of Zoning Ordinance

The Planning Department does not recommend the proposed change to the Zoning Ordinance.
The City's Zoning Ordinance makes a difference between Animal Clinic and Animal Kennel.
Given the difference in scale and manner of operation the uses are allowed within different
zoning classifications.
Animal Clinics - Allowed in C-1 (Restricted Commercial) by Special Exception. A facility
which provides medical and surgical care for animals and does not include boarding facilities for
healthy animals. However, it allows overnight boarding for up to five (5) sick animals at one
time.
Animal Kennel - Allowed in a C-2 (General Commercial) District. A facility which provides
boarding services for five (5) or more animals.
In doing some research on how neighboring cities address this particular use, the Planning
Department found that the City of Coral Gables allows veterinarian clinics only within their
industrial areas, not Restricted Commercial zones.
The City of Miami is seeing a growth in our commercial corridors which will result in the
increase of our tax base. We believe that amending the Zoning Ordinance to allow the equivalent
of an animal kennel use in a C-I district would be detrimental to the future development of our
commercial corridors. The proposed use is more appropriate in a General Commercial or
Industrial area of the City.
We want to preserve the quality of our C-1 (Restricted Commercial) corridors and encourage
those uses which are intended for those areas, including uses which will promote an active
corridor with ground level activities. -

Agenda
Attached is a proposed amendment to Section 2502 of the Zoning Ordinance. Please
place this amendment on the April, 1999 Planning Advisory Board agenda or at the
soonest available date. Currently, only five sick animals are permitted to stay overnight in
a veterinary clinic in the C-1 district, regardless of the office's size. The attached
amendment would permit the Zoning Board to approve overnight stays for more than five
animals depending on the size of the building, the building's structural construction, and
the proposed operation of the clinic. Special exceptions which require public hearings
before the Zoning Board will still be required for approval of any animal clinic/veterinary
offices in a C-1 district.

11000. AS AMENDED, THE ZONING ORDINANCE
OF THE CITY OF MIAMI. FLORICA, BY AMENCING
ARTICLE 26, SECTION 2602 TO AMEND THE
DEFINITION OF ANIMAL CLINICS; CONTAINING A
REPEALER PROVISION, A SEVERASIUTY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Miami Planning Advisory Board, at is meefM of
1999, Item No. following an advertised hearing, adopted Resolution No. PAS = 99 by a
vote of - to L_;, RECOMMENDING of amending Zoning
Ordinance No. 11000 as hereinafter set forth; and
WHEREAS, the City Commission after meful consideration of this matter deems it
advisable and in the hest interest of the general wefts of the City of Miami and its inhabitants to
amend Ordinance No. 11000 as herelna>ftr set forth;

Section 1. The recitals and gxdings contained in the Preamble to this Ordinance are
hereby adopted by reference thereto and in rporated herein as if fully set fortis in this Section.
Section 2. Ordinance No. 11000, as amended, the Zonkg Ordinance of the City of
Miami, Florida, is hereby amended by amending the taxi of said Ordinance as follows':

Section 3. All ordirnances or parts of ordinances insofar as #W are irxconsistent

this Ordinance is declared invalid, the remaining provisions of iNs Ordnance shall not be affected.

reading and adoption thereof'.
