Alt 0 5 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER: TO EXECUTE AN AMENDMENT TO THE EXISTING AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH KATZ, KUTTER, ALDERMAN, HAIGLER, BRYANT & YON, P.A. AND RICHARD- L. SPEES, P.A. TO EXTEND THE TERM OF THE AGREEMENT AT THE SAME TERMS AND CONDITIONS FOR THE PROVISION OF FEDERAL GOVERNMENT LOBBYING AND CONSULTING SERVICES TO THE CITY OF MIAMI FOR A .PERIOD OF ONE (1) YEAR, EFFECTIVE OCTOBER 1, 2000; ALLOCATING FUNDS THEREFOR, IN AN AMOUNT NOT TO EXCEED $100,000, INCLUSIVE OF EXPENSES, FROM ACCOUNT CODE NO. 920216-270, FOR SAID SERVICES. WHEREAS, the City of Miami ("City") continues to have a need for federal government lobbying and consulting services to assist in achieving its legislative objectives at the federal level; and WHEREAS, a Request for Qualifications No. 97-98-055 was issued on April 27, 1998, for the purpose of obtaining federal government representation and consulting services; and WHEREAS, the law firm of Katz, Kutter, Alderman, Haigler, Bryant & Yon, P.A. ("Katz, Kutter"). was one of two firms selected to provide these services to the City for a period of one (1) year; and CITY COMMSSSIOR I EETING OF 9 6 2000 pearlul N WHEREAS, pursuant to Motion No. 98-768, adopted July 21, 1998, the City Commission authorized the City Manager to execute a Professional Services Agreement with said law firm, in an amount not to exceed $100,000, inclusive of expenses; and WHEREAS, Katz, Kutter has been a resource for the Administration on federal issues involving an intergovernmental, multi -use Community Training Center and the Empowerment Zone; and WHEREAS, funds are available from Account Code No. 920216-270 for said services; NOW,. THEREFORE, BE IT RESOLVED BY THE COMMISSION OF .THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorizedll to execute an amendment to the existing agreement, in a form acceptable to the City Attorney, with Katz, Kutter, Alderman, Haigler, Bryant & Yon, P.A. and Richard L. Spees, P.A. to extend the term of the agreement at the same terms and conditions for the provision of federal government lobbying and consulting services to the City of Miami for a period of one (1) year, �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Spees, P.A. for federal lobbying services. Background: After an extensive Request for Proposals process, an evaluation committee recommended that the City award the contract for federal lobbying and consulting services jointly to two proposers —Katz, Kutter, Haigler, Alderman, Bryant & Yon, P.A. in conjunction with Richard L. Spees, P.A. and Greenberg, Traurig, P.A. The City Commission, upon receiving the same recommendation from the City Manager, accepted the recommendation and authorized the City Manager to execute an agreement with the two firms for a one-year period. That contract expired on September 30, 2000. The City Commission reserved the right to extend the contract upon consideration of the accomplishments of the firms. The following are the areas of responsibility of the Consultant pursuant to this Agreement: 1.) Unfunded Mandates, 2.) Empowerment Zones, 3.) Inner City Development, 4.) Preemption of City powers, 5.) Housing and Urban Development, 6.) Homeless Programs, 7.) Human/Social Service Issues, 8.) Planning and Development —Growth Management Issues, 9.) Telecommunications, 10.) Finance and Taxation, 11.) Refugee/Entrant Funding, 12.) Immigration Reform Implementation, 13.) General Government Property Rights. Attached please find an activity report summarizing the efforts taken on behalf of the City during the last term of the contract. This renewal request was delayed to accommodate the additional opportunity anticipated in the budget process because of the election year. We have been actively pursuing a number of projects. In fact, Mike Abrams was in Washington this week and met personally with Congressmen Deutsch and Boyd, and Congresswomen Ros- Lehth= and Meek to push the City's agenda The meetings were successful. Regarding the status of specific projects.requested by the City, they are in the legislative process. Congress is in the muddle of writing the Fiscal Year 2001 budget. There are 13 appropriations bills that together make up the discretionary parts of the federal budget. None of the 13 bills have yet passed this year. Thus, we do not know at this time which Miami projects will be funded by Congress, or at what level. The federal budget year starts on October 1. Most, if not 4 of the appropriations bills will be resolved by then. The projects we have been actively pursuing include: 1. Brownfields Monies --The City is seeking S150,000 to inventory 110 brownfields sites. We are pursuing funding for this through the EPA appropriations bill. We are also monitoring the eRiorts to reform the nation's Superfund law. The House Transportation and Infrastructure Committee reported out a comprehensive Superfund bill last year by a vote of 69-2. The House bill would amend the Superfund law to encourage development of urban brownfields. Unfortunately, that bill, which has wide bipartisan support, also includes a tax on oil and chemical companies to pay for abandoned toxic dump sites (the original Superfund bill had a similar tax, but it expired.) 6W05 Sent By: ; ® 202 624 0659; Nov-2.- 4:49PM; Page .3/4 Congressman Archer, the Chairman of the House Ways and Means Committee, and who represents parts of Houston, is adamantly opposed to the. taxes. He has successfully blocked floor consideration of the bill. In the Senate, the Chairman of the Environment and Public Works Committee, has introduced a bill to develop brownfields only. This bill, which has significant democratic support, avoids the pitfalls of the taxes by only addressing brownfields issues. There is universal support for the brownfields provisions. Unfortunately, a number of other Senators object to any Stgwfund bill unless it is comprehensive. In other words, they do not favor passing a brownfields measure, unless it is part of the broad comprehensive Superf and reform bill. We will continue to monitor this legislation. If either the House comprehensive Superfund, or the narrow Senate Brownfields bill passes; it will provide money and authority to revitalize brownfields. 2. Justice Funding and the COPS program --Miami has several requests before Congress for money from the Justice Department. These include support for continuation of the COPS program, and for two important juvenile justice programs --the Little Haiti After School Diversionary Program and the Miami Love Youth At Risk Project. Funding for all three items should be included in the Justice Department Appropriations bill. 3. Parks --Earlier this year the House passed legislation to restructure our nation's lands purchases. The bill would take the proceeds of offshore oil drilling taxes and apply them to a number of specific purposes, including urban parks. if this bill gets enacted into law, .it would provide additional resources for urban parks throughout the country. The Senate has yet to pass the bill. if it does, the President has indicated he will sign it (provided the Senate does not change the bill drastically). If the bill becomes law, we will work with the City to insure that it gets some parks money. 4. Reimbursements for City expenses associated with the Elian Gonzales case --The City wants reimbursements totaling $2,222,607 for expenses incurred handling the F,lian Gonzales case. We have been in contact with the Justice Department regarding this matter. There is an existing fund at Justice that can be used to cover these expenses. Submissions are made to the Department for approval by the Attorney General- To date, we have helped identify the right procedures and right people to get the petition before the Attorney General. We. will continue to monitor the situation. If necessary, we will mobilize Congress to support the City's request. 5. Flagler Marketplace --We are also working to find fiords for the Flagler Marketplace project. When complete, this project will renovate the commercial core in downtown Miami. The project includes, Flagler, North First and South First Streets connecting Downtown Miami's Bayliont to the Miami River. Sent By: ; ® 202 624 0659; Nov-2 I 4:50PM; Page 4/4 6. Enterprise Zones--N iarni was chosen as a stational Enterprise Zone in the wwnd round of Competition by the Clinton Administration. Unfortunately, the Congress has yet to provide the funding that was originally promised when the program was created. Last year, we worker) with other "second round" cities to get an appropriation of $3.5 million for each city. We continue to work with the same coalition to get full funding for the enterprise program. On a longer term, we are working to authorize a police multidisciplinary training center. We do not believe the project will be successful this year, but we are working to get it included in the FY 2002 budget. If you have any questions, please do not hesitate to contact me. 00-1, 015
