HomeMy WebLinkAboutR-00-1099• J-00-1014 11/30/00 RESOLUTION NO. 0 0 -10 9 "" A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING PAYMENT TO MIAMI-DADE COUNTY FOR THE DISPOSAL OF CERTAIN SOLID WASTE COLLECTED IN AND BY THE CITY OF MIAMI, IN AN AMOUNT NOT TO EXCEED $8,506,716, FOR A PERIOD OF ONE (1) YEAR, PURSUANT TO INTERLOCAL AGREEMENTS ENTERED INTO WITH MIAMI-DADE COUNTY, FLORIDA, ON SEPTEMBER 29, 1995; ALLOCATING FUNDS THEREFOR FROM ACCOUNT CODE NO. 422001.320302.6.531. WHEREAS, the City of Miami ("City") entered into two (2) Interlocal Agreements with Miami -Dade County (the "County") for the use of the County Solid Waste Management System Facilities for disposal of certain solid waste materials collected in and by the City; and WHEREAS, the second Interlocal Agreement provides for the suspension or termination of the rights and obligations of the City and County pursuant to the first. Interlocal Agreement for the use of the County Solid Waste Management System Facilities based upon the occurrence of a "condition subsequent" which would occur upon the implementation of the City's Bedminster CITY 'COKKISSION EE'TG OF DEC 1 4 2000 Resolution NV6 Corporation Agreement .which provides for the disposal of municipal solid waste at the Bedminster Facility when it becomes operational; and WHEREAS, the Bedminster Facility has not become operational and the City will continue to dispose of certain solid waste at County facilities during Fiscal Year 100-01; and WHEREAS, the Interlocal Agreements established the fees for Fiscal Year '00-01 for the disposal of materials collected in and by the City at $47.95 or $57.50 per ton at the Resource Recovery Landfill or Transfer Facilities, respectively; and WHEREAS, funds are available from Account Code No. 422001.320302.6.531 for said payment; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to pay Miami -Dade County for the disposal of certain solid waste collected in and by the City of Miami, in an' amount not to exceed $8,506,716, for a period of one (1) year, pursuant to Interlocal Agreements entered into with Miami -Dade County, Florida, on September 29, 1995, with funds therefor hereby allocated from Account No. 422001.320302.6.531. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. BACKGROUND: The City of Miami entered into two (2) Interlocal Agreements with Miami -Dade County (the "County") for the use of the County's Solid Waste Management System Facilities for the disposal of certain solid waste materials collected in and by the City of Miami. The second Interlocal Agreement provides for the suspension or termination of the rights and obligations of the City and the County pursuant to the first Interlocal Agreement between them for the use of the County Solid Waste Management System Facilities based upon the occurrence of a "condition subsequent" which would occur upon the implementation of the City's Bedminster Seacor Services Miami Corporation ("Bedminster") agreement which provides for the disposal of municipal solid waste at the Bedminster Facility should it become operational. The Interlocal Agreements established the fees for the disposal of materials at $47.95 or $57.50 per ton at the Resource Recovery, Landff/iill,,,`or(/Transfer Facilities respectively.
