. the remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

ARTICLE IV. INTERIM PROPRIETARY
AND GENERAL SERVICES FEE
Sec. 13-138. Fee levied for services to certain
properties.
(a) There is hereby levied an interim proprietary
and general services fee which shall apply to
those properties for which a certificate of
occupancy or a certificate of cp=letion is
issued, either permanent or temporary,. for
full or partial use of the premises, and
which shall be payable on

date upon which such certificate of occupancy
or certificate of co=letinn is issued until
the ensuing January 1.
(b) There is hereby levied an interim proprietary
and general services fee which shall apply to.

occupancy or a certificate of completion is -
issued, either permanent or temporary, for
full or partial use of the premises, and
which shall be payable on a-- mentthl y basis

Sec. 13-139. when fee paid.
The first Rent-h's interim proprietary and general
services fee shall be paid upon the issuance of a
certificate of occupancy, either permanent or
temporary, or a rertificate of om=letion_ and —RHO
certificate of occupancy or certificate of completion
shall be issued until such time as the interim
proprietary and general services fee has been paid in
Sec. 13-144. Collection and deposit.
All money paid for such services shall be collected
by the director of planning, building and zoning

fund."
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof2l.

becomes effective with the elapse of ten (10) days from the date of Commissi ction

This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately
upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.

BACKGROUND
It is respectfully recommended that the City Commission approve the attached Ordinance
authorizing an amendment to the Code of the City of Miami, Florida "Chapter 13, Article
IV. Interim Proprietary and General Services Fee, Sec. 13-138 Fee Levied for services to
certain properties. (a) (b), Sec. 13-139, when fee paid. Sec 13-144 Collection and
deposit.
RECOMMENDATION
There is hereby levied an interim proprietary and general services fee to apply to those
properties for which a certificate of occupancy is issued, for full or partial use of
premises, and which shall be payable on the date upon -which such certificate of
occupancy is issued until the ensuing January 1, or until such time as the improvement
necessitating said certificate of occupancy is assessed by the Miami -Dade County
property appraiser and extended on the tax roll. Fee shall be paid in full prior to the
issuance of a certificate of occupancy and all money paid for such services shall be
collected by the Director of Building and Zoning Department and shall be deposited into
the general fund.
