HomeMy WebLinkAboutR-00-0995J-00-756 11/16/00 RESOLUTION NO. 00- 995 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5T11) AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PROCUREMENT FOR THE DEPARTMENT OF FIRE -RESCUE OF ONE (1) LIFEPAK DEFIBRILLATION/MONITOR, WITH REMOTE PACING AND 12-LEAD CAPABILITY AND RELATED EQUIPMENT FROM MEDTRONIC PHYSIO-CONTROL CORPORATION, THE SOLE SOURCE PROVIDER, AT A TOTAL AMOUNT NOT TO EXCEED $20,000; ALLOCATING FUNDS THEREFOR FROM THE GRANT ENTITLED FEMA/USAR GRANT AWARD (FISCAL YEAR 2000), PROJECT NO. 110091, ACCOUNT CODE NO. 280904.840. WHEREAS, since 1984 the Department of Fire -Rescue has used medical equipment provided by Medtronic Physio-Control Corporation; and WHEREAS, said Department's Urban Search and Rescue ("USAR") Team now requires one (1) Y2K compliant LifePak defibrillator, monitor with remote pacing and 12-lead capability with related equipment; and WHEREAS, since all Department of Fire -Rescue cardiac monitoring and defibillation equipment is man CITY CONXISSION MEETING OF 1 6 2000 Resolution No. Go- 995 Medtronic Physio-Control, Medtronic Physio-Control Corporation can also provide such equipment for the USAR Team; and WHEREAS, the defibrillation equipment and cardiac monitoring is fully compatible with current equipment used by the Department of Fire -Rescue and the firefighters are familiar with the intricacies of the equipment; and WHEREAS, Medtronic Physio-Control Corporation has been previously deemed a sole source provider for the acquisition of defibrillation and monitoring equipment used by the City; and WHEREAS, the Chief Procurement Officer has adopted a finding that Medtronic Physio-Control Corporation is the only supplier of the defibrillator, monitor and related equipment required by the USAR Team; and WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of. the City Manager; and WHEREAS, the City Manager recommends that the requirements for competitive bidding procedures be waived and the purchase of one (1) defibrillator, monitor and related equipment from Medtronic Physio-Control Corporation, the sole source provider, be approved; and WHEREAS, funds are available from the FEMA/USAR Grant Award (Fiscal Year 2000), Project No. 110091, Account Code No. 280904.840. Page 2 of 4 An— 995 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this section. Section 2. By a four -fifths (4/5ths) affirmative vote, after a duly advertised public hearing, the members of the City Commission hereby ratify, approve and confirm the City Manager's finding of sole source, and the requirements for competitive sealed bidding procedures are hereby waived and the procurement of one (1) defibrillator, monitor and related equipment from Medtronic Physio-Control Corporation, the sole source provider for said equipment, for the Department of Fire -Rescue, is hereby ratified, approved and confirmed, at a total amount not to exceed $20,000, with funds therefore hereby allocated from the grant entitled FEMA/USAR Grant Award (Fiscal Year 2000), Project No. 110091, Account Code No. 280904.840 for said procurement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'/ 1� If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. BACKGROUND The Department of Fire -Rescue has been utilizing equipment provided by Medtronic Physio- Control Corporation since at least 1984. The Department.has conducted an extensive field test which involved the major vendors of this type of equipment. The test results proved that the Medtronic Physio-Control product is superior in function and reliability. Since all Department of Fire -Rescue cardiac monitoring and defibrillation equipment is manufactured by Medtronic Physio-Control, the equipment proposed for purchase is fully compatible with all accessories and firefighters which participate in the Urban Search and Rescue Team are familiar with the equipment. As the Chief Procurement Officer has deemed Medtronic Physio-Conrol Corporation as a sole source; it is therefore recommended at this time that the City Commission ratify the City Manager's finding of sole source and authorize the purchase of this equipment. The City of Miami has been purchasing various medical equipment from Medtronic Physio Control Corporation as a sole source provider since at least 1984, and has maintained a sole source maintenance and service agreement with that firm to maintain said equipment during this period of time. The Department has conducted an extensive field test and determined the Medtronic Physio-Control product is superior in function and reliability. The Department of Fire -Rescue is now seeking to purchase one (1) defibrillator, monitor with remote pacing and 12 lead capability, for the USAR Team. Since all of the Department of Fire -Rescue's cardiac monitoring and defibrillation equipment is manufactured by Medtronic Physio-Control, the equipment proposed for purchase is fully compatible with all accessories. Firefighters, which participate in the Urban Search and Rescue Team, are thoroughly familiar with the equipment. Medtronic Physio Control is the manufacturer and sole source provider for the LifePak 12 monitor defibrillator. No other monitor defibrillator is compatible with the LifePak defibrillation/monitor, which is currently being used by the Department of Fire -Rescue. As a result, Medtronic Physio Control is the sole source provider for the acquisition of the new generation of monitor defibrillator and is fully compatible with the existing equipment being used by the Department for many years. The acquisition of equipment and maintenance by Medtronic Physio Control has been previously deemed a sole source pursuant to Resolution Number 00-136. The proposed cost for the acquisition of one (1) defibrillator, monitor, with remote pacing and 12 lead capabilities, which is Y2K compliant, is $20,000.00.
