HomeMy WebLinkAboutR-00-1065J-00-1085 12/13/00 RESOLUTION NO. o A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH MERCY HOSPITAL, INC., ON BEHALF OF THE SOUTH FLORIDA URBAN SEARCH AND RESCUE ("USAR") TASK FORCE, FOR THE PURPOSE OF MAINTAINING AND PROVIDING AN EXPENDABLE MEDICAL CACHE OF SPECIFIC DRUGS AND SUPPLIES FOR STATE OR FEDERALLY ACTIVATED DISASTER RESPONSE, IN AN ANNUAL MAINTENANCE FEE AMOUNT NOT TO EXCEED $4,200; ALLOCATING FUNDS THEREFOR FOR (1) REQUIRED DISASTER RESPONSE EXPENSES FROM ACCOUNT CODE NO. 110095.280906.6.714, 'AND (2) THE ANNUAL MAINTENANCE FEE FOR MERCY HOSPITAL, IN THE AMOUNT OF $4,200, FROM ACCOUNT CODE NO. 110091.280907.6.340, SAID ALLOCATIONS CONTINGENT UPON ALL EXPENSES BEING 100% REIMBURSABLE FROM STATE OR FEDERAL FUNDING SOURCES. WHEREAS, Resolution No. 93-224, adopted April 15, 1993, authorized the City Manager to execute a Memorandum of Agreement between the City of Miami and the State of Florida and the Federal Emergency Management Agency ("FEMA"), for the purpose of setting forth the parties responsibilities in connection with the development and support of a local Urban Search and Rescue Task Force sponsored by the City of Miami Department of Fire -Rescue; and I CITY COMMISSIO I DIETING Wi DEC 1. 4 ' 2000` F.es��utian No. '. A' � C; WHEREAS, the Task Force is required to maintain a significant amount of expendable, sensitive and time dated pharmaceutical supplies inventory for emergency use; and WHEREAS, pursuant to Resolution No. 95-352, adopted May 11, 1995, Cedars Medical Center entered into an agreement with the Task Force to maintain and inventory pharmaceutical supplies for emergency use; and WHEREAS, Cedars Medical Center no longer wishes to continue providing such services; and WHEREAS, The Task Force has worked out an agreement with Mercy Hospital, Inc. (the "Hospital") whereby the Mercy Pharmacy shall maintain an inventory of pharmaceutical supplies for the Task Force's use in an annual fee not to exceed $4,200; and WHEREAS, after a mobilization and demobilization, the City is to return the unused portion of the supplies to Mercy Pharmacy and reimburse the Hospital for the replenishment of any supplies used; and WHEREAS, supplies will only be requisitioned during State or federal activations whereby the expenses are 100% reimbursable by FEMA or State funding source; and. WHEREAS, funds for the annual maintenance fee for pharmaceutical inventory is available from Account Code No. 110091.280907.6.340 and for disaster response expenses from Account Code No. 110095.280906.6.714; Page 2 of 4�®��� NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorizedl� to execute a Memorandum of Agreement, in substantially the attached form, with Mercy Hospital, Inc., on behalf of the South Florida Urban Search and Rescue ("USAR") Task Force, for the purpose of maintaining and providing an expendable medical cache of specific drugs and supplies for State of Florida or federally activated disaster response, in an annual maintenance fee amount not to exceed $4,200, with funds therefor allocated for (1) disaster response expenses from Account Code No. 110095.280906.6.714, and (2) the annual maintenance fee for Mercy Hospital in the amount of $4,200 from Account Code No. 110091.280907.6.340, said allocations contingent upon all expenses being 100% reimbursable from State or federal funding sources. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2/ 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. FOEMAN CITY CLERK APPROVED AS TO FORM AND CORRECTNESS: ALEJANDRO'-ZALARELLO� CITY ATTORNEY W4910:LB:BSS Page 4 of 4 ®0-10G.5 MEMORANDUM OF AGREEMENT This Agreement entered into this day of �L� , 2000, by and between the City of Miami, on behalf of the South Florida Urban Search and Rescue (US&R) Task Force, Florida Task Force Two (FL TF2); (hereafter collectively referred to as the "City") and Mercy Hospital, Inc., a Florida not -for -profit corporation, (hereafter referred to as "Mercy") WITNES'SETH: WHEREAS, Mercy is a fully licensed and accredited general acute care hospital, located within the boundaries of the City of Miami, 'whose operations include the maintenance ,of a fully licensed Pharmacy Department; and WHEREAS, the City is responsible, during times of emergency preparedness and/or disaster, to activate forces necessary to respond .to emergent situations, which response may include the need for certain pharmaceutical products, and WHEREAS, " the City desires to obtain said pharmaceuticals from Mercy, Viand Mer'�x $ �� .�r.�y desires to store and keep available such pharmaceuticals for the City s use, all upon 'the terms and conditions set forth herein; NOW, THEREFORE, in consideration of the mutual premises, covenants and conditions of this Agreement, the parties hereto agree as follows: I. PURPOSE This Memorandum of Agreement ("MOA") between the City and Mercy sets forth the obligations of the parties with respect to the voluntary positioning within the Pharmacy Department of Mercy and reimbursement of the pharmaceutical cache utilized by FL TF2. . II. RESPONSIBILITIES A. Mercy Hospital agrees to: 1. Provide the pharmaceutical supplies, in such vohIme as specified in Exhibit --A", attached hereto and incorporated herein by reference, and as may be amended from time to time by the City and agreed to by rtilercy (the `Supplies"). Stock and store the SupplieS in such amounts as may be specified by the City and in such a manner as will guarantee that the City will be able to have immediate access thereto. Periodically check the Supplies on a rotation deemed appropriate by iklercy's Director of Pharmacy Services, or his designee, and replace as necessary, to ensure that Supplies are maintained within appropriate expiration periods. lo* 1065 4. Secure controlled substances in a narcotic cabinet under the standard protocol of Mercy until such time that FL TF2 is mobilized and the controlled substances are requested. 5. Designate and maintain available personnel 24 hours a day, with authority to release the Supplies to the City upon proper notification by the City. At all times during the term of this MOA, Mercy shall, in writing, provide the City the name(s), title, phone number, and beeper number of such authorized personnel. 6. At all times during the term of this MOA, Mercy shall restock Supplies within ninety-six (96) hours after the. City returns the remaining and/or unused Supplies released for a deployment. 7. Mercy will prepare and submit an invoice to the City within fifteen (15) days, or as otherwise agreed upon in writing, for reimbursement of Supplies. The invoice will include all expended or damaged Supplies, and any Aexpired;and < replaced Supplies, listed by name, quantity:aad pace Reimbursement 's h be based on the then current `actual costs i-mcurred by -Mercy to 'replace a _ r Supplies ("Acquisition Costs!). B. City Agrees to: 1 Designate and maintain available personnel, 24 hours a day, with authority to request the release of the Supplies. At ll times during the term of the MOA, the City shall, in writing, provide Mercy with the name(s), title, phone number, and beeper number of such personnel. 2. Provide Mercy with refrigeration or appropriate temperature controlled environment for heat sensitive Supplies'when FL TF2 is deployed. 3. Return all unused Supplies and shipping containers to Mercy's Pharmacy and reimburse Mercy for the replenishment of the Supplies in accordance with Section 11 A(7) above. 4. Reimburse Nlercy, in accordance with Section 11 A(7) above, for all Supplies replaced due to expiration of the pharmaceuticals. 5. At the City's option, either it will initially provide to Mercy the initial inventory of Supplies set forth on Exhibit A, or it will pay Nlercy for Nlercy's acquisition of the initial inventory at Nlercy's Acquisition Costs, 6. Any of the Supplies set forth on Exhibit :N which are not on the Mercy fUrmUlary and/or are not routinely stocked by Nlercy, shall be provided by the Cite, both initially and at times of replenishment. 2 7. Reimburse Mercy for its staff time expended in stocking, checking and withdrawing the Supplies, at the rate of S 50.00 per hour. 111. PROCEDURES A. Alert & Activation 1. Upon request, State or Federal disaster assistance, or the prepositioning of FL TF2 the State of Florida or the Federal Emergency Management Agency (FEMA) shall request the activation of forces necessary to respond to an emergency or disaster situation. 2. Upon activation of the FL TF2, the medical component will become operational under the US Public Health Service. The City of Miami Department of Fire -Rescue will notify the Pharmacy Services Department at Mercy, via Dr. Xavier Anton, or his designee: (305) 285-5050. 3. Additionally, Mercy Administration will be notified by the Task Forccii Medical Team Manager via the Vice-President/Operations, or then a pointee x� The Supplies and storage containers will be 'retnevedfromtheMercy� _, x n t Pharmacy by the Iviediaal Director of FL"TF2; or ttieu appointee c 4. At that time, controlled substances will be accounted for and properly released. Once released, accountability of these substances becomes the responsibility of the Task Force. IV. CONDITIONS, AMENDMENTS AND TERMINATION A. The term of this MOA, unless sooner terminated as provided below, will end on December 31, 2003, at which time both parties may agree to renew the association. Renewal will be based on evaluation of the FL TF2 and Mercy Pharmacy Services' ability to conform to procedures and equipment standards are described in this MOA. B. This Agreement may be modified or amended only on written agreement of all parties, and all amendments shall be attached hereto. . C. Any party hereto, upon thirty (30) days prior written notice, may terminate this Agreement. BACKGROUND On April 15, 1993, Resolution 93-224 authorized the City Manager to execute a Memorandum of Agreement between the City of Miami and the State of Florida and the Federal Emergency Management Agency ("FEMA"), for the purpose of setting forth the parties responsibilities in connection with the development and support of a local Urban Search and . Rescue Task Force sponsored by the. City of Miami, Department of Fire Rescue. In 1995, the Task Force entered into an agreement with Cedars Medical Center for the purpose of Cedars Pharmacy providing maintenance and inventory pharmaceutical supplies for emergency use. Recently, Cedars Medical Center advised the Task Force that they no longer wished to provide this service. Therefore, Mercy Hospital, Inc. was approached by the Task Force and agreed to maintain and inventory pharmaceutical supplies for emergency use for an annual fee of $4,200.
