A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), AUTHORIZING THE
ACQUISITION OF THREE (3) MULTIFAMILY
PROPERTIES LOCATED AT 1435, 1455 AND 1475
NORTHWEST 61ST STREET, MIAMI, FLORIDA, BY
PURCHASING THE TAX DEEDS FOR SAME; FURTHER
AUTHORIZING THE PAYMENT OF ALL OUTSTANDING
REAL ESTATE TAXES FOR THE PROPERTY LOCATED AT
1606 NORTHWEST 58TH TERRACE, MIAMI, FLORIDA,
LOCATED IN THE MODEL CITY REVITALIZATION
DISTRICT; ALLOCATING COMMUNITY DEVELOPMENT
BLOCK GRANT (CDBG) PROGRAM FUNDS, IN AN
AMOUNT NOT TO EXCEED $300,000, TO COVER ALL
COSTS ASSOCIATED WITH THE ACQUISITION AND
PAYMENTS RELATED TO THE SUBJECT PROPERTIES;.
AUTHORIZING AND DIRECTING. THE' CITY MANAGER
AND CITY ATTORNEY TO TAKE THE APPROPRIATE
STEPS REQUIRED TO ACQUIRE THE SUBJECT
PROPERTIES; AUTHORIZING THE CITY MANAGER TO
EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
ACQUISITION.
WHEREAS, in the early 19901s, the City of Miami provided
assistance in the form`of..a second mortgage to Devecorp, Inc., in
the amount of approximately`$1,651,565, for the rehabilitation of
certain multifamily apartment buildings as listed herein ("the
Properties") and as legally described in "Exhibit A," attached
and incorporated:

WHEREAS, the Properties are located in the City's designated
Model City Homeownership Zone, and the City's acquisition of the
Properties will be a significant step toward the City's
Comprehensive Neighborhood Revitalization Strategy for the Model
City Revitalization District; and
WHEREAS, the City has an opportunity to acquire the
Properties by purchasing the tax deeds from the current property
owner(s), or by initiating foreclosure actions; and
WHEREAS, the holder(s) of the tax deeds has offered and
agreed to sell the City its interest in the Properties located at
1435, 1455, and 1475 Northwest 61St Streets for approximately
$185,102 as of July 31, 2000; and
WHEREAS, the City has expressed an interest to accept said
offer; and
WHEREAS, real estate taxes are due on the multifamily
property located at 1606 Northwest 58.th Terrace, Miami, Florida,
in the amount of approximately $34,227, as of August, 2000; and
WHEREAS, it is necessary for the City to acquire properties
in the area and to protect the City's interests to assure the
City's implementation of various revitalization activities in the
Model City Revitalization District; and
WHEREAS, it is recommended that the City Commission allocate
Community Development Block .Grant funds, in an amount not to
exceed $300,000, to satisfy* all past due real estate taxes and

any other legal and recordation. costs associated with the
acquisition of said properties;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The acquisition of the following three (3)
multifamily properties as legally described in "Exhibit A,"
attached and incorporated, by purchasing the tax deeds is
authorized:
1435 Northwest 61St Street, Miami, Florida
1455 Northwest 61St Street, Miami, Florida
1475 Northwest 61St Street, Miami, Florida
Section 3. The payment of real estate taxes for the
property located at 1606 Northwest 58th Terrace, Miami, Florida,
located in the Model City Revitalization District and as legally
described in "Exhibit A," attached and incorporated, is
authorized.
Section 4. The allocation of Community Development Block
Grant (CDBG) program funds, in an amount not to exceed $300,000,
to cover all costs associated with the acquisition and payments
related to the subject properties is authorized.
Section 5. The City Manager and the City Attorney are
authorized to take -the appropriate legal steps required to
acquire the subject multifamily properties.

Section 6. The City Manager is authorized" to execute
all necessary documents, in a form acceptable to the City
Attorney, for said acquisition.
Section 7. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor .2/

It is respectfully recommended that the City Commission adopt the attached resolution by a 4/5ths
affirmative vote, ratifying, approving and confirming the City Manager's action to allocate an amount
not to exceed $300,000 in Community Development Block Grant Program funds to purchase certain
tax deeds and satisfy prior year real estate taxes on four (4) multifamily apartment buildings located in
the Model City neighborhood.
The attached resolution further authorizes and directs the City Manager and City Attorney to take the
appropriate legal action required to complete the acquisition of the subject multifamily properties.
BACKGROUND:
In 1993, the City of Miami provided approximately $1,651,565 in funding through the Rental
Rehabilitation Grant and HOME Investment Partnership Programs to Devecorp, Inc. to assist in part
with the financing of four (4) multifamily apartment buildings located in the Model City neighborhood.
Presently, the four (4) apartment buildings are substandard structures that are vacant, abandoned and
pose a threat to the health, safety and welfare of the residents of the immediate area. The buildings are
located at the following addresses:

Over a period of several months, discussions have been held by the City Attorney's Office, Department
of Community Development and legal counsel representing the holder of the tax deeds regarding the
current conditions and future of the aforementioned properties.
On. July 31, 2000, Mark Evans Kass, Attorney at Law and legal counsel representing the holder of the
tax deeds, contacted ,the City to convey his clients' willingness to sell its interest in the properties
located at 1405, 1455 and 1475 N.W. 61" Street for $185,102. The City also holds a second mortgage
on the property located at 1606 N.W. 58h Terrace that has approximately $34,227 existing in
outstanding real estate taxes due for 1996, 1997,,1998 and 1999.
The City's acquisition of the subject properties will provide additional open space for the expansion of
African Square Park and the development of affordable housing for purchase by area residents. Due to
the urgent need to take immediate action, it was determined necessary for the City Manager 'to
authorize CDBG funds to be used to purchase the tax deeds and pay the outstanding real estate taxes to
protect the City's interest in the aforementioned properties.
At the time of the City Manager's action, approximately $219,329'in back taxes was owed on the four
(4) properties. However, it is anticipated that additional taxes and/or resolutions of outstanding code
enforcement penalties will increase the total amount of funds needed to complete the transaction..
Therefore, it is recommended that CDBG funds in an amount not to exceed $300,000 be allocated to
cover the cost of acquisition, past due real estate taxes, and other related costs. associated with
acquisition of the subject properties.
It is recommended that the City Commission adopt the proposed resolution that ratifies,, approves and
confirms the City Manager's. action authorizing the acquisition of the subject multifamily properties
prior to City Commission approval in order to eliminate four (4) substandard buildings that threaten the
health, safety and welfare of residents of the Model City neighborhood.

Housing Properties
In 1993, the City of Miami provided approximately $1,651,565 in city assistance to Devecorp,
Inc. to assist in the rehabilitation of four (4) multifamily apartment buildings located at the
following addresses listed below:

Presently, the aforementioned substandard buildings are vacant, abandoned and represent a threat
to the health, safety and welfare of the residents of the immediate area. For the past several
months, discussions were held by the City Attorney's Office, Department of Community
Development and legal counsel representing the holder of the tax deeds on the subject properties,
regarding the current condition and future of the substandard buildings.
Per the attached correspondence dated July 31, 2000 from Mark Evans Kass, Attorney at Law,
the holder of the tax deeds is willing to sell its interest in the properties located at 1435, 1455,
1475 N.W. 61" Street for $185,102. Acquisition of the abovementioned properties will provide
additional open space for the expansion of African Square Park.
Secondly, the City also holds a second mortgage on the property located at 1606 N.W. 58`h
Terrace. Approximately $34,227 exists in outstanding real estate taxes due for 1996, 1997, 1998
and 1999.
In an effort to protect the City's interest in the four (4) subject properties prior to the initiation of
legal action against the property owner, the Department of Community Development requests

purchase the tax deeds and satisfy all outstanding real estate taxes. Funds in the amount of
$300,000 have been identified and are available from the CDBG Program to carry out this
activity.
If you concur with this request, please indicate by affixing your signature below. The
Department of Community Development will prepare an agenda item ratifying this action for the
September 14, 2000 City Commission meeting.
