A RESOLUTION OF THE MIAMI CITY COMMISSION,
RELATING TO THE CONVEYANCE OF FIVE (5) CITY -
OWNED VACANT PARCELS TO THE RAFAEL HERNANDEZ
HOUSING AND ECONOMIC DEVELOPMENT CORPORATION
("CORPORATION") FOR THE CONSTRUCTION OF
APPROXIMATELY FIVE (5) NEW SINGLE FAMILY
HOMES FOR PURCHASE BY LOW AND MODERATE INCOME
FAMILIES; GRANTING AN EXTENSION FROM
APRIL 25, 2001 TO DECEMBER 14, 2001 TO
COMPLETE CONSTRUCTION AND SALE OF FIVE (5)
SINGLE FAMILY HOMES PLANNED IN THE CITY;
AUTHORIZING THE CITY MANAGER TO PROVIDE AN
ALTERNATE PARCEL LOCATED AT
229 NORTHWEST 30TH STREET, MIAMI, FLORIDA, IN
LIEU OF THE CITY -OWNED PARCEL LOCATED AT 1264
NORTHWEST 31ST STREET WHICH PARCEL HAS
CERTAIN TITLE DEFECTS, FURTHER AUTHORIZING
THE CITY MANAGER TO EXECUTE THE NECESSARY
DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR CONVEYANCE OF THE PARCEL, AT NO
COST TO THE CORPORATION AND SUBJECT TO TERMS
AND CONDITIONS AS SET FORTH HEREIN.
WHEREAS, pursuant to Resolution No. 00-346, adopted
April 7, 2000, the City Commission granted a twelve (12) month
extension,
from April
25,
2000 to
April 25, 2001
to Rafael
Hernandez
Housing
and
Economic
Development
Corporation
("Corporation") to complete the construction and marketing. of
five (5) new single family homes on City -owned parcels; and

WHEREAS, title to the subject parcels have not been conveyed
to the Corporation due to a title defect with one (1) of the five
(5) City -owned parcels to be conveyed by the City; and
WHEREAS, the City Manager recommends an extension of time
for the construction and sale of the five (5) single family homes
to be built on the City -owned parcels, and authorization to
provide an alternate City -owned residential parcel at
229 Northwest 30th Street, Miami, Florida, located in the Wynwood
neighborhood, in lieu of the parcel located at 1264
Northwest 31st Street, Miami, Florida, due to title defects;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. An extension, from April 25, 2001 to
December 14, 2001, is hereby granted to Rafael Hernandez Housing
and Economic Development Corporation ("Corporation") to complete
the construction and sale of five (5) single family homes to
qualified low and moderate income families in the City.

Section 3. The City Manager is hereby authorized" to
provide an alternate City -owned parcel located at
229 Northwest 30th Street, Miami, Florida, in lieu of the parcel
located at 1264 Northwest 31st Street, Miami, Florida, which
parcel has certain title defects.
Section 4. The City Manager is hereby authorize&11 to
execute all necessary document(s), in a form acceptable to the
City Attorney, for the conveyance of the said parcels, at no cost
to the Corporation, subject to the following conditions:
construction on the subject parcels must have commenced within
six (6) months from the date of adoption of this Resolution and
construction must be completed and the single family homes sold
to qualified low and moderate income homebuyers by
December 14, 2001, or title to the said parcels shall revert back
to the City.
Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.31
1� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
3/ If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the attached resolution,
authorizing and granting a twelve (12) month extension, from December 14, 2000 to December
14, 2001, for the Rafael Hernandez Housing and Economic Development Corporation to
commence and complete construction of five (5) new single homes on city -owned parcels. The
attached resolution also authorizes the City Manager to provide an alternate city -owned parcel
located at 229 Northwest 30th Street to replace one (1) of the parcels previously conveyed which
has certain title defects that impede construction.

BACKGROUND:
In April, 2000, the City Commission adopted Resolution No. 00-346, granting a twelve (12)
month extension from April 25, 2000 to April 25, 2001, to Rafael Hernandez Housing and
Economic Development Corporation to complete the financing plans, construction and sales of
five (5) homes to qualified low and moderate incomes in the City. Resolution No. 00-346
required that the organization commence construction on the subject parcels within six (6)
months from the date of City Commission action. To date the subject parcels have not been
conveyed to the organization due to certain title defects with one (1) of the parcels located at
1264 Northwest 3 1 " Street. To address this issue, the City Administration recommends
providing the organization with an alternative housing site located at 229 Northwest 30th Street.
The attached resolution grants an additional twelve (12) month extension to Rafael Hernandez
Housing and Economic Development Corporation to secure the balance of the financing,
complete construction and sell -out of the homes to qualified low and moderate income
homebuyers. Construction on the subject city -owned vacant parcels must be underway within
six (6) months from the date of City Commission action, with construction completed and the
new single family homes sold to qualified homebuyers by December 14, 2001, or the subject
parcels will revert back to the City.
