BIDING PROCEDURES AND APPROVING THE ACQUISITION OF A TRIGGERFISHTM 4080B CELLULAR SURVEILLANCE NETWORK SYSTEM FOR THE DEPARTMENT OF POLICE FROM HARRIS CORPORATION, A SOLE SOURCE PROVIDER, IN AN AMOUNT NOT TO EXCEED $55,000; ALLOCATING FUNDS THEREFOR FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NOS. 6900,01, 690002 AND 690003, SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH THE U.S. DEPARTMENT OF THE TREASURY'S '!GUIDE TO EQUITABLE SHARING," AND SECTION 932.7055, FLORIDA STATUTES, AS AMENDED. WHEREAS, the U.S. Department of the Treasury's "Guide to Equitable Sharing" and Section 932.7055, Florida Statutes, as amended, authorize the expenditure of forfeiture cash or proceeds for certain law enforcement purposes not considered normal operating expenses; and WHEREAS, the Department of Police requires the acquisition of a TriggerfishTM 4080B Cellular Surveillance Network System, which will enhance its investigative capabilities; and CITY COMMISSION MEETING OF, SPP _ 1 4 2000 hesoanii=,Nm — 752 1 0 0 WHEREAS, the Chief Procurement Officer has adopted a finding that Harris Corporation is the sole source provider of the TriggerfishT' 4080B Cellular Surveillance Network System, which finding has 'been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief of Police recommend that the requirements for competitive sealed bidding procedures be waived and the acquisition of a TriggerfishTm 4080B Cellular Surveillance Network System from Harris Corporation, the sole source provider, be approved; and WHEREAS, funds to cover this expenditure have not been included in the Police Department's normal operating budget and are available in the City of Miami Law Enforcement Trust Fund; and WHEREAS, funds are available from the Law Enforcement Trust Fund, Project Nos. 690001, 690002, and 690003; WHEREAS, pursuant to the provisions of Section 932.7055(c), Florida Statutes (1999), the recipient shall (1) certify that the funds appropriated will be used lawfully and for the purpose stated, (2) be required to maintain proper accounting records for the expenditure of such monies and (3) provide any reports, including, but not limited to, audit reports, as may be required by the City of Miami or applicable law; Page 2 of 4 0- 756 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four fifths (4/5th,) affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's finding of sole source and waiving the requirements for competitive sealed bidding procedures, are hereby ratified, approved and confirmed, and the acquisition of a TriggerfishT"' 4080B Cellular Surveillance Network System for the Department Of Police from Harris Corporation, a sole source provider, in an amount not to exceed $55,000, is hereby approved, with funds therefor hereby allocated from the Law Enforcement Trust Fund, Project Nos. 690001, 690002 and 690003, such expenditure having been approved by the Chief of Police as complying with the U.S. Department of the Treasury's "Guide to Equitable Sharing" and Section 932.7055, Florida Statutes, as amended. This product is a cellular intercept tool, which allows law enforcement agencies to capture telephone conversations. The Director of the Purchasing Department has determined that Harris Corporation, due to the proprietary nature of this system, is the sole manufacturer of the TriggerFish 4080B Cellular Surveillance Product. From research conducted over the Internet, no other similar product with the same features could be found.
