A RESOLUTION OF THE MIAMI CITY COMMISSION, BY
A FOUR-FIFTHS (4/5THS ) AFFIRMATIVE, RATIFYING,
APPROVING, AND CONFIRMING THE CITY MANAGER'S
FINDING OF AN EMERGENCY, WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDDING
PROCEDURES, AND APPROVING THE ACQUISITION OF
FOOD FOR THE MOBILIZATION OF POLICE OFFICERS
DURING THE ELIAN GONZALEZ DEMONSTRATIONS, FOR
THE DEPARTMENT OF POLICE, FROM
HECTOR LOPETEGUI, IN AN AMOUNT NOT TO EXCEED
$20,000; ALLOCATING FUNDS THEREFOR FROM THE
POLICE GENERAL OPERATING BUDGET, ACCOUNT CODE
NO. 001000.290201.6.710, FOR SAID PURPOSE.
WHEREAS, the demonstrations related .to the Elian Gonzalez
Immigration and Naturalization issues'created.an immediate danger
to the health, safety and welfare of the citizens and the public,
requiring officers of the Department of Police to be mobilized;
and
WHEREAS, due the duration of the demonstrations, it was
necessary to provide meals to police personnel; and
WHEREAS, the City Manager made a written finding that the
mobilization of police personnel constituted a valid emergency,
which required the immediate acquisition of food; and
WHEREAS, the City Manager and the Chief of Police
recommended that the requirements for competitive sealed bidding
procedures be waived and approved the acquisition of food for

police personnel from Hector Lopetegui, the current operator of
the Police Department Cafeteria; and
WHEREAS, funds are available from the Police General
Operating Budget, Account Code No. 001000.290201.6.710, for said
purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA;
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto, and incorporated herein as if fully set forth in this
Section.
Section 2. By a fourth -fifths (4/5th,) affirmative vote
of the members of the City Commission, the City Manager's finding
of an emergency, waiving the requirements for competitive sealed
bidding procedures, and approving the acquisition of food for
police personnel from Hector Lopetegui, in an amount not to
exceed $20,000, is hereby ratified, approved and confirmed, with
funds therefor hereby allocated from the Police General Operating
Budget, Account Code No. 001000.290201.6.670.
Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.!/
�i If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the attached Resolution ratifying
the City Manager's emergency action authorizing the purchase of food for the emergency
mobilization of the Police Department from Hector Lopetegui, in an amount not to exceed
$20,000. Funding is available from the Police General Operating Budget, Account Code No.
001000.290201.6.710.
BACKGROUND
Due to demonstrations occurring within the City of Miami on January 6, 2000, related to the Elian
Gonzalez Immigration and Naturalization Services' case, it was necessary that officers work 24-
hour shifts for as long as needed. At that particular time, the duration of the demonstrations where
not known, and therefore, arrangements had to be made to provide meals to the Police
Department's officers. The Police Department requested and received approval from the City
Manager to issue an Emergency Purchase for this provision from Hector Lopetegui. Mr.
Lopetegui was selected, as he is the current operator of the Police Department's Cafeteria, and has
in the past provided food on an emergency basis in a satisfactory manner.
