AFTER A DULY ADVERTISED PUBLIC HEARING,
RATIFYING, APPROVING AND CONFIRMING THE
.CITY MANAGER'S FINDING OF AN. EMERGENCY,
WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE
ACQUISITION OF ELECTRICAL SPLICE
REPLACEMENT SERVICES FOR THE PROJECT
ENTITLED "DINNER . KEY MARINA SPLICE
REPLACEMENT PROJECT (3RD BIDDING) B-6325,"
.CAPITAL IMPROVEMENTS PROJECT NO. 326004,
FOR THE DEPARTMENT OF PUBLIC WORKS FROM
TRI-CITY ELECTRIC COMPANY, INC., IN THE
AMOUNT OF $201,875; ALLOCATING FUNDS
THEREFOR FROM THE FISCAL YEAR 1999 GENERAL
FUND AND FISCAL YEAR 2000 GENERAL FUND
SURPLUS, AS, APPROPRIATED BY THE ANNUAL
APPROPRIATIONS AND CAPITAL IMPROVEMENT
PROJECTS ORDINANCES, IN THE AMOUNT OF
$197,875 FOR THE CONTRACT COSTS AND $4,000
FOR ESTIMATED EXPENSES, FOR A TOTAL
ESTIMATED COST OF $201,875; AND AUTHORIZING
THE CITY MANAGER TO EXECUTE A CONTRACT, IN
A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR
SAID PURPOSE.
WHEREAS, since 1993, power.outages have recurred on the
piers due to salt water intrusion of the electrical wires located
below the pier decking; and

WHEREAS, the City Manager made a written finding that the
electrical repairs constituted a valid emergency; and
WHEREAS, three (3) informal quotes were obtained and the
City Manager awarded the contract to commence the necessary
repairs that would prevent further power outages to Tri-City
Electric Company, Inc., the lowest responsive and responsible
quote; and
WHEREAS, upon further inspection, numerous electrical Code
violations were identified on the piers; and
WHEREAS, the City Manager made a written finding that the
repair to bring the electrical Code violations into compliance
constituted.a valid emergency; and
WHEREAS, the City Manager and the Directors of the
Departments of Public Works. and Conferences, Conventions and
Public .Facilities recommended that the- requirements for
competitive sealed bidding procedures be waived for repair of.the
electrical Code deficiencies and`that the City Manager authorize
the immediate acquisition of the additional electrical services
from Tri -City Electric Company, Inc . ; and
WHEREAS, funds are available from the Fiscal Year 1999
General Fund and the Fiscal Year 2000 General Fund Surplus, as
appropriated by the Annual Appropriations and Capital Improvement
Projects Ordinances;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote of
the members of the City Commission, the City Manager's finding
that valid emergencies existed, waiving formal competitive
bidding procedures and authorizing the acquisition of electrical
repairs for the Department of Public Works project entitled
"Dinner Key Marina Splice Replacement Project (3rd Bidding)
B-6325" from Tri-City Electric Company, Inc., in the proposed
amount of $197,875, are hereby ratified, approved and confirmed.
Section 3. The total estimated project costs of $201,875
are hereby allocated for Capital Improvement Project No. 326004,
consisting of contract costs in the amount of. $197,875 and
estimated expenses in the amount of $4,000, from the Fiscal Year
1999 General Fund and the Fiscal Year. 2000 General�Fund Surplus,
as appropriated by the Annual Appropriations and Capital
Improvement Projects Ordinances.
Section.4. The City Manager is hereby authorized) to
enter into a contract, in a form acceptable to the City Attorney,

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached
Resolution ratifying, confirming and approving the City Manager's finding that a valid
emergency exists on the piers at Dinner Key Marina, waving formal competitive
bidding procedures and authorizing the City Manager to enter into a contract on behalf
of the" City with Tri-City Electric Company, Inc., whose principal is Rod Borden,
President, a company located at 625 NW 16th Avenue, Miami, Florida, for the project
entitled, DINNER KEY MARINA ELECTRICAL SPLICE REPLACEMENT PROJECT (3RD
BIDDING), B-6325, in the amount of $197,875.00.
BACKGROUND
The intrusion of salt water has corroded the electrical splices below the pier decking at
Dinner Key Marina, resulting in re -occurring power outages. The frequency of these
power outages prompted the City Manager to deem the replacement of the electrical
splices an emergency. On October 29th, 1999, the City received informal bids from
three (3) qualified contractors. The Departments of Public Works and Public Facilities
deemed Tri-City Electric Company, Inc. to be the lowest responsible and responsive
bidder, in the amount of $34,875.00. On December 15th, 1999, a contract was awarded
to Tri-City Electric Company, Inc. to replace the electrical splices.
During the Building Department initial inspection on the piers, additional code
violations were found. The scope of work of the project was subsequently revised to
include the repair of these violations. Based on the recommendation of the Director of
the Department of Public Facilities, the City Manager made a written finding that a
valid emergency exists to increase the contract with Tri-City Electric Company, Inc. by
the amount of $163,000.00 for the additional repairs.
Funds for the bid amount of $34,875.00 are available from Fiscal Year 1999 General
Fund, and funds for the increase of $163,000.00 are available from Fiscal Year 2000
General Fund surplus. The amended contract cost of $197,875.00 is the sum of
$34,875.00 and $163,000.00.

Please allow this to serve as a request for your authorization for the following emergency actions
previously approved by former City Manager Donald Warshaw, and which now require an
expanded scope of work.
The Dinner Key Marina Electrical Splice Replacement Project, B-6325, was originally contracted
with Tri-City Electric Company, Inc. (TCE) for the replacement of the 480-volt electrical splices
below the pier decking in the amount of $34,875. Funds were allocated from CIP Project No.
326004, Index 319301.830. On May 25, 2000, per the requirements of the electrical inspector, the
scope of work was revised to include the repair of additional electrical code violations on the piers.
The violations include loose electrical conduits, damaged pullboxes and improper electrical splices
inside the dummy pedestals. These conditions do not meet current code requirements and are a
threat to public safety.
Pursuant to the attached memo from Albert Dominguez, Assistant Director, the Department of
Public Works has advised that all the funds have been spent for the electrical repairs on Pier 5, and
they have determined that an additional $163,000 will be required to complete the electrical repairs
on the remaining seven piers.
We request your approval to allocate funding in the amount of $163,000 for these repairs, and to
proceed on an emergency basis to make these repairs. Please indicate your preference by siding
below. _

Feeder Wires and Splices
This memorandum .serves to request a waiver of competitive bidding requirements to make
emergency repairs to the electrical feeder wires and splices located below the piers and quay
decking at Dinner Key Marina.
Dinner Key Marina is experiencing abrupt power outages on the piers. A visual inspection of the
480 volt feeder wires inside the conduits and boxes has indicated that the power outages are
caused by the intrusion of salt water. The reoccurring power outages presents a threat to public
safety and property. The marina has 580 slips and is currently 94% utilized. The intermittent
power outages are adversely affecting the welfare and enjoyment of our patrons.
The Department of Public Works has contacted three (3) electrical contractors and obtained the
following quotes. Attached, please find a copy of the analysis.

procurement as the most responsive and lowest bidder. The Department of Conferences,

for this emergency procurement is available from the Capital Improvements Program, Project
No. 326004, Index -519301.830 Legislation will be prepared for ratification by the City

PLEASE ALL TAKE NOTICE THAT a public hearing will be held by the City
Commission of the City of Miami, Florida, on November 16, 2000, at 9:30 a.m. in
the City Commission Chambers at City Hall, 3500 Pan American Drive, Miami,
Florida, for the purpose of discussing the ratification of the City Manager's
finding of an emergency with the Dinner Key Marina Splice Replacement Project.
All interested persons are invited to appear and may be heard concerning this
Ordinance. Should any person desire to appeal any decision of the City
Commission with respect to any matter considered at this hearing, that person
shall ensure that a verbatim record of the proceedings is made, including all
