A RESOLUTION OF THE MIAMI CITY COMMISSION, BY
A FOUR-FIFTHS (4/5Tas) AFFIRMATIVE VOTE,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES, AND AWARDING THE
PROCUREMENT OF EMERGENCY REPAIRS TO THE POOLS
AT HADLEY, JOSE MARTI AND ATHALIE RANGE PARKS
FOR THE DEPARTMENT OF PARKS AND RECREATION,
FROM INNOVATIVE POOL PLASTERING, . INC., IN AN
AMOUNT NOT TO EXCEED $74,175; ALLOCATING
FUNDS THEREFOR FROM THE SAFE NEIGHBORHOOD
PARKS BOND PROGRAM BUDGET, ACCOUNT CODE
NO. 589305-860, CAPITAL IMPROVEMENT PROJECT
("CIP") NO. 331391, IN THE AMOUNT OF $24,875,
CIP NO. 331385, IN THE AMOUNT OF $43,000, AND
CIP NO. 331070, IN THE AMOUNT OF $6,300.
WHEREAS, the pools at Hadley, Jose Marti and Athalie Range
Parks required extensive emergency repairs to be completed prior
to the opening of the summer recreation programs to minimize the
disruption of services and use of the facilities by the
community; and
WHEREAS, due to time constraints to meet the commencement of
the summer programs, three .(3) informal solicitations were
obtained and the lowest responsive and responsible bid was
received from Innovative Pool Plastering, Inc.; and
WHEREAS, the City Manager made a written finding that the
repairs to the pools constituted a valid emergency; and

WHEREAS, the City Manager and the Director of the Department
of Parks and Recreation recommended that the requirements for
competitive sealed bidding procedures be waived and that the
procurement of repair services for the said pools from Innovative
Pool Plastering, Inc. be approved; and
WHEREAS, funds are available from the Safe Neighborhood
Parks Bond Program Budget, Account Code No. 589305-860, Capital
Improvement Project ("CIP") No. 331391, in the amount of $24,875,
CIP No. 331385, in the amount of $43,000, and CIP No. 331070, in
the amount of $6,300;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/stns) affirmative vote of
the members of the City Commission, the City Manager's finding of
an emergency, waiving the requirements for competitive sealed
bidding procedures, and approving the procurement of emergency
repairs to the pools for the Department of Parks and Recreation
at Hadley, Jose Marti and Athalie Range Parks from Innovative
Pool Plastering, Inc., in an amount not to exceed $74,175, are
hereby ratified, approved and confirmed, with funds therefor
hereby allocated from the Safe Neighborhood Parks Bond Program
Budget, Account Code No. 589305.860, Capital Improvement Project
("CIP") No. 331391, in the amount of $24,875, CIP No. 331385, in

the amount of $43,000, and CIP No. 331070 in the amount of
$6,300.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

I:t i -s respectfully recommended that the City Commission
adopt the attached Resolution, by a 4/5 1h affirmative vote,
ratifying approving and confirming the City Manager's
finding of an emergency, waiver of competitive sealed bids
requirements and his action to approve the recommendation to
proceed on an emergency basis for the repairs to the pools
at Hadley Park, Jose Marti Park and Athalie Range Parks, in
the amount of $74,175 to Innovative Pool Plastering, Inc.
This Resolution further allocates funds for said purpose,
from the Safe Neighborhood Parks Bond Program Budget Account
Code No. 589305-860, Capital Improvement Projects No.
331391, No. 331385 and No. 331070.
BACKGROUND:
The Hadley and Jose Marti Pools are open to the public all
year round. The pools at these parks and the pool at
Athalie Range Park (which is opened only during the.Summer)
were in need of extensive repairs. In order to minimize the
disruption of services and use of these facilities by the
community during the highly attended Summer Recreation
Program , the Park's Department obtained three (3) bids for
the repairs of all three pools.
Innovative Pool Plastering, Inc. submitted the lowest bid at
$74,175. A description of repair and cost per park is
detailed in the attached memorandum dated January 25, 2000,
which authorized this emergency action.

Department of Parks and Recreation
The Department of Parks and Recreation respectfully requests your approval, on an
emergency basis, to complete repair work at the Hadley, Jose Marti and Athalie Range
Park swimming pools.
We have contacted three firms: Innovative Pool Plastering, Ultimate Pools, Inc., and
Miami Pool Tech, Inc., (see attached tabulation of prices for your information). The
lowest responsible bidder is Innovative Pool Plastering which we recommend be selected
to do the proposed repairs as listed below:

Please note that both Jose Marti and Hadley pools are open to the public all year round
and therefore need to be repaired immediately so as to minimize the disruption of services
and use of the facilities by the community.' Although Range Pool is not open all year
round, we recommend that the bid for this pool be included with the other, two (2) pools
in the bid package to generate savings to the City at this time.
The total cost of these repairs should not exceed $74,175 and funding is available from
the 1999-00 Safe Neighborhood Parks Bond Program as follows:

ITEM: Pool repairs at Hadley, Jose Marti and Athalie Range Parks
DEPARTMENT: Parks 8T Recreation
TYPE: Emergency Purchase
REASON: The Department of Parks & Recreation has a need for
extensive repair work for the pools at Hadley, Jose Marti
and Athalie Range Parks to maintain the scheduled opening
of the pool for the department's summer program.
RECOMMENDATION: It is respectfully recommended, that the City Commission,
ratify, approve and confirm by a four/fifths (4/5th)
affirmative vote, the City Manager's finding of an
emergency, to repair the pools at Hadley, Jose Marti and
Athalie Range Parks from Innovative Pool Plastering, Inc.,
for the Department of Parks and Recreation, in an amount
not to exceed $ 74,175; allocating funds therefor from the
Safe Neighborhood Parks Bond Program Budget Account
Code No. 589305-860, Capital Improvement Projects No.
331391, No. 331385 and No. 331070.
