A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
NEGOTIATE AN AGREEMENT WITH THE DOWNTOWN
DEVELOPMENT AUTHORITY FOR THE USE OF CITY -
OWNED PROPERTY LOCATED AT APPROXIMATELY
405 NORTHWEST 3RD AVENUE, MIAMI, FLORIDA, FOR
THE DESIGN, CONSTRUCTION AND MANAGEMENT OF A
CHARTER SCHOOL; FURTHER DIRECTING THE CITY
MANAGER TO PRESENT THE NEGOTIATED AGREEMENT
TO THE CITY COMMISSION FOR ITS FINAL REVIEW
AND APPROVAL.
WHEREAS, on April 24, 1996, the City of Miami (the "City")
entered into a lease agreement (the "Lease Agreement") with
Miami -Dade County for the use of City -owned property located at
approximately 405 Northwest 3rd Avenue, Miami, Florida, more
particularly described as Block 88, Miami North, as recorded in
Plat Book B, at Page 41, of the Public Records of Miami -Dade
County, Florida; and
WHEREAS, the Lease Agreement was executed for a period of
thirty (30) years, with an expiration date of April 23, 2026; and
WHEREAS, pursuant to the Laws of Florida, Chapter 65-1090,
the City created the Downtown Development Authority for the
purpose of facilitating economic growth in the Downtown area; and

WHEREAS, the Downtown Development Authority is seeking to
develop, in conjunction with the private sector, a charter school
in the Downtown Miami area; and
WHEREAS, the development of a charter school will encourage
and promote development in the Downtown Miami area which is
consistent with the purpose and goals of the Downtown Development
Authority; and
WHEREAS, the City Commission finds it in the best interest
of the City to facilitate the development of such a charter
school;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorizedl� and
directed to negotiate an Agreement, in a form acceptable to the
City Attorney, with the Downtown Development Authority, for use
of City -owned property located at approximately 405 Northwest

management of a charter school.
Section 3. The City Manager is hereby directed to
present the negotiated agreement to the City Commission for its
review and approval.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.2/

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
