A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), CLOSING, VACATING,
ABANDONING AND DISCONTINUING FOR PUBLIC USE
THAT PORTION OF A PUBLIC RIGHT-OF-WAY, BEING
THE PORTION OF THE WESTERLY 70' OF SOUTHWEST
TIGERTAIL COURT, MIAMI, FLORIDA, AS LEGALLY
DESCRIBED IN !'EXHIBIT A," ATTACHED HERETO
AND MADE A PART HEREOF.
WHEREAS, the Miami Zoning Board at its meeting of July 10,
2000, Item No. 4, duly adopted Resolution No. ZB 2000-0335 by an
eight to one (8-1) vote, RECOMMENDING APPROVAL of closing,
vacating, abandoning, and discontinuing a portion of the public
right-of-way as set forth herein; and
WHEREAS, the Department of Public Works and the Plat and
Street Committee have studied the subject vacation and closure
and determined that it will not affect pedestrian or vehicular
traffic circulation or access for public service; and
WHEREAS, the Plat and Street Committee has reviewed the
subject tentative plat and determined that all technical
requirements have been met, and vacation of the subject
right-of-way would benefit the general public; and
WHEREAS, the .Department of Public Works and the Plat and
Street Committee recommend approval of said vacation request; and

WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of a portion of the
subject right-of-way, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
and incorporated as if fully set forth in this Section.
Section 2. A portion of public right-of-way, being
the portion of Westerley 70' of Southwest Tigertail Court,
Miami, Florida, as legally described in "Exhibit A", attached
hereto and made a part hereof, is herby closed, vacated,
abandoned and disconnected for public use.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor!'.
�i If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.

PUBLIC WORKS ANALYSIS FOR
Vacation and Closure of the Westerly Portion of T'igertail Court
The Public Works Department and the Plat and Street Committee have studied the
proposed closure and vacation of the westerly end of Tigertail Court and
determined that the closure of this court will not adversely affect traffic circulation
or access for public service vehicles such as trash and garbage trucks, fire, police
and/or other emergency vehicles. This court is not part of the critical pedestrian
and vehicular transportation network for the neighborhood. The Plat and Street
Committee has reviewed the tentative plat of "Olympia Park Replat" and
determined that all technical requirements contained in the City Code Subdivision
Regulations have been met and the closure of this court and development of the
property would benefit the general public. The property owner must provide a
specific attorney's opinion addressing the reversionary rights of the court as part of
the application process. Based on the criteria contained in the Subdivision
Regulations of the City Code, the Public Works Department and the Plat and Street
Committee recommended approval of this court closure and vacation request.

The City of Miami Plat and Street Committee, at its meeting of February 3, 2000, improved
the above tentative plat subject to the following revisions being made to the tentative
plat, additional information being provided and/or variances being granted. Please be
advised that the processing of your tentative plat cannot proceed until these conditions
have been satisfied:
1. The Acting Zoning Administrator must approve a letter of clarification concerning the
decision to approve the frontage requirements for existing Lot 6, Block 3 of the First
Addition to Rock Reef subdivision and the setback requirements for proposed Lot 4-A.
2. Label proposed lots and proposed block in the main sketch. Label second block.
3. An opinion of title as to the reversionary rights for the right-of-way (Tigertail Court
and easements) to be closed and vacated will be required by the Zoning Board. The
opinion of title must also address whether or not there are any individuals, in addition
to the abutting property owners, having an interest in the right-of-way to be closed
and vacated. A copy of the opinion must be provided to the Public Works
Department.
4. A sketch and legal description, with square footage, for the proposed street closure
and a sketch and legal description, with square footage area, for each of the
proposed easement closures will be required by the Zoning Board. Contact Ms.
Teresita Fernandez, Chief of the Hearing Boards, at 305-416-2030.
5. The property owner(s) of Lot 6, Block 3, First Addition to Rock Reef, Plat Book 75 at
Page 33, will have to join in and execute the final plat.
6. Be advised that the specific plat restrictions referenced in the City of Miami Code,
concerning private roads, must appear on the final plat.

7. Delete surveyor's notes 7 and 8 from final plat.
8. The Plat and Street Committee in viewing the request to close and vacate.a portion of
Tigertail Court at its southwesterly end and access easements of' lympia Park' at Plat
Book 51, Page 82 have considered the public interest requirements found in Chapter
55 of the Miami City Code. These requirements having been met, the Plat and Street
Committee recommends approval of the vacation and closure of the said: portion of
Tigertail Court and access easement.
In addition to the above requirements, you should be aware of the following: .
1-. State and local laws require.the installation of various physical, improvements in
the public rights-of-way when property is platted. These subdivision
improvements include paving, drainage, landscaping, sidewalks, etc. ,In some cases
this. could represent a substantial investment on your part.
2.: The alteration, relocation or installation of utilities such as storm and sanitary
sewers, electric, telephone, water, etc., caused by this plat will be at the property
owner's expense. Also, utility easements may be required on the property being
platted.
3. A. building permit will not be issued on the property being platted until the final
plat is recorded. Also, the Certificate of occupancy ,for any building construction
will be issued only after all the required subdivision improvements have been,
completed.
4. "Approval for fire flow requirements must be obtained from the Fire -Rescue
Department prior to the issuance of a building permit.
5. Additional items must be provided to the Citylof Miami Department of Public
Works before the final plat is submitted to the City Commissior for approval., You
will be notified in writing as to what these items are after the amount of the bond
has been determined for the necessary subdivision improvements. ,
6. Tentative plat approval is only valid for one (1) year from the date of the Plat and
Street Committee meeting at which time.it was approved.

As Supervisor of Plats, I have reviewed your request for an adjustment to design
standards for the above captioned plat in accordance with Miami City Code Section 55-
11(f). The specific request is to permit a "T" type turnaround on the proposed private
road instead of the required cul-de-sac and allow a platted easement for the general
public to use the private road and "T" type turnaround and further, that access to Lot 6,
Block 3 of First Addition to Rock Reef, is 'acceptable. The purpose of the plat is to
eliminate an existing easement and remedy an existing encroachment within the public
right-of-way.
In order to arrive at a decision in this matter, the following conditions were reviewed:
Special circumstances or conditions affecting the property are present and strict
compliance of the design standards would deprive the applicant of reasonable use of
the land. This request is to provide a remedy for a building encroachment into a
public easement reserved for a cul-de-sac at the westerly dead end of Tigertail Court.
At present, all lots have been developed along this street for quite some time.
However, a physical (paved) cul-de-sac was never developed here and property owners
and providers of City services are not impacted by their current situation. A "T° type
turnaround, fully paved in accordance with standards developed by the Miami Fire -
Rescue Department, would provide an excellent enhancement for public safety, if
needed. At the present time, the City has no plans to pave the cul-de-sac easement in
question. When constructed, the turnaround would have to be located within a
permanent easement.
2. Adjustment is necessary for the preservation and enjoyment of a substantial property
right. Elimination of the cul-de-sac easement would allow for current property
development to remain as is. All parties to the plat are in agreement with proceeding
With the plat as presented. Additionally, frontage to Lot 6 remains the same and
access is not hindered.

3. Granting of an adjustment will not be detrimental to public welfare or injurious to
other properties in the vicinity. All waivers will occur at the dead end portion of this
street. The proposed remedy is reasonable, provides access to Lot 6 and a physical
public turnaround, which presently does not exist.
4. Adjustment will not unreasonably burden City services, including adjacent streets.
The proposed waiver has no negative impact on the ability of the City to provide
services. The proposed turnaround enhances the City's ability to safely provide this
maneuver.
Based on the above findings, a waiver of the design standards is hereby approved, as
follows:
• Construction of a "T" type turnaround Within the designated easement shown
on the tentative plat, contingent upon the review and approval of the Miami
Fire -Rescue Department.
A publicly dedicated easement off of the private road area for purposes of
providing a ^T" type turnaround.
• Access to Lot 6, Block 3, First Addition to Rock Reef is sufficient for purposes of
this plat.

Application of David Freedman and Robert Mennis
to Vacate Westerly 70 feet of Tigertail Court in Coconut Grove
City of Miami City Commission Hearing: Thursday, September 28, 2000 at 2:00 p.m:
The above matter is a hardship case involving a mistake in the City's platting process
approximately 50 years ago. The road vacation is needed to correct the error and to clear the title
• to the homes of the two applicants.
About 50 years ago, the old DuBois estate (near Kennedy Park) was subdivided into two
blocks; the two blocks are divided by a small dead-end street called "Tigertail Court." Because
dead -ends are not permitted (emergency vehicles need some way to turn around), a "temporary
• turnaround easement" was put on the plat at the "dead end" at the West end of the street.
Through error, the legal description of the street and turnaround easement actually runs
underneath the two homes (Freedman residence and Mennis residence) which front on the street
at the West end.
• It was intended that this platted turnaround arrangement be "temporary," because the
original plan was that the street would be later extended to the west to connect to another street;
the subdivision plat states that the "turnaround" easement was to be temporary until Tigertail
Court was extended, at which time the easement was to be vacated. However, the City later
accepted a plat for the neighboring subdivision, which called for a house (in the adjoining
® subdivision) to be built at the "dead end" of Tigertail Court. As a result, the street can never be
extended, and the "temporary" situation has become permanent. The two homeowners
(applicants) face the hardship of perhaps having to tear down parts of their homes, and have a
title defect which could make their homes unsaleable.
The Plat and Street Committee has approved the recommended solution for this problem:
® a replat of the two homes to relocate the legal boundaries of the street and the turnaround
easement so that they are not under the houses. To do this, the public dedication of the last 70
feet of the street has to be vacated. There will be no physical closure of the end of the road, no
gate or barrier of any kind, only a change "on paper" of the legal description of the road and the
turnaround easement.

The Director -of Public Works recognized the hardship and recommended approval. The
Fire Department has been to. the site and approves. The Zoning Board approved the proposed
vacation on July 10, 2000.

As Supervisor of Plats, I have reviewed your request for an adjustment to design
standards for the above captioned plat in accordance with Miami City Code Section 55-
11(f). The specific request is to permit'a "T" type turnaround on the proposed private
road instead of the required cul-de-sac and allow a platted easement for the general
public to use the private road and "T" type turnaround and further, that access to Lot 6,
Block 3 of First Addition to Rock Reef, is acceptable. The purpose of the plat is to
eliminate an existing easement and remedy an existing encroachment within the public
right-of-way.
In order to arrive at a decision in this matter, the following conditions were reviewed:
1. Special circumstances or conditions affecting the property are present and strict
compliance of the design standards would deprive the applicant of reasonable use of
the land. This request is to provide a remedy for a building encroachment into a
public easement reserved for a cul-de-sac at the westerly dead end of Tigertail Court.
At present, all lots have been developed along this street for quite some time.
However, a physical (paved) cul-de-sac was never developed here and property owners
and providers of City services are not impacted by their current situation. A "T" type
turnaround, fully paved in accordance with standards developed by the Miami Fire -
Rescue Department, would provide an excellent enhancement for public safety, if
needed. At the present time, the City has no plans to pave the cul-de-sac easement in
question. When constructed, the turnaround would have to be located within a
permanent easement.
Adjustment is necessary for the preservation and enjoyment of a substantial property
right. Elimination of the cul-de-sac easement would allow for current property
development,to remain as is. All parties to the plat are in agreement with proceeding
with the plat as presented. Additionally, frontage to Lot 6 remains the same and
access is not hindered. Submitted into the public

3. Granting of an adjustment will not be detrimental to public welfare or injurious to
other properties in the vicinity. All waivers will occur at the dead end portion of this
street. The proposed remedy is reasonable, provides access to Lot 6 and a physical
public turnaround, which presently does not exist.
4. Adjustment will not unreasonably burden City services, including adjacent streets.
The proposed waiver has no negative impact on the ability of the City to provide
services. The proposed turnaround enhances the City's ability to safely provide this
maneuver.
Based on the above findings, a waiver of the design standards is hereby approved, as
follows:
• Construction of a "T" type turnaround within the designated easement shown
on the tentative plat, contingent upon the review and approval of the Miami
Fire -Rescue Department.
• A publicly dedicated easement off of the private road area for purposes of
providing a "T" type turnaround.
• Access to Lot 6, Block 3, First Addition to Rock Reef is sufficient for purposes of
this plat.

The City of Miami Plat & Street Committee at its meeting of February 3, 2000, approved the
referenced tentative plat subject to several conditions and revisions. One of the conditions is
a letter of clarification from the Acting Zoning Administrator concerning the decision to
approve the frontage requirements for existing Lot 6, Block 3 of the First Addition to Rock
Reef subdivision and the setback requirements for proposed Lot 4-A. In connection
therewith, please be advised.as follows:
Pursuant to my letter dated December 30, 1999, in which two (2) specific questions were
responded to, the following addendum to the letter shall be part of the public records.
The proposed Olympia Park Replat, which includes a turnaround easement, is an acceptable
solution to an unusual situation caused by a prior plat approved by the City in the early
1960's. This proposed replat will correct the past error by replatting the property including a
turnaround easement and lots with the correct frontage width on the street.
The existing nonconforming structure that was originally built as a garage and subsequently
changed pursuant to building permit 85-9646 which converted the garage into a children's
playroom with a bathroom. is considered a legal nonconforming structure that may continue
to be utilized as such without a need for a variance. Theref6re, the setback for proposed Lot
4-A is not relevant and no setback variances are required.
In conclusion, this case is unique and unusual and because of the aforementioned
circumstances the proposed remedy to `cure' these problems by the turnaround easement and'
the replat'are acceptable.
