RESOLUTION NO. 00— 827
A RESOLUTION OF THE MIAMI CITY COMMISSION BY
A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE,
RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS
AND AUTHORIZING THE CONTINUED PROVISION OF
TEMPORARY PERSONNEL SERVICES FROM TRI-STATE
EMPLOYMENT SERVICES, BUDGET QUALITY STAFFING,
AND MANPOWER INTERNATIONAL, INC., UNDER
INVITATION FOR BIDS NO. 96-97-014, WITH COSTS
FOR SAID SERVICES TO BE FUNDED AS PREVIOUSLY
ALLOCATED BY RESOLUTION NO. 97-324.
WHEREAS, temporary personnel services are used to provide
departments with qualified workers when urgent emergency
situations arise until recruitment of permanent personnel takes
place; and
WHEREAS,
pursuant
to Resolution
No.
97-324,
the City
Commission
authorized
contracts with
Tri-State
Employment
Services, Budget Quality Staffing, and Manpower International,
Inc. to provide such temporary personnel services; and
WHEREAS, the terms of the contracts expired on June 15,
2000; and
WHEREAS, the City Manager made a written finding that an
emergency existed to assure the continuation of temporary

personnel services to August 1, 2000, until responses for an
Invitation for Bids are received; and
WHEREAS, due to numerous inquiries from prospective vendors
regarding a new contract, Tri-State Employment Services, Budget
Quality Staffing, and Manpower International, Inc. agreed to
extend their contracts through September 30, 2000, at the same
terms, conditions, and pricing existing under Invitation for Bids
No. 96-97-014, until the new bids will be accepted by the City
Commission; and
WHEREAS, on September 14, 2000, pursuant to Resolution
No. 00-732, the City Commission accepted bids from various
vendors for temporary personnel services as of October 1, 2000;
and
WHEREAS, funds in the amount of $300,000 remain from the
funds previously allocated pursuant to Resolution No. 97-324, and
additional funds are not required;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5tns) affirmative vote of
the members of the City Commission, the City Manager's finding of
an emergency, waiving the requirements for competitive sealed
bidding procedures, and authorizing the continued provision of

temporary personnel services from Tri-State Employment Services,
Budget Quality Staffing, and Manpower International, -Inc., under
Invitation for Bids No. 96-97-014, is ratified, approved and
confirmed, with costs for said services to be funded as
previously allocated by Resolution No. 97-324.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective

It. is respectfully recommended that the City Commission adopt the attached Resolution
ratifying the City Manager's emergency action authorizing the continued provision of
temporary services by Tri-State Employment Services, Budget Quality Staffing, and
Manpower International, Inc. No additional funding is required for this extension, as
over $300,000 remains from the original funds allocated under the existing contract.
BACKGROUND
Temporary Personnel Services are used to provide assistance to City Departments when
urgent/ emergency situations arise. The use of temporary services provides departments
with qualified workers while the recruitment and hiring process takes place. The current
contract, Bid number 96-97-014, was originally due to expire on June 15, 2000. The
aforementioned companies agreed to provide these services under the same terms,
conditions, and pricing, through September 30, 2000. A new contract is expected to be
awarded in September, 2000, and no further extension of Bid 96-97-014 is anticipated.

This memorandum serves to request a continuation of the existing contract for Temporary
Personnel Services on an emergency basis, beyond its scheduled expiration. Temporary
Personnel Services are used to provide assistance to City Departments when ufgent/
emergency situations arise. The use of temporary services provides departments with
qualified workers while the recruitment and hiring process takes place. The current
contract, bid number 96-97-014, was originally due to expire on June 15, 2000. A new
contract is presently out to bid, but it is likely that the contract will not be awarded by the
expiration of the existing contract. The former City Manager, Donald H. Warshaw,
approved an emergency extension until August 1, 2000; however, due to numerous
questions from potential vendors, the vendor response date was extended from June 5" to
June 19th.
As a result, it is requested that the current contract be extended for a period of two
months beyond the scheduled termination, at the same price terms. Based on
expenditures to date, the appropriation for this expenditure does not have to be increased.
Legislation ratifying this emergency action will be submitted for inclusion on the
September 14, 2000 City Commission Agenda.

REASON: The Department of Human Resources has a need for
continued temporary personnel services.
RECOMMENDATION: It is respectfully recommended that the City Commission,
ratify, approve and confirm by a four/fifths (4/5th)
affirmative vote, the City Manager's finding of an
emergency, for continued temporary personnel services from
Tri-State Employment Services, Budget Quality Staffing
and Manpower International, Inc., for the Department of
Human Resources; additional funding is not required, as over
$300,000 remains from the original funds allocated under
