HomeMy WebLinkAboutR-00-1076J-00-1120 12/14/00 • RESOLUTION NO . ~` ~~ ~ ~ ~~ ~~ ~~ A RESOLUTION OF THE MIAMI CITY COMMISSION RELATED TO THE COCONUT GROVE FOOD .AND MUSIC FESTIVAL, ALSO KNOWN AS THE TASTE OF THE GROVE FESTIVAL (THE "FESTIVAL"), CONDUCTED BY THE COCONUT GROVE CHAMBER OF COMMERCE (THE "CHAMBER"), TO BE HELD JANUARY 20-21, 2001, AT PEACOCK AND MYERS PARKS, IN COCONUT GROVE; AUTHORIZING THE CITY MANAGER TO ISSUE A TWO- DAY PERMIT FOR THE SALE OF ALCOHOLIC BEVERAGES DURING SAID EVENT; AUTHORIZING THE CLOSURE OF DESIGNATED STREETS AND ESTABLISHING A .PEDESTRIAN MALL SUBJECT TO ISSUANCE OF REQUIRED PERMITS BY THE POLICE DEPARTMENT; GRANTING VENDING RIGHTS TO THE CHAMBER CONSISTENT WITH AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE CHAMBER, AND ESTABLISHING AN AREA PROHIBITED TO RETAIL PEDDLERS DURING THE PERIOD OF THE FESTIVAL; AUTHORIZING THE PROVISION OF IN-KIND SERVICES, IN AN AMOUNT NOT TO EXCEED $6,000, FROM THE DEPARTMENT OF PARKS AND RECREATION; SAID AUTHORIZATIONS CONDITIONED UPON THE ORGANIZERS: (1) OBTAINING ALL PERMITS REQUIRED BY LAW, INCLUDING BUT NOT LIMITED TO A TEMPORARY PERMIT TO SELL ALCOHOLIC BEVERAGES BY THE FLORIDA DEPARTMENT OF BUSINESS REGULATION., DIVISION OR ALCOHOLIC BEVERAGES AND TOBACCO, PURSUANT TO SECTION 54-13 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED;. (2) PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES AND APPLICABLE FEES ASSOCIATED WITH SAID EVENT; (3) OBTAINING INSURANCE, INCLUDING LIQUOR LIABILITY, TO PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR DESIGNEE; (4) INSTITUTING AN IDENTIFICATION PROGRAM TO ASSURE THAT ONLY THOSE INDIVIDUALS OVER. THE AGE OF TWENTY-ONE MAY PURCHASE ALCOHOLIC BEVERAGES; (5) ADVISING ALL ADJACENT BUSINESSES, PROPERTY OWNERS, AND RESIDENTS OF STREET CLOSURES ASSOCIATED WITH SAID FESTIVAL; AND (6) COMPLYING WITH 'ALL CONDITIONS AND LIMITATIONS AS MAY BE PRESCRIBED BY THE CITY MANAGER OR DESIGNEE. ,, e `~ e'" ~'~'~"~' CO~-IYSS~®N' M~£T~.~P~ ~g ,,di olutio T ~~~ w _~~~ • WHEREAS, Sid Sussman, Chairperson of the Coconut Grove Food and Music Festival, also known as Taste. of the Grove Festival (the "Festival"), and representatives of the Coconut Grove Chamber of Commerce (the "Chamber"), have requested that the City Commission grant permission for the sale of spirit based alcoholic beverages, the closure of certain streets, vending rights, and the provision of in-kind services as they relate to the annual Festival; and WHEREAS, the Chamber has agreed to certain assurances regarding control of vending rights for the Festival; and [nTHEREAS, the City Code, Chapter 39, specifically regulates street vending and provides for conditions under which certain street vending can be controlled during designated special events; and WHEREAS, the City Commission wishes to authorize the provision of in-kind services only from the Department of Parks and Recreation in an amount not to exceed $6,000; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Page 2 of 6 ,~~;cr~.~~~. ~ • Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized to issue a two-day permit for the sale of alcoholic beverages during the Coconut Grove Food and Music, Festival, also known as the Taste of the Grove Festival (the "Festival"), conducted by the Coconut Grove Chamber of Commerce (the "Chamber"), on January 20-21, 2001, at Peacock and Myers Parks in Coconut Grove, Miami, Florida. Section 3. (a) In order to effectuate safe passage and establish a temporary pedestrian mall during the Festival, the following streets are hereby closed to through vehicular traffic from 7:00 A.M. Saturday, January 20, 2001 to 8:00 P.M. on Sunday, January 21, 2001, as specified below: MacFarlane Road from South Bayshore Drive to Main Highway and South Bayshore Drive from McFarlane to 2 7th Avenue ; and Included in the herein closure are all streets, avenues, alleys, ways and thoroughfares which intersect said areas iri the areas of Coconut Grove, Miami, Florida. (b) The Department of Parks and Recreation is hereby authorized to provide in-kind services for the Festival in an amount not to exceed $6,000. Page 3 of 6 -~ ~~'~~~ • Section 4. Such closing of streets is subject to requisite State approval and issuance of permits by the Departments of Police, Public Works,, Fire-Rescue, and such other departments as may be specified in the City Code. The permit from the Department of Police is to be issued upon the full approval of the Chief of Police after giving all. due consideration to the.safety and traffic needs of residents, businesses, and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's. judgment predicated upon all factors set forth herein.:.. Section 5. Pursuant to the provisions of Chapter 39 of the Code of the City of Miami, Florida, as amended (the "Code"), all retail peddlers' occupational licenses issued under the Code, shall not be valid on January 20 through January 21, 2001, on the above designated streets and on all intersecting streets for two blocks in all directions ("Designated Area") In the Designated Area, only business entities duly licensed by the City through the Chamber specifically for this Festival will be permitted to advertise their products, sell their products, or distribute free samples to the public. Section 6. Vending rights are hereby granted to the Chamber for the Festival. Page 4 of 6 ~. ~~ ~'~ • Section 7. The herein authorizations are hereby conditioned upon the organizers (1) obtaining all permits required by law, .including but not limited to a temporary permit to sell alcoholic beverages by the Florida Department of Business Regulation, Division of Alcoholic Beverages and Tobacco, pursuant to Section 54-13 of the Code of the City of Miami, Florida, as amended; (2) paying for all necessary costs of City services and. applicable fees associated with said Festival; (3) obtaining insurance to protect. the City in the amount as prescribed by the City Manager or designee; (4) instituting an identification program to assure that only those individuals over the age of twenty-one may purchase alcoholic beverages; (5) advising all adjacent businesses, property owners, and residents of street closures associated with said Festival; and (6) complying with all conditions and limitations as may be prescribed by the City Manager or designee. Section 8. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.l~ 1~ If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. Page 5 of 6 ® ... A. Park usage fees, B_ Park vendor location fees and alcohol beverage stand fees. The waiver of these fees will help to facilitate the profitability of this event and allow the Chamber of Commerce to secure income desperately needed so we can continue to serve our members and the Coconut Grove community. As it relates to the waiver of fees, the administration recommends denial due to budgetary constraints. Approval of this request may set a precedent for other festivals seeking financial support from the City. BACKGROUND: Mr. Sid Sussman, Vice-President of the Coconut Grove Chamber of Commerce, is appearing before the City Commission to request authorization to sell alcoholic beverages during the Coconut Grove Food and Music Festival scheduled for Saturday and Sunday, January 20-21, 2001. The organizers of the event will meet with City staff, including the Police Department and NET office, as well as with the Coconut Grove Festival Committee, to discuss the festival. The Coconut Grove Festival Committee will approve the event subject to compliance with all rules and regulations prescribed by the City of Miami.
