A RESOLUTION OF THE MIAMI CITY COMMISSION
AMENDING RESOLUTION NO. 99-206, TO EXTEND THE
AMNESTY PERIOD FROM ENDING DECEMBER 31, 2000
TO JUNE 30, 2001, FOR CONSTRUCTION, REPAIRS
AND ADDITIONS, BUILT WITHOUT PROPER PERMITS,
OR PERMITS WHICH EXPIRED WITHOUT THE ISSUANCE
OF CERTIFICATES OF COMPLETION FROM
OCTOBER 29, 1957 THROUGH JULY, 1997, TO BE
BROUGHT INTO CONFORMANCE WITH THE PROVISIONS
OF THE SOUTH FLORIDA BUILDING CODE IN EFFECT
AT THE TIME THE CONSTRUCTION, REPAIRS OR
ADDITIONS WERE MADE, SAID EXTENSION
CONTINGENT UPON MIAMI-DADE COUNTY TAKING ALL
ACTIONS NECESSARY TO EXTEND THE AMNESTY
PERIOD GRANTED BY MIAMI-DADE COUNTY AMNESTY
ORDINANCE (ORDINANCE NO. 97-107) BEYOND
DECEMBER 31, 2000; REITERATING, PURSUANT TO
RESOLUTION NO. 99-206, THE ADOPTION AND
INCORPORATION OF THE PROVISIONS SET FORTH IN
THE AMNESTY ORDINANCE AS PART OF THE BUILDING
CODE OF THE CITY OF MIAMI; AND DIRECTING THE
CITY MANAGER TO INSTRUCT THE BUILDING
OFFICIAL OF THE CITY OF MIAMI TO CONTINUE TO
IMPLEMENT AND ENFORCE THE PROVISIONS OF SAID
ORDINANCE; PROVIDING FOR TIME LIMITATIONS AND
AN EFFECTIVE DATE.
WHEREAS, the South Florida Building Code ("SFBC") was
amended pursuant to Miami -Dade County Ordinance No. 97-107 (the
"Amnesty Ordinance"), adopted July 8, 1997, to provide for an
amnesty period to allow property owners to bring into compliance
additions or repairs to Group I and Group J Occupancies and
accessory structures, built without proper permits or permits

which had expired issued during the period of October 29, 1957
and July, 1997; and
WHEREAS, the Amnesty Ordinance allows that repairs or
additions be deemed to be in compliance with the SFBC provided
the owner furnishes satisfactory evidence to the Building
Official that the repairs or additions to the structures satisfy
the requirements of the Code in effect on the date such repairs
or additions were made; and
WHEREAS, pursuant to Resolution No. 99-206, adopted
March 23, 1999, the City Commission (1) established an amnesty
period, ending December 31, 2000, to allow repairs and additions,
built without proper permits, or permits which expired without
the issuance of certificates of completion from October 29, 1957
through July, 1997 in the City of Miami, to be brought into
conformance with the provisions of the SFBC in effect at the time
the construction of such repairs or additions were made, and (2)
adopted and incorporated the provisions set forth in the Amnesty
Ordnance to assure the safety of its citizens, and to identity
any structures not properly calculated as part of the City's tax
base; and
WHEREAS, the City Commission wishes to extend the deadline
of the City of Miami's amnesty period from December 31, 2000 to
June 30, 2001, contingent upon Miami -Dade County taking all
actions necessary to extend amnesty period granted by the Amnesty
Ordinance beyond December 31, 2000, and to reiterate its adoption
and incorporation of the provisions of the Amnesty Ordinance;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Resolution No 99-206, adopted March 23, 1999,
is hereby amended in the following particulars:'/

Section 3. Pursuant to Resolution No. 99-206, the
adoption and incorporation as part of the Building Code of the
City of Miami of the provisions set forth in the Amnesty
Ordinance (which ordinance amended the South Florida Building
Code), are hereby reiterated.

Section 4. The City Manager is hereby directed to
instruct the Building Official of the City of Miami to continue
to implement and enforce the provisions of the Amnesty Ordinance.
Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor./

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
