HomeMy WebLinkAboutR-00-0826J-00-758 9/27/00' RESOLUTION NO. 0'` 8 2 6 A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR-FIFTHS (4/5T11) AFFIRMATIVE VOTE, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND APPROVING THE ACQUISITION OF WINDOW PANELS AND REPAIR SERVICES FOR THE CITY OF MIAMI RIVERSIDE CENTER (MRC) FROM SKYHANGER II CORPORATION, FROM JULY 24, 2000 THROUGH SEPTEMBER 30, 2000; ALLOCATING FUNDS, IN AN AMOUNT NOT TO EXCEED $15,000, FROM THE GENERAL OPERATING BUDGET OF THE MIAMI RIVERSIDE CENTER FOR FISCAL YEAR 1999-2000, ACCOUNT CODE NO. 001000.810201.6.670, FOR SAID PURPOSE. WHEREAS, seven glass panels at the Miami Riverside Center ("MRC"), the City's Administration Building, at 444 Southwest 2nd Avenue, Miami, Florida, were damaged due to vandalism; and WHEREAS, in replacing each of the panels, the City's stock reserve was totally depleted; and WHEREAS, the minimum time required to manufacture the glass panels to meet the specifications required at the MRC is approximately eight to ten weeks; and WHEREAS, even though the agreement with Skyhanger II Corporation to provide the necessary repair and window services to the City had expired, Skyhanger agreed to provide its services at the same costs, terms and conditions agreed upon under in its recently expired agreement which utilized Bid No. 96-97-055R; and WHEREAS, due to the emergency need to immediately replace the shattered glass panels and to order stock in case of future emergencies, the City Manager made a written finding of an emergency and approved the acquisition of services from Skyhanger from July 24, 2000 to September 30, 2000; and WHEREAS, it is now necessary for the City Commission to ratify, approve and confirm the City Manager's findings and action in engaging Skyhanger to provide repair services and to replenish the depleted window panel stock, at a amount not to exceed $15,000; and WHEREAS, funds for said service and panels are available from the General Operating Budget of the Miami Riverside Center for Fiscal Year 1999-2000, Account Code No. 001000.810201.6.670; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a fourth fifths (4/5tns) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, waiving the requirements for competitive sealed bidding procedures, and approving the acquisition of window panels and repair services for the MRC from Skyhanger II Page 2 of 3 .00— 826 Corporation, from July 24, 2000 through September 30, 2000, are hereby ratified, approved, and confirmed, with funds, in an amount not to exceed $15,000, allocated from the General Operating Budget of the Miami Riverside Center for Fiscal Year 1999-2000, Account Code No. 001000.810201.6.670, for. said purpose. Page 3 of 3 00— 826 CITY OF MIAMI, FLORIDA .19 INTER -OFFICE MEMORANDUM TO: The Honorable Mayor and Members DATE: SEP 1 -2 fir^' - FILE of the City Commission SUBJECT: Resolution Ratifying City Manager's Action g"' FROM::7 REFERENCES: Emergency Extension and ACCiManager ENCLOSURES: Increase of Hi -Rise Window Cleaning Services Contract RECOMMENDATION It is respectfully recommended that the City Commission approve, ratify and confirm by a four- fifths (4/5h') affirmative vote, the City Manager's finding that an emergency need existed in approving the continuation of Hi -Rise Window Cleaning Services with Skyhanger II Corporation, Hispanic/Non-Local vendor located at 409 Pembroke Road, Hallandale, Florida 33009, for the City of Miami Riverside Center (MRC) Administrative Building, from July 24, 2000 through September 30, 2000; further increasing the contract for said services in an amount not to exceed $15,000, from a total contract amount of $15,000 to $30,000. Funding is available from the Miami Riverside Center, FY'99-00 General Operating Budget, Account Code No. 001000.810201.6.670. BACKGROUND As a result of vandalism to the City of Miami Riverside Center (MRC), seven (7) glass panels were lost with the end result being the depletion of glass stock reserves. The justification for this emergency is twofold: 1) to increase the amount of the existing contract to cover the costs of the emergency -related repairs and to replenish depleted stock for which moneys were not available under the purchase order currently in effect; and 2) the need to extend the current contract's termination date of July 24, 2000 to September 30, 2000 in that the minimum time necessary for the manufacture of the glass required is 8 to 10 weeks noting that the renewal periods for the existing contract have been exhausted. The existing vendor, Skyhanger II Corporation, has performed satisfactorily and has subsequently agreed to extend the contract under the same terms, conditions, and costs pursuant to the same being acquired under Bid No. 96-97-055R. By affording this emergency provision, funds will be utilized from FY'00 rather than from FY'0I and encumbering costs from FY'01 would adversely impact the provision of MRC window services for the next fiscal year. In addition, higher costs can be expected for the next fiscal period and the acquisition of replenishment stock at the current prices reflect a cost savings. Funds for this increase are available from Account Code No. 001000.810201.6.670. EMERGENCY JUSTIFICATION Due to a recent unexpected criminal activity to the MRC Facility which caused the loss of seven (7) glass panels and the depletion of other panels due to other accidental and wind damage, an emergency increase to the contract amount is requested. Our stock is now depleted. The acquisition of replacement stock is of critical importance considering the lead-time for the manufacture is 8 to 10 weeks and that hurricane season has arrived. In addition, the current Hi -Rise Window Service contract, pursuant to Res. No. 97-367, expires July 24, 2000 and all contract extensions have been exhausted. Bids for the new contract are in process and it is anticipated that the new bid process will be completed and scheduled for Commission approval sometime in September. While this process proceeds, the General Services Administration, MRC Division, must continue to have the ability to provide window services (replenishment of stock, repairs and window cleaning services) to the MRC Facility. It is requested that the contract be extended to the end of the fiscal period, September 30, 2000. The vendor, Sky Hanger Corporation, has agreed to continue providing these services under the same terms, conditions, and pricing, pursuant to the contract acquired under Bid No. 96-97-055R (see attached letter). 00-- 826 Carlos A.
