Warshaw City Manager Copy of Resolution No. 97-907 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached Resolution rescinding Resolution No. 97-907, which accepted the plat of NORTHWESTERN ESTATES. The plat of NORTHWESTERN ESTATES being a proposed subdivision in the City of Miami. BACKGROUND: On December 9, 1997, as a pocket item, the City Commission adopted Resolution No. 97-907, accepting the plat of NORTHWESTERN ESTATES, and accepting the dedications shown on said plat; and accepting a clean Opinion of Title, Subdivision Improvements Agreement and Cover, ant to un immediate construction of certain improvem nts until required by the Department Public Works; and authorizing and directing the City Manager and th The Land postponing the the plat; and providing for the recordation of said plat in the Public Records City Clerk to execute p ent of Dade County, Florida. ords of Miami - After acceptance by the City Commission, the said plat was to be recorded within 120 calendar days of its approval, or it would be in default and deemed abandoned. Subsequently, the owners did not proceed to satisfy the Citty's requirements in order the said plat could be forwarded to Miami Dade County for review and recordation within the alloweq time period --see the attached list of requirements. Three (3) originally signed copies of a clean updated Opinion of Title for property. 2. Paid tax receipts or collection inquiry statements for all of the property. 3. Three (3) originally executed copies of the Subdivision Improvements Agreement. 4. Original Letter of Credit for subdivision improvements. 5. Three (3) originally executed copies of the Covenant To Run With The Land. 6. Copy of partnership papers showing who has the authority to bind the partnership. 7. Utility letter from: 1) Florida Power and Light Company; 2)BellSouth; 3)Miami-Dade Water and Sewer Department addressing final concerns. 8. Check in the amount of $200.00, payable to the City of Miami, for Covenant To Run With The Land. 9. Cashier's Check in the amount of $33.00, payable to the Clerk of the Circuit Court, for recordation of Covenant To Run With The Land. 10. The clean Opinion of Title, Subdivision Improvement Agreement and Covenant To Run With The Land to be executed by Knight Manor Homes of Miami, Inc., a Florida corporation, as general partner for Liberty Housing Associates and Liberty Commercial Associates, both being Florida general partnerships and the property owners, are hereby accepted, and the proper officials are directed to record said documents after execution by the property owner(s) and approval of same by the City Attorney, following the plat recordation in the Public Records of Miami -Dade County, Florida. Section 3. The City Manager and City Clerk are hereby authorized and directed to execute the plat and cause the same to be recorded in the Public Records of Miami -Dade County, Florida. Section 4. State and local laws require the installation of various physical Improvements in the public rights -of -way when property Is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial Investment on your part. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc., caused by this plat will be at the property owners expense. Also, utility easements may be required on the Property being platted. 3. A building permit will not be Issued on the property being platted until the final plat is recorded. Also, the Certificate of occupancy for any building construction will be Issued only after all the required subdivision improvements have been completed. a. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to.the issuance of a building permit 5. Additional Items must be provided to the City of Miami Department of Public works before the final plat Is submitted to the City Commission for approval.
