A FOUR-FIFTHS (4/5THS ) AFFIRMATIVE VOTE
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES AND AUTHORIZING THE
ACQUISITION, DELIVERY AND INSTALLATION OF AN
ELECTRICAL TRANSFORMER FOR THE OPERATION OF s
THE SCOREBOARD AT THE ORANGE BOWL STADIUM
FROM FLORIDA TRANSFORMERS, INC. FOR THE
DEPARTMENT CONFERENCES, CONVENTIONS AND
PUBLIC FACILITIES, IN AN AMOUNT NOT TO EXCEED
$12,370; ALLOCATING FUNDS THEREFOR FROM
CAPITAL IMPROVEMENT PROJECT NO. 324002.
WHEREAS, the Department of Conferences, Conventions and
Public Facilities required the immediate acquisition, delivery
and installation of an electrical transformer for the operation
of the scoreboard at the Orange Bowl Stadium (the "Stadium"); and
WHEREAS, the transformer which operates the scoreboard at
the Stadium was struck by lightning and required immediate
replacement for the University of Miami football home games and
other sports events being hosted at the Stadium; and
WHEREAS, the City Manager made a t.written finding that the
replacement of the electrical transformer for the operation of
the scoreboard at the Stadium constituted a valid emergency; and

WHEREAS, the City Manager and the Director of the Department
of Conferences, Conventions and Public Facilities recommended
that the requirements for competitive sealed bidding procedures
be waived; and
WHEREAS, informal solicitations were obtained and the lowest
responsive response was received from Florida Transformers, Inc.
for the acquisition, delivery and installation of the electrical
transformer; and
WHEREAS, funds are available from Capital Improvement
Project No. 324002;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/51hs) affirmative vote of
the members of the City Commission, the City Manager's finding of
an emergency, waiving the requirements for competitive sealed
bidding procedures, and authorizing the acquisition, delivery,
and installation of an electrical transformer for the operation
of the scoreboard at the Orange Bowl Stadium from Florida
Transformers, Inc. for the Department Conferences, Conventions
and Public Facilities, in an amount not to exceed $12,370, is
hereby ratified, approved and confirmed, with funds therefor
hereby allocated from Capital Improvement Project No. 324002.

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Resolution ratifying,
approving and confirming the City Manager's finding of an emergency, waiving the requirements
for competitive sealed bids and approving the purchase of an electrical transformer for the
scoreboard at the Orange Bowl Stadium from Florida Transformers, Inc. in the amount of $12,370.
Funding has been allocated from CIP Project 324002.
BACKGROUND
The Department of Conferences, Conventions and Public Facilities. determined that the electrical
transformer which services the scoreboard at the Orange Bowl Stadium had been struck by
lightning and required immediate replacement. The time frame for delivery of the transformer was
approximately four to six weeks. The transformer is essential to the operation of the scoreboard for
University of Miami football home games, and other soccer events. Florida Transformers, Inc.
.provided the most responsive proposal in the amount of $12,370, including delivery and
installation.

This memorandum serves to request your authorization for the emergency purchase of an
electrical transformer to replace the damaged transformer that services the Orange Bowl
Stadium Scoreboard. An outside contractor and FPL conducted several tests and determined
that the.transformer was apparently struck by lightning and needs to be replaced.
The Orange Bowl staff together with GSA, and Public Works, have tested the emergency
power generator servicing the area and it seems to be in good working condition. We will be
running the scoreboard and sound through this generator for next week's soccer game and
possibly the first U of M game.
The company that could supply this transformer, Florida Transformers, Inc., sent a proposal
for $12,000 plus delivery and installation. We need to proceed to purchase this transformer
immediately since the time frame for delivery is approximately four to six weeks. The funds
for this purchase are available in the CIP Project 324002 entitled Ramp Replacement and
Structural Repair.

REASON: The Department of Conferences, Conventions and Public
Facilities has a need to purchase, delivery and installation of
an electrical transformer for the Orange Bowl Stadium to
provide power to the scoreboard.
RECOMMENDATION: It is respectfully recommended that the City Commission,
ratify, 'approve and confirm by a four/fifths (4/5th)
affirmative vote, the City Manager's finding of an
emergency, for purchase, delivery and installation of an
electrical transformer, to provide power to the scoreboard at
the Orange Bowl Stadium from Florida Transformers, Inc.,
