MEMBERS OF THE CITY COMMISSION, AFTER A DULY
ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING" AND CONFIRMING THE CITY MANAGER'S
FINDING OF SOLE SOURCE; WAIVING THE
REQUIREMENTS FOR COMPETITIVE BIDDING
PROCEDURES AND APPROVING THE ACQUISITION OF

SOLE SOURCE PROVIDER, IN A TOTAL AMOUNT NOT

ISSUE A PURCHASE`ORDER FOR SAID ACQUISITION.
WHEREAS, the Department of Solid Waste seeks to acquire 34
Motorola portable radios, MTS2000 and LTS2000 Series, Astro
Digital Spectra Consoletes Base Stations, with SMARTNETTM Type II
software and accessories for its in the Operational Division; and
WHEREAS, the Chief Procurement Officer has adopted a finding
that Motorola Communications And Electronics, Inc. is the only

vendor able to provide the SMARTNETTM software, with accessories;
and
WHEREAS, the City Manager and the Chief Procurement Officer
recommend that the requirements for competitive formal sealed
bidding procedures be waived and the acquisition of said radios
from Motorola Communications And Electronics, Inc. as the sole
source provider be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding of sole source is
hereby ratified, approved and confirmed, the requirements for
competitive sealed bidding procedures are hereby, waived and the
request of the Department of Solid Waste for the acquisition of
various radios, MTS2000 and LTS2000 Series, Astro Digital Spectra
Consoletes Base Stations, with the SMARTNETTM Type II software,
with accessories, from Motorola Communications and Electronics,
Inc., in a total amount not to exceed $56,341.50, is hereby
approved, with funds therefor hereby allocated from Account Code
No. 422001.320302.6.850, in the amount of $45,232.00, and Account
Code No. 001000.320101.6.840, in the amount of $11,109.50.

Section 3. The City Manager is hereby authorized to
instruct the Chief Procurement Officer to' issue a purchase order
for said acquisition.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

RECOMMENDATION
It is respectfully recommended that the City Commission waive the necessity of competitive sealed
bids and approve the attached Resolution for the sole source purchase of 34 Motorola Portable
Radios MTS2000 & LTS2000 Series (Astro Digital Spectra Consoletes Base Stations with
Smartnet Type II Software and required accessories) for the Department of Solid Waste, from
Motorola Communications and Electronics, Inc., a Non-Local/Non-Minority vendor located at 4660
SW 158 Avenue, Miami, Florida 33185, in an amount not to exceed $56,341.50.
Funding is available in the department's budget, Account Code No. 422001.320302.6.850
($45,232.00) and 001000.320101.6.840 ($11,109.50).
BACKGROUND
The Department of Solid Waste has identified a need to purchase additional portable radios for the
Operational Division of the department. This equipment will enhance the overall communications
within the Operational division relative to equipment breakdowns, complaints and/or accidents in
an efficient and timely manner.
The Director of the Purchasing Department has determined that Motorola Communications and
Electronics, Inc., is the sole manufacturer of the Motorola Portable Radios MTS2000 & LTS2000
Series (Astro Digital Spectra Consoletes Base Stations with Smartnet Type II Software and
required accessories).

Staff conducted an investigation to determine whether Motorola Communications and Electronics, Inc.,
a non -minority / non -local vendor, located at 4660 S.W. 158' Avenue, Miami, Florida 33183, is the
sole source provider of Motorola Portable Radios and accessories. The Department of Solid Waste is
seeking to acquire thirty-four (34) Motorola Portable Radios, MTS2000 and LTS2000 Series (Astro
Digital Spectra Consoletes Base Stations, and required accessories). All of the radios are equipped
with the Smartnet Type II software. Funding for the Department of Solid Waste is available from
Account Code 422001.320302.6.850 ($45,232.00) and 001000.320101.6.840 ($11,109.50), for a total
of $56,341.50.
The Department of Solid Waste has identified a need to purchase additional portable radios for the
Operational Division of the department. This equipment will enhance the overall communications

efficient and timely manner.
It has been determined that Motorola Communications and Electronics, Inc. is the sole manufacturer of
the existing 800 MHz radio system, which was previously acquired by the City via a sole source
finding. The engineering, original design and installation of the system was executed by Motorola. In
addition, the operating and maintenance software for the system is proprietary to Motorola. Pursuant
to Resolutions 98-423, 99-222, and 99-421, the City had determined the acquisition of the portable
radios from Motorola, Inc. with the proprietary Smartnet software, and accessories, was a sole source
acquisition.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and these
findings be approved: Motorola Communications and Electronics, Inc., is the sole source provider of
thirty-four (34) Motorola Portable Radios, MTS2000 and LTS2000 Series (Astro Digital Spectra
Consoletes Base Stations, and required accessories). All of the radios are equipped with the Smartnet
