A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR-FIFTHS (4/5THS ) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND AUTHORIZING THE ACQUISITION OF SERVICES FOR IMPROVEMENTS TO THE POOL SHELL AT ELIZABETH VIRRICK PARK FOR THE PARKS AND RECREATION DEPARTMENT FROM MALIBU POOL SERVICES, INC. , IN AN AMOUNT NOT TO EXCEED $8,500; ALLOCATING FUNDS THEREFOR FROM THE DEPARTMENT OF PARKS AND RECREATION GENERAL OPERATING BUDGET, ACCOUNT CODE NO. 001000.580302.6.340. WHEREAS, the unsafe condition of the pool shell at Elizabeth Virrick Park created an immediate danger to the health, safety and welfare of the citizens and the public, requiring immediate improvements in the form of sandblasting and recoating; and WHEREAS, the completion of the necessary improvements were required prior to the commencement of the summer swimming programs, and due to time constraints, three (3) informal solicitations were obtained, and the lowest responsive response was received from Malibu Pool Services, Inc.; and WHEREAS, the City Manager made a written finding that the improvements to the pool shell constituted a valid emergency; and CITY CO SS10N' VIEETING Of P 2000 Resolution Ido. WHEREAS, the Director of the Department of Parks and Recreation recommended that the- requirements for competitive sealed bidding procedures be waived and that the City Manager authorized immediate acquisition of services for the improvements to the Elizabeth Virrick Park poolshell from Malibu Pool Services, Inc.; and WHEREAS, funds are available from the Department of Parks and Recreation General Operating budget, Account Code No. 001000.580302.6.340; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. - Section 2. By a four-fifths (4/5th) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, waiving the requirements for competitive sealed bidding procedures, and authorizing the acquisition of improvements to the pool shell at Elizabeth Virrick Park for the Department of Parks and Recreation from Malibu Pool Services, Inc., in an amount not to exceed $8,500, is hereby ratified, approved and confirmed, with funds therefor hereby allocated from the Department of Parks and Recreation General Operating Budget, Account Code No. 001000.580302.6.340. This Resolution further allocates funds for said purpose, from the Parks and Recreation Department's Budget, Account Code No. 001000.580302.6.340. BACKGROUND: The existing condition of the pool shell at Virrick Park was found to be unsafe. Originally, City work forces planned to perform the needed repairs. However, upon further inspection, it was discovered that these repairs were beyond the capabilities of City staff. If not resolved on a timely basis, it would have prevented the scheduled opening of this pool for the Summer. The work on the pool had to be done on an emergency basis or there would not have been time to complete the formal bid process and work prior to the beginning of the summer swimming program.
