HomeMy WebLinkAboutR-00-0879i J-00-866 10/3/00 RESOLUTION NO. 04 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE ALLOCATION OF FUNDS IN AN AMOUNT NOT TO EXCEED $37,134.37 TO THE DADE COUNTY ASSOCIATION OF CHIEFS OF POLICE, COURT OVERTIME REDUCTION PROJECT; ALLOCATING FUNDS THEREFOR FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NUMBERS 690001, 690002, AND 690003, SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH THE U.S. DEPARTMENT OF THE TREASURY AND JUSTICE'S "GUIDE TO EQUITABLE SHARING" AND SECTION 932.7055, FLORIDA STATUTES (1999). WHEREAS, the U.S. Department of the Treasury and Justice's "Guide to Equitable Sharing" and Section 932.7055, Florida Statutes (1999) authorize the expenditure of forfeiture cash or proceeds for certain law enforcement purposes not considered normal operating expenses; and WHEREAS, the Miami Police Department, as do most departments in Dade County, face rising court overtime costs; and WHEREAS, the Dade County Association of Chiefs of Police (the "Association") and Dade County State Attorney's Office have implemented the Dade County Association of Chiefs of Police Court Overtime Reduction Project (the "Project") which employs a CITY COMMISSION MEETING OF CT 1 2 2000 solution coordinator to notify victims, witnesses and officers when they are required to appear.at court, which system has greatly reduced the costs of overtime for court appearances for all local law enforcement agencies; and WHEREAS, members of the Association share in the Project's costs based on the number of sworn officers assigned to each of the respective agencies; and WHEREAS, the Chief of Police has recommended funding of the Project and adoption of this Resolution and has determined that the expenditures proposed comply with the U. S. Department of the Treasury and Justice's "Guide to Equitable Sharing" and Section 932.7055, Florida Statutes (1999); and WHEREAS, the funding will assist the Association and the Dade County State Attorney's Office with expenses related to the Project; and WHEREAS, funds to cover these expenditures have not been included in the Police Department's normal operating budget and are available in the City of Miami Law Enforcement Trust Fund; and WHEREAS, pursuant to the provisions of Section 932.7055(c), Florida Statutes (1999), the recipient, Dade County Association of Chiefs of Police, Court Overtime Reduction Project, shall (1) Page 2 of 4 00— 879 certify that the funds appropriated will be used lawfully and for the purpose stated, (2) be required to maintain proper accounting records for the expenditure of such monies, and (3) provide any reports, including, but not limited to, audit reports, as may be required by the City of Miami or applicable law; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of funds in an amount not to exceed $37,134.37 for the Dade County Association of Chiefs of Police, Court Overtime Reduction Project, is hereby authorized, with funds therefor hereby allocated from the Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 690003, such expenditure having, been approved by the Chief of Police as complying with the U.S. Department of the Treasury and Justice's "Guide to Equitable Sharing," and Section 932.7055, Florida Statutes (1999). Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'/ �i If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. Proposed Resolution REFERENCES Dade County Association of Chiefs of Police; Court ENCLOSURES: Overtime Reduction Project It is respectfully recommended that the City Commission adopt the attached Resolution authorizing funding, in the amount of $37,134.37, for the Dade County Association of Chiefs of Police, Court Overtime Reduction Project. Funding is to be provided from the Law Enforcement Trust Fund, Project Numbers 690001, 690002, and 690003. BACKGROUND In an effort to contain rising overtime costs, the Dade County Association of Chiefs of Police, along with the State Attorney's Office, instituted a "County Court Standby Program." This program has dramatically reduced court overtime costs for all law enforcement agencies. Since the program was implemented in 1997, the Police Department has been able to reduce overtime cost by 38%. The system uses a victim/witness coordinator to ascertain officer, as well as, victim and witness availability, thus allowing the State Attorney's Office to plan accordingly. Officers are notified that they are being placed on a "standby" basis and will only be called when needed. All Police Departments in Dade County are being requested to continue to financially support this court overtime reduction program.
