A RESOLUTION OF THE MIAMI CITY COMMISSION BY
A FOUR FIFTHS (4/5 T11 AFFIRMATIVE VOTE
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY AND
WAIVING FORMAL COMPETITIVE SEALED BIDDING
PROCEDURES'; AUTHORIZING THE CITY MANAGER TO
ACQUIRE SERVICES, EQUIPMENT AND/OR MATERIALS
REQUIRED FOR THE DEPARTMENT OF PUBLIC WORK'S

COVER CONTRACT(S) COSTS IN THE AMOUNT OF
$31,756.32 AND ESTIMATED EXPENSES INCURRED
BY THE CITY, IN AN ESTIMATED AMOUNT OF
$373,493.12; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE,,CONTRACTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH WIS'S
ENGINEERING AND F & L CONSTRUCTION, INC.,
FOR SAID PROJECT.
WHEREAS, due to the hazardous condition of the sidewalks
and curbs throughout the City of Miami, the City Manager has
made an emergency finding that a valid public emergency exists

and the immediate construction of new sidewalks and curbs is
necessary to protect the safety and welfare of the citizens of
the City; and
WHEREAS, implementation of required procedures and
scheduling requirements for formal advertising, receipt of bids,
award of contract(s) and processing of contract(s) will
needlessly and unwisely delay the construction of new sidewalks
and curbs for the Department of Public Work's project entitled
"Citywide Sidewalk Replacement Project Phase 16 (Second
Bidding), 13-4624, Bids "A and 1311;' and
WHEREAS, due to the urgent need for immediate sidewalk
replacement, the City Manager and the Director of the Department
of Public Works recommended, and deemed it appropriate, that
informal bidding procedures be solicited to acquire the lowest
and most responsive quotes to provide the required sidewalk and
curb replacement; and
WHEREAS, informal quotes were subsequently solicited by the
Department of Public Works and the quotes submitted by Wis's
Engineering and F & L Construction, Inc. were the lowest and
most responsive quotes received for Bid "A" and Bid "B,"
respectively;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI,_ FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5tns) affirmative vote of
the members of the City Commission, the City Manager's finding
that a valid public emergency exists and waiving formal
competitive bidding procedures are hereby ratified, approved and
confirmed.
Section 3. The City Manager is hereby authorized to the
acquire services, equipment and/or materials required for the
Department of Public Work's project entitled "Citywide Sidewalk
Replacement Project Phase 16 (Second Bidding), B-4624, Bids "A
and B", for construction of new sidewalks and curbs throughout
the City of Miami from Wis's Engineering, in the proposed amount
of $198,111.80 (Bid "A"), and F & L Construction, Inc., in the
proposed amount of $143,625.00 (Bid "B").
Section 4. The total estimated project costs of
$373,493.12 are hereby allocated from Capital Improvement
Project No. 341170, consisting of contract(s) costs in the
amount of $341,736.80 and estimated project expenses incurred by
the City in the amount of $31,756.32.

Section 5. The City Manager is hereby authorized to
enter into a contract, in a form acceptable to the City
Attorney, with WisIs Engineering and F & L :Construction, Inc.
for said purpose.
Section 6. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor 2/

not limited to those prescribed by applicable City Charter and Code
provisions.
If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the attached Resolution
ratifying the City Manager's written finding that a valid emergency exists concerning the
condition of the sidewalks throughout the City, and waiving formal competitive bidding
procedures and authorizing the City Manager to accept the bid of Wis's Engineering as
the lowest responsive and responsible bid in the amount of $198,111.80 for Bid "A" and
to accept the bid of F & L Construction, Inc., as the lowest responsive and responsible
bid in the amount of $143,625.00for Bid "B".
BACKGROUND
On June 8, 2000, the City Commission rejected the bid of M.E.F. Construction for the
project entitled "Citywide Sidewalk Replacement Project — Phase 16, B-4624". The City
Commission passed a motion to divide the project into smaller components in order to
provide ample opportunity for competitive bidding and waiver of the formal bidding
process. The reason behind this is to allow other competitive bidders to submit bid bond
vouchers which are applicable to bids under $200,000.00.
Based on my investigation of the citywide condition of the sidewalks and curbs, I believe
that an EMERGENCY exists to replace hazardous sidewalks which justifies the selection
of Contractors by informal bids. Due to the condition of the sidewalks and curbs, there is
an urgent need to have the replacements done. Further, considering that the City
Commission passed a motion to divide this project into smaller components, the project
was divided into two parts allowing more opportunity for bidders with two contracts
under $200,000.00 each.
Because of the sidewalk and curb conditions there is a need for extraordinary measures
to protect the health, safety and welfare of the community. In order to initiate the
construction of the sidewalk and curb in locations citywide as soon as possible, formal
competitive sealed bid procedures shall be waived for the procurement of contracting
services required for said EMERGENCY pursuant to Sections 18-83 and 18-84 of the
City Code. Informal bids for parts "A" and "B" were obtained and two separate contracts
will be awarded to the lowest responsive and qualified bidders. All costs of these two
projects'will be funded from CIP Project No. 341170.

A public hearing will be held by the Commission of the City of Miami, Florida, on
September 14, 2000, at a.m., in the City Commission Chambers at City Hall,
3500 Pan American Drive, Miami, Florida, for the purpose of hearing objections from any
interested parties to the waiving of formal competitive sealed bid procedures for the
project entitled CITYWIDE SIDEWALK REPLACEMENT PROJECT PHASE 16
(SECOND BIDDING), B-4624, BIDS WAND'S'.
All interested persons are invited to appear and may be heard concerning the proposed
sidewalk and curb improvements. Should any person desire to appeal any decision of
