HomeMy WebLinkAboutR-00-0844J-00-907 9/28/00 RESOLUTION NO. o 0 — SQ 1 A RESOLUTION OF THE MIAMI CITY COMMISSION URGING THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS AND BUILDING OFFICIAL TO TAKE ALL STEPS NECESSARY TO EXTEND THE AMNESTY PERIOD GRANTED PURSUANT TO MIAMI-DADE COUNTY ORDINANCE (ORDINANCE NO. 97-107) (THE "AMNESTY ORDINANCE") AND RESOLUTION NO. R-1455-98 FOR BRINGING CONSTRUCTION, REPAIRS AND ADDITIONS, BUILT WITHOUT PROPER PERMITS, OR PERMITS WHICH EXPIRED WITHOUT THE ISSUANCE OF CERTIFICATES OF COMPLETION FROM OCTOBER 29, 1957 THROUGH JULY, 1997, INTO CONFORMANCE WITH THE PROVISIONS OF THE SOUTH FLORIDA BUILDING CODE, FROM ENDING DECEMBER 31, 2000 TO NO EARLIER THAN JUNE 30, 2001; FURTHER DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS DESIGNATED HEREIN. 2 L) WHEREAS, Ordinance No. 97-107 (the "Amnesty Ordinance"), adopted by the Board of County Commissioners on July 8, 1997, amended the South Florida Building Code (the "SFBC") and established a limited period to facilitate bringing residential structures built without proper permits or with permits which have expired without the issuance of a Certificate of Completion in Miami -Dade County into compliance with the SFBC; and WHEREAS, the Amnesty Ordinance provided that the period for compliance shall expire December 31, 1998, but that the amnesty period may be extended for a period not to exceed twenty-four CITY COMMISSION MEETING OF S E P 2. " 2000 Resolution No. 0® 844 months by resolution of the Board of County Commissioners upon recommendation of the Building Official; and WHEREAS, pursuant to Miami -Dade County Resolution No. R-1455-98, adopted December 15, 1998, the amnesty period was extended to December 31, 2000; and WHEREAS, the City of Miami (the "City"), pursuant to the authority granted by the Amnesty Ordinance and Resolution No. R-1455-98, thereby adopted Resolution No. 99-206 on March 23, 1999, to grant such amnesty period in the City ending December 31, 2000; and WHEREAS, the City Commission wishes to extend the December 31, 2000 amnesty period deadline to June 30, 2001, as a great number of structures 'in the City have yet to receive the required final Certificate of Completion; and WHEREAS, such amnesty period extension can be granted to the citizens of the City by the City Commission only upon an extension of the amnesty period by the Miami -Dade County Board of County Commissioners; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Page 2 of 4 i lJ Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami -Dade County Board of County Commissioners and Building Official are hereby urged to take all steps necessary to extend the amnesty period granted pursuant to Miami -Dade County Ordinance (Ordinance No. 97-107) (the "Amnesty Ordinance") and Resolution No. R-1455-98, for bringing construction, repairs and additions, built without proper permits, or permits which expired without the issuance of Certificates of Completion from October 29, 1957 through July, 1997, into conformance with the provisions of the South Florida Building Code, from ending December 31, 2000 to no earlier than June 30, 2001. Section 3. The City Clerk is hereby directed to transmit a copy of this Resolution to the following Miami -Dade County officials: Mayor Alex Penelas, all members of the Board of County Commissioners, County Manager Merrett R. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
