WHEREAS, the Housing Opportunities for Persons With AIDS (HOPWA) Program was created under the AIDS Housing Opportunity Act, and revised under the Housing and Community Development Act of 1992; and COMUSSION MEETING OF S E P I It 2000 Resolution No, • WHEREAS, the Housing and Community Development Act of 1992 stipulates that the most populous unit of general local government in an eligible metropolitan statistical area (EMSA), excluding county government, must be the applicant for a HOPWA Grant to be allocated the related funding; and WHEREAS, the City of Miami has been awarded funding from the U.S. Department of Housing and Urban Development (U.S. HUD) to implement the HOPWA Program; and WHEREAS, Resolution No. 98-1192 authorized HOPWA funding in the amount of $2,400,000 to Miami -Dade County's Department of Human Services (Office of Community Services) for the provision of utilities assistance to low income persons living with HIV/AIDS; and WHEREAS, Resolution No. 99-702 authorized HOPWA funding to Miami -Dade County's Department of Human Services, Office of Community Services in the amount of $281,704 for the provision of Emergency Housing Assistance and $1,098,047 for the provision of Short Term Housing Assistance to serve low income persons living with HIV/AIDS; Page 2 of 6 f� — 7 fill c� WHEREAS, Miami -Dade County's Department of Human Services, Office of Community Services, requested that the City reallocate $200,000 from funding previously allocated for Utility Assistance to Short Term Housing Assistance to enable the Provider Agency to continue to provide Short Term Housing Assistance for their existing caseload of 345 clients through September 30, 2000; and WHEREAS, Miami -Dade County's Department of Human Services, Office of Community Services, also requested that the City reallocate $100,000 from funding previously allocated for Utility Assistance to Emergency Housing Assistance to enable the Provider Agency to continue to provide Emergency Housing Assistance to an additional 100 clients through September 30, 2000; and WHEREAS, the service agreements between the City and nine (9) of the service providers which are recommended for continued funding will expire on September 30, 2000; and WHEREAS, to continue services under the HOPWA Program, it is necessary for the City Commission to authorize the City Manager to allocate funding from the Housing Opportunities for Persons With AIDS (HOPWA) Program Grant, in the amount of Page 3 of 6 U 72 • 0 $9,979,000, to ten (10) service providers for the provision of housing assistance and housing related services to low income persons living with HIV/AIDS, as designated in Section 3 herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The proposed resolution further authorizes the City Manager to execute individual agreements and/or amendments as required, in a form acceptable to the City Attorney with the aforementioned sponsors. BACKGROUND: The proposed legislation allocates Housing Opportunities for Persons with AIDS (HOPWA) funds to continue housing assistance and housing related services to low income persons living with HIV/AIDS for the period October 1, 2000 - September 30, 2001 and also transfers $300,000 of HOPWA funds within existing contracts of previously approved allocations for projects operated by the Miami -Dade County Department of Human Services, Office of Community Services (OCS). Transfer of funds within Existing HOPWA contracts for the Miami -Dade County Department of Human Services, Office of Community Services (OCS) At its meeting of December 8, 1998, the City Commission adopted Resolution No. 98-1192 awarding $2,400,000 from the FY 1998-99 HOPWA Program Grant to the Miami -Dade County Department of Human Services, Office of Community Services for the provision of utilities assistance to very low income persons living with HIV/AIDS. The City Commission also adopted Resolution No.99-702 at its meeting of. September 28, 1999 that further allocated $1,098,047 from the FY 1998-99 HOPWA Program Grant to the Miami - Dade County Department of Human Services, Office of Community Services for the provision of short term, housing assistance and $281,704. for emergency housing assistance to low income persons living with HIV/AIDS.. In a letter to the City of Miami dated. July 12, 2000;..00S formally requested the transfer of $300,000 from the $2,400,000 previously allocated for utility assistance by directing $200,000 to continue the short term housing assistance program -,for its. existing caseload of 345 clients and $100,000 to serve .200 additional clients in its emergency housing assistance program through September 30, 2000. In an effort to ensure the continuation of housing assistance and housing related services to low income persons living with HIV/AIDS throughout Miami -Dade County, it is recommended that the City Commission approve the request to transfer. funds. within previously approved HOPWA projects to better serve the impacted population. HOPWA Allocations for the 2000-2001 Program Year Currently, the City of Miami, through the Housing Opportunities for- Persons With AIDS (HOPWA) Grant Program, allocates funds to various organizations to .provide housing assistance and housing related services to low income persons living with HIV/AIDS throughout Miami - Dade County. Service agreements, between the City and the service providers will expire . September 30, 2000. Under the restructured program, the City of Miami will administer and implement the Program for participants living in the City and Miami -Dade County will be responsible for similar services to individuals residing in the balance of Miami -Dade County. The above listed agencies will be working in conjunction with the City and County to ensure that the services are provided through the transition of program responsibilities. Funds for the transition, which will commence with the new October 1 Program Year, are included in the recommended funding allocations. In an effort to ensure the continuation of housing assistance and housing related services to low income persons living with HIV/AIDS, City Commission approval of the attached resolution is recommended. The specific request is to move $200,000 to the Short -Term Housing Assistance Contract and $100,000 to the Emergency Housing Contract. The additional $200,000 for Short -Term Housing Assistance will allow us to cover a projected short fall of $106,413 in rental assistance for the existing caseload of 345 cases, with the remaining $93,587 being available for new clients. We are accepting between 50 and 70 new cases monthly for Short -Term Housing. Additionally, we are unable to close out ongoing cases because of the delay in the active cases being approved by the Long Term Housing Assistance Program. WHEREAS, the Housing Opportunities for Persons With AIDS (HOPWA) Program was created under the AIDS Housing Opportunity Act, and revised under the Housing and Community Development Act of 1992; and WHEREAS, Section 606(d)(2) of the Housing and Community Development Act of 1992 stipulates that the City of Miami, being the most populous unit of general local government in an eligible metropolitan statistical area (EMSA), not including county government, shall be the applicant for the HOPWA Grant and be allocated the related funding; and WHEREAS, the City of Miami has been awarded funding from the U.S. Department of Housing and Urban Development (U.S. HUD) for CITY c0MME&IM KEEMG or, DEC 0 0 1998 00- 792.� the implementation of the 1998 HOPWA.Program Grant; and WHEREAS, on March 14, 19981 the City Commission adopted Ordinance No. 11643, -which established a special revenue fund entitled "Housing Opportunities for Persons With AIDS.Grant", and appropriated $7,732,000 in funding from U.S.HUD for the 'implementation and administration of the 1998 HOPWA Program;,,and, WHEREAS, on April 14, 1998, the City Commission adopted..
