HomeMy WebLinkAboutR-00-1071J-00-1115 12/14/00 -1071 RESOLUTION NO. 0 A RESOLUTION OF THE MIAMI `CITY' COMMISSION RELATED TO THE 38TH ANNUAL BANK OF AMERICA COCONUT GROVE ARTS FESTIVAL, CONDUCTED BY THE COCONUT GROVE ASSOCIATION, INC., TO BE HELD ON FEBRUARY 17 THRU 19, 2001; AUTHORIZING THE CITY MANAGER TO ISSUE A THREE-DAY PERMIT FOR THE SALE OF ALCOHOLIC BEVERAGES DURING SAID EVENT IN THE AREA OF McFARLANE ROAD FROM SOUTH BAYSHORE DRIVE TO MAIN HIGHWAY AND SOUTH BAYSHORE DRIVE FROM McFARLANE ROAD TO MAIN HIGHWAY, INCLUDING ALL STREETS, AVENUES, ALLEYS, WAYS AND THOROUGHFARES WHICH INTERSECT SAID AREAS IN COCONUT GROVE, MIAMI, FLORIDA; AND DIRECTING THE CITY MANAGER THAT SAID AUTHORIZATION SHALL BE CONDITIONED UPON THE ORGANIZERS: (1) OBTAINING ALL PERMITS REQUIRED BY LAW, INCLUDING BUT NOT LIMITED TO A TEMPORARY PERMIT TO SELL ALCOHOLIC. BEVERAGES BY THE FLORIDA DEPARTMENT OF BUSINESS REGULATION, DIVISION OF ALCOHOLIC BEVERAGES AND TOBACCO, PURSUANT TO SECTION 54-13 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; (2) PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES AND APPLICABLE FEES ASSOCIATED WITH SAID EVENT; (3) OBTAINING INSURANCE TO PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE; (4) INSTITUTING AN IDENTIFICATION PROGRAM TO ASSURE THAT ONLY THOSE INDIVIDUALS OVER THE AGE OF TWENTY-ONE MAY PURCHASE ALCOHOLIC BEVERAGES; (5) ADVISING ALL ADJACENT BUSINESSES, PROPERTY OWNERS, AND RESIDENTS OF STREET CLOSURES ASSOCIATED WITH SAID EVENT; AND (6) COMPLYING WITH ALL CONDITIONS AND LIMITATIONS AS MAY BE PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. The City Manager is hereby authorized to issue a three-day permit for the sale of alcoholic beverages during the 38th Annual Bank of America Coconut Grove Arts Festival, conducted by the Coconut Grove Association, Inc., to be held on February 17 thru 19, 2001, in the area of McFarlane Road from South Bayshore Drive to Main Highway and South Bayshore Drive from McFarlane Road to Main Highway, including all streets, avenues, alleys, ways and thoroughfares which intersect said areas in Coconut Grove, Miami, Florida. Section 2. The herein authorization is hereby conditioned upon the organizers (1) obtaining all permits required by law including, but not limited to, a temporary permit to sell alcoholic beverages by the Florida Department of Business Regulation, Division of Alcoholic Beverages and Tobacco, pursuant to Section 54-13 of the Code of the City of Miami, Florida, as amended; (2) paying for all necessary costs of City services and applicable fees associated with said event; (3) obtaining insurance to protect the City in the amount as prescribed by the City Manager or his designee; (4) instituting an identification program to assure that only those individuals over the age of twenty-one may purchase alcoholic beverages; (5) advising all adjacent businesses, property owners, and residents of street closures associated with said event; and (6) complying Page 2 of 3 with all conditions and limitations as may be prescribed by the City Manager or his designee. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'/ PASSED AND ADOPTED this 14th day of December , 2000. JOE CAROLLO, MAYOR In accordance with Miami Code Sec. 2-36, since the Mayor did not indicate approval of this legislation by signing in the designated place provided, said legislation now becomes effective with the elapse of ten (10) days from the date of commission action regarding same, without the Mayor exercising a vote. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. Beer and wine sales are handled by local service organizations who receive a Daryl A. Grice substantial portion of the proceeds for their fundraising efforts. REFERENCES: ENCLOSURES The administration recommends approval of the Coconut Grove Association, Inc., request to sell alcoholic beverages, subject to the following: • Paying for the cost of all City services and applicable permits fees required by law. • Obtaining insurance,. including liquor liability, to protect the City of Miami in the amount stipulated by City requirements. FILE : • Instituting an identification program to assure that only those over the age of twenty- one will buy alcoholic drinks. • Notifying adjacent businesses, property owners and residents of the upcoming street closures. BACKGROUN ID: Ms. Carol Romine, Executive Director of Bank of America Coconut Grove Arts Festival, is appearing before the City Commission to request authorization to sell alcoholic beverages during their 38`h annual Bank of America Coconut Grove Arts Festival scheduled for Friday. Saturday and Sunday, February 17-19, 2001. The organizers of the event will meet with City staff, including the Police Department and NET office, as well as with the Coconut Grove Festival Committee, to discuss the festival. The Coconut Grove Festival Committee «ill approve the event subject to compliance with all rules and regulations prescribed by the City of Miami.
