WHEREAS, the Department of Conferences, Conventions and
Public Facilities requires the acquisition of inspection and
analysis services for the fire alarm system at Miamarina at
Bayside; and
WHEREAS, the system has malfunctioned since its
installation in October 1997 due to circuit shorts, most likely
caused by excessive condensation; and

WHEREAS, all efforts to compel the installer of the fire
alarm system to correct the problem have been unsuccessful to
date; and
WHEREAS, the immediate inspection and analysis of the
system to determine the cause of the problem is necessary for
the protection and safety of Miamarina tenants, guests and the
general public; and
WHEREAS, Diversifire Systems, Inc. provided a responsive
and responsible informal quote for the inspection and analysis
of the fire alarm system at Miamarina; and
WHEREAS, the City Manager made a written finding that the
inspection and analysis of the fire alarm system constitutes a
valid emergency; and
WHEREAS, the Director of Conferences, Conventions and
Public Facilities recommended that the requirements for
competitive sealed bidding procedures be waived and that the
City Manager authorize the immediate inspection and analysis of
the fire alarm system at the Miamarina;
WHEREAS, funds are available from the Miamarina Operating
Budget Account Code No. 413000.350505.840;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote of
the members of the City Commission, the City Manager's finding
of an emergency, waiving the requirements for competitive sealed
bidding procedures and authorizing the acquisition of inspection
and analysis services for the fire alarm system at Miamarina at
Bayside, from Diversifire Systems, Inc. for the Department of
Conferences, Conventions and Public Facilities, in an 'amount not
to exceed $5,125, is hereby ratified, approved and confirmed,
with funds therefor hereby allocated from the Miamarina
Operating Budget, Account Code No. 413000.350505.840.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/
1� If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar, days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of, the veto by the City Commission.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Resolution ratifying,
approving and confirming the City Manager's finding of an emergency, waiving the requirements
for competitive sealed bids and approving the purchase of inspection and analysis services for the
fire alarm system at Miamarina at Bayside from Diversifire Systems, Inc. in the amount of
$5,125.00. Funding is available from the Miamarina Operating Budget, Account No.
413000.350505.840.
BACKGROUND
The fire alarm system at Miamarina is not functioning. The system was installed in October, 1997
and has malfunctioned since inception, due to circuit shorts possibly caused by excessive
condensation. All efforts to compel the installer of the system to correct the problem have been
unsuccessful to date. The manufacturer of the fire alarm system, Faraday, Inc., has recommended
that the vendor proposed for this work, a licensed and certified service/repair company for Faraday
systems, conduct a thorough inspection and analysis of all components of the system in order to
determine the root cause of the problems.
Diversifire Systems proposes to conduct a complete analysis of the system to determine the actual
repair work required to make the system operational. At that time, if it is determined that the
system was improperly installed, the Department of Conferences, Conventions and Public Facilities
will pursue all means necessary to seek reimbursement from the responsible parties.

This serves to request your approval to initiate an Emergency Purchase Order to conduct a
thorough inspection and analysis of the pole mounted audio/strobe fire alarm system at
Miamarina at Bayside. This analysis has been estimated to cost $5,125.00. Funding for this
work is available from Miamarina's FY 2000 Operating Budget, from expense line item no.
413000.350505.6.840, as verified by the Budget Department (see below).
The Fire Alarm system at Miamarina is not functioning. The current system was installed as
part of the Miamarina Reconstruction ProjggtS, lg51 in October, 1997. This system has
malfunctioned since inception, due t�u}1�te "{ ossibly caused by excessive
condensation. All efforts to compel the installer oys emto correct the problem have
been unsuccessful to date. The manufacturer of the fire alarm system, Faraday, Inc., has

Once Diversifire Systems has cohey will provide us with a proposal for

I have attached some amplifying background information relevant to this matter, for your
perusal. It is with this in mind that we request your approval for the above. Thank you for

Re: Miamarina at Bayside - Fire Alarm System
As per your request, following is a quotation for a review and evaluation of your
existing Faraday fire alarm system as follows:
A) We will examen all fire alarm devices to verify that they are "UL" listed for the application for
which they have been installed, specifically that they are weatherproof devices.
B) We will examen all fire alarm devices to verify if they were installed properly and as per the
manufacturers installation Instructions which is required in order to maintain their "UU listing.
C) We will examen and inspect the "poles" on which the dock devices have been mounted, with
regard to the actual mounting method of the fire alarm devices with specific emphasis on the device
backboxes and the conduit / wire entry.
E) We will test the fire alarm panel and remote annunciator to verify proper operation and whether or
not it is in need of any repairs, however we are aware that the batteries are in need of replacement
which much be done In order for us to perform the testing as described above, and as such, the price
quoted includes a new set of batteries.
Price: $6,126.00 + Tax
I felt that the best approach at accomplishing an overall review of your system was to
inspect the poles and devices as is outlined above, and the fire alarm panel itself along
with the annunciator panel.
From this review, we should be able to find out what the problems are in your system
including where the ground fault troubles are coming from. You will be provided with a
written report of our findings upon completion of our inspection.
This quotation does NOT included any inspection of the conduit raceway system or its
internal wires, as from our inspection of the pole mounted fire alarm devices, and the
poles themselves, I firmly believe that we should be able to isolate and determine the
source of the fire alarm panel's ground fault trouble condition, and from the information
I have at this time, it appears that is most likely to be with the devices, or within the
poles.
TERMS: COD or Net 30 with approved credit, payment terms and a properly executed PO, NO RETAINAGE

Attached please find a copy of a proposal from Diversifire Systems, Inc. for the review and
evaluation of the defective fire alarm system at Miamarina. Funding is currently available within
the Miamarina FY 2000 Budget. This should be considered as Phase 1 of a 2 Phase project, as this
proposal is for the identification of the cause(s) of the problems contributing to the systemic failure
of the system. After the cause(s) have been identified, the company will submit another proposal to
correct the problem.
As you will recall, my inability to get BASS United Co. (another factory authorized service
company for our fire alarm system) to inspect the system or provide a proposal for the work
outlined above led me to contact the system's manufacturer directly — the manufacturer
recommended Diversifire Systems, Inc. to me.
I will prepare the paperwork necessary to initiate an Emergency Purchase Order for the work
outlined above. After this evaluation has been completed I believe that it is important that we
schedule a meeting with the Public Works Department, and probably the Law Department, to
discuss available options in recovering all of our costs associated with repairing this system.

Defective Fire Alarm System

This will serve to document (once again) the continuing problems we are experiencing with the
Fire Alarm System at Miamarina. On March 29, 1999, after two days of intermittent malfunction
and false alarms, I telephoned Bob Waddle of Marina Power to (again) seek his assistance in
remedying the problem. Mr. Waddle promised, and has continued to promise, to send out the
manufacturer's technicians to correct the problem - to date no one has shown up to look at the
system.
As you know, this Fire Alarm System has been malfunctioning since, at least, December of 1997
when I arrived. We have repeatedly attempted to compel Mr. Waddle and Mr. Andrews of SERLL
Electric to permanently correct these chronic problems, without success. I am at a loss as to what
to do next - any assistance that you might be able to provide is greatly appreciated.
