Backaround: In 1992, the City Commission adopted Resolution 92-88 which set criteria, requirements and procedures used when issuing revocable permits for the use of space at the Manuel Artime Center. This resolution provided for the issuance of revocable permits by the City Manager to non-profit entities with priority given to cultural entities. The permits that have been issued by the City Manager pursuant to this resolution provided for a fee in the amount of $4.50 sf. This rental rate has been in effect for more than 14 years. If this amount were adjusted for inflation, the rate would currently be approximately $ 7.00 sf. The City is currently subsidizing the use of the buildings in the amount of jy approximately $250,000/year. 1 Current, Use Presently there are nine agencies who occupy office space within the Theater Building. 1 Additionally, there are six agencies who occupy office space within the Office Building. The current monthly fees range from S1/year to $4.50 sf. This fiscal year, the City will receive approximately S47,000 in revenue from the office rentals. A copy of the rent roll for the . Theater Building and the Office Building listing the agencies who occupy each of these } buildings and their respective monthly fees is attached hereto as Exhibit A for reference. #� The current rate for use of the theater is $350 per performance. «'hen an admission fee is charged, the City is to receive 10% of gross ticket sales in addition to the S350. Earlier this year the City Commission adopted Ordinance 11750 which provided a waiver of the 100/0 of gross ticket sales charge for non-profit entities. This waiver was for a one year period which rill expire February 11, 2000. This fiscal year there were 54 events held in the theater which generated approximately $27,400. Additionally, the City held four events in the theater. l Presently there are 38 events tentatively scheduled for FY 2000, five of which are Citv of Miami events. 9 IM Honorable Mayor and Members of the City Commission Page 2 Afarket Rent Aizal srs The Office of Asset Management has conducted an analysis of market rents for similar type office buildings in the area. A copy of their analysis is attached hereto as Exhibit B. Based upon same, the market rent for use of the Office Building would be $8.50 s.f. The market rent for office space within the Theater Building would be $7.75 s.f. The proposed market rent provides for each office tenant to pay rental on its proportionate share of the common areas. The common area factor to be utilized is 1694). This means a tenant using 500 s.f. of office space would pay rent for 565 s.f. The Department of Public Facilities has analyzed the current rate structure for use of the theater and compared it against rates charged by similar facilities. A copy of their suggested rental rates is attached hereto as Exhibit C. Reconznzenclation for Oifice Space: Wwould recommend the City Commission adopt the suggested market rates of $8.50 sf for the Office Building and S7.75 sf for office space in the Theater Building for any new license agreement with for -profit entities. We would further recommend that non-profit agencies receive a 25% discount from the market rates or $6.38 sf for the Office Building and S5.81 sf for the Theater Building. The new rates for non -profits would be applicable for any new license agreements and to any expansion space for existing licensees. The square footage calculation Nvould include each licensee paring its proportionate share of the common area expenses. «'ith the adoption of the rates suggested above, the subsidy by the City could be reduced in future years. Additionally, we would recommend the City Manager be authorized to enter into license agreements with agencies paying the adopted rental rate. The license agreements would include language for increases based upon increases in the consumer price index to cover the increased cost of providing services to the building. 0 Honorable Mayor and Members of the City Commission Page 3 With respect to existing licensees, we would recommend that the licensees paying $4.50 sf be permitted to continue paying the same rate for their existing area. There are currently four licensees, National Journalist. Association of Cuba, Spanish American League Against Discrimination, Colegio de Abogados and Jefatura I111litar Conjunta (Brigade 2506), paying 51.00/yr in the Theater Building. These organizations are utilizing their respective offices on a limited basis. We would recommend that these organizations be relocated into a single office where they could each locate a desk and file cabinet and could share in the use and expense of office equipment such as a fax machine and copier. In the event these organizations need to schedule a meeting, the City would work Nvith them to provide a meeting room for their use. The onl\- licensee pat-ing 51.00/yr in the Office Building is the Lions Home for the Blind. Given that the utilize the premises on a regular basis, we would recommend the City be authorized to Nvork with them to develop a plan for monthly fee payments to the City- in the future. NVe would further recommend the City A'lanager be authorized to issue revocable license agreements with these existing licensees upon negotiation of a mutually acceptable agreement. Recommendation for Theater: We would recommend the City Commission approve the rental rates suggested in Exhibit C. In this manner, the City Nvill be able to at a minimum cover direct costs associated with an event such as security and janitorial services.
