,AN EMERGENCY ORDINANCE.AMENDING ORDINANCE NO.
11659, WHICH ESTABLISHED INITIAL RESOURCES
AND APPROPRIATIONS FOR A NEW SPECIAL REVENUE
FUND ENTITLED: "EAST LITTLE HAVANA MINORITY
YOUTH DIVERSION PROGRAM", TO INCREASE THE
APPROPRIATIONS FOR SAID FUND IN THE AMOUNT OF
$70,000, CONSISTING OF FUNDS RECEIVED 'AS A
GRANT FROM THE FLORIDA DEPARTMENT OF JUVENILE
JUSTICE AND AN IN -KIND SERVICES MATCH EQUAL
TO $12,924.00, TO BE PROVIDED BY THE
DEPARTMENT OF POLICE; AUTHORIZING THE CITY
MANAGER TO ACCEPT SAID GRANT, AND TO EXECUTE
THE NECESSARY DOCUMENT(S), IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, AUTHORIZING
THE EXPENDITURES OF SAID GRANT FOR OPERATION
OF SAID PROGRAM; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, pursuant. to Ordinance 11659, adopted May 26, 1998,
a special revenue fund entitled "East Little Havana Minority
Youth Diversion Program" was established to appropriated funds,
in the amount of $70,000, to operate a community policing
diversionary program for minority youth in the East Little Havana
section of Miami; and
WHEREAS, the Florida Department of Juvenile Justice has
approved an additional grant award in the amount of $70,000,
which does not include a required $12,924.00, in -kind service
match by the City of Miami, and it is the desire of the City
Commission to accept said grant and further amend Ordinance. No.

11659 by increasing the appropriations to the "East Little Havana
Minority Youth Diversion Program" Special Revenue Fund in the
amount of $82, 924, and reflect a total appropriation to said
fund since its inception, in the amount of $165,848; and
WHEREAS, any equipment/services purchases for said Program
must comply with applicable City Code procurement requirements;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 2 of Ordinance No. 11659, adopted on
May 26, 1998, is hereby amended in the following particulars:I/

APPROPRIATIONS: EAST LITTLE HAVANA MINORITY 60�T $165,848.00
YOUTH DIVERSION PROGRAM
Section 3. The City Manager is hereby authorized2-1 to
accept the grant from the Florida Department of Juvenile Justice,
and execute the necessary documents, in a form acceptable to the
City Attorney, to implement acceptance of said grant for the
operation of said Program.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance. is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on.the functions and
duties of municipal affairs.
The herein authorization is further subject to compliance
with all requirements that may be imposed by the City
Attorney, including but not limited to those prescribed by
applicable City Charter and Code provisions.

Section 7. The requirement of reading this Ordinance on
two.separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.a/

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Emergency
Ordinance, amending Ordinance No. 11659, which established initial resources and initial
appropriations for a Special Revenue Fund entitled: "East Little Havana Minority Youth Diversion
Program" accepting an additional grant from the Florida Department of Juvenile Justice, in the
amount of $70,000. An in -kind, match totaling $12,924 is required of the city; and will be
contributed by the Miami Police and, Parks and Recreation Departments: The Police Department
will donate a percentage of the NET Lieutenant's time to function as the Project Director
(estimated cost: $7,900) and waive payment of the administrative surcharge fees for off -duty
officers (estimated cost: $3,000). The Parks and Recreation Department will donate the use of
space and telephone services at Jose Marti Park (estimated cost: $2,024).
BACKGROUND
The Department of Police has received a grant to operate a community policing diversionary
program for minority youth in the East Little Havana area. This particular neighborhood was
selected because it is among the highest in Florida for violent crime, poverty, overcrowding,
unemployment, and low education attainment. The program targets an under served minority
youth population who have either already committed one offense or are at risk of involvement in
juvenile crime. The goal of the East Little Havana Youth Diversion program is to reduce juvenile
delinquency by providing a prevention, early intervention, and diversion program; during the hours
when juvenile crimes are at a peak, and targeting services to the age group committing most of
these crimes.

approved an award in the amount of $70,000.00, which requires a
in -kind service match equal to $12,924.00 by the Department of
Police, to be applied towards salaries and necessary expenses for
the operation of said Program; and

Monthly Program Activity Report is defined as a narrative report, which summarizes the
activities of the program. At a minimum, the report shall include information on the law
enforcement alternatives to adjudication, neighborhood diversion programs, and minority
youth over representation programs, educational, health, recreational components or
activities, parental participation, speakers and topics. The report shall also include the
number of volunteer hours provided to the program during each month. The report shall
be submitted on form JJDP- 02 (Attachment III).

A list of youth attending during each month shall be submitted monthly as part of the
documentation and shall be a requirement for payment of the invoice.
Attendance sheets providing date, time, location, topic and attendees shall be maintained
at the site as documentation on all workshops, field trips, tutoring sessions or other group
activities.
Service Units shall reflect the program description in the attached grant application,
which is incorporated by reference and made part of these grant conditions.
