A RESOLUTION OF THE MIAMI CITY COMMISSION
ACCEPTING THE BID OF AUSTIN'S DIVING CENTER,
INC. FOR THE PROCUREMENT OF ENVIRONMENTAL
PROTECTION DRY SUITS WITH ACCESSORIES, FOR
THE DEPARTMENT OF POLICE, IN AN AMOUNT NOT TO
EXCEED $34,383.20; ALLOCATING FUNDS THEREFOR
FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT
NOS. 690001, 690002, AND 690003, SUCH
EXPENDITURE HAVING BEEN APPROVED BY THE CHIEF
OF POLICE AS COMPLYING WITH THE U.S.
DEPARTMENT OF THE TREASURY AND JUSTICE'S
"GUIDE TO EQUITABLE SHARING" AND
SECTION 732.7055, FLORIDA STATUTES (1999).
WHEREAS, the Department of Police, Marine Patrol Detail,
requires the procurement of environmental protection dry suits
with accessories to protect its divers from contaminants in the
waterways when responding to underwater search and recovery
requests; and
WHEREAS, the U.S. Department of the Treasury and Justice's
"Guide to Equitable Sharing" and Section 932.7055, Florida
Statutes (1999), authorize the expenditure of forfeiture cash or
proceeds for law enforcement purposes not considered normal
operating expenses; and
WHEREAS, the Chief of Police has recommended adoption of
this Resolution and has determined that the expenditure proposed
comply with the U. S. Department of the Treasury and Justice's

"Guide to Equitable Sharing" and Section 932.7055, Florida
Statutes (1999); and
WHEREAS, funds to cover this expenditure have not been
included in the Police Department's normal operating budget and
are available in the City of Miami Law Enforcement Trust Fund;
and
WHEREAS, pursuant to public notice, Invitation for Bids
No. 99-00-202 was mailed to sixteen (16) potential bidders; and
WHEREAS, one (1) response was received on August 14, 2000;
and
WHEREAS, the City Manager and the Chief of Police recommend
that the bid received from Austin's Diving Center, Inc. for the
procurement of environmental protection dry suits with accessories
be accepted as the only responsive and responsible bid; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The bid received on August 14, 2000, from
Austin's Diving Center, Inc., for the procurement of
environmental protection dry suits with accessories, for the
Department of Police, in an amount not to exceed $34,383.20, is

hereby accepted, with funds therefor hereby allocated from the
Law Enforcement Trust Fund, Project Numbers 690001, 690002, and
690003, such expenditure having been approved by the Chief of
Police as complying with the U.S. Department of the Treasury and
Justice's "Guide to Equitable Sharing" and Florida State Statutes
932.7055, as amended.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

It is respectfully recommended that the City Commission adopt the attached Resolution accepting
the bid of Austin's Diving Center, Inc., a Non-Minority/Dade County vendor, located at 10525 S.
Dixie Highway, Miami, FL 33156, for the purchase of Environmental Protection Dry Suits with
Accessories, for the Police Department's Marine Patrol Detail, in an amount not to exceed
$34,383.20.
Funding is available from the Law Enforcement Trust Fund, Project Numbers 690001, 690002 and
690003.

The Department of Police has analyzed the bids received pursuant to Bid No. 99-00-202. Sixteen
(16) Invitations for Bids were mailed and one (1) response was received. Austin's Diving Center,
Inc., submitted the lowest responsive and responsible bid and is, therefore, recommended for the
award.
These dry suits will upgrade those currently used by the Police Department's Marine Patrol Detail
Divers for protection from environmental contaminants. The divers respond to request for
underwater recovery and searches throughout the waterways located within the City of Miami.
Most of these bodies of water are contaminated and require the use of environmental exposure dry
suits for the diver's protection. Contaminants found in our waterways include fuels and other
petroleum products, chemicals, fertilizers, and fecal coliform bacteria, and other health threatening
organisms.
