A RESOLUTION OF THE MIAMI CITY COMMISSION
DIRECTING THE CITY MANAGER TO INVESTIGATE
PROCEDURES TO CAUSE THE DEEPWATER SLIP AREA,
KNOWN AS THE FEC (FLORIDA EAST COAST)
PROPERTY LOCATED NORTH OF THE AMERICAN
AIRLINE ARENA AND EAST OF BISCAYNE BOULEVARD
IN MIAMI, FLORIDA, TO BE FILLED IN; DIRECTING
THE CITY MANAGER TO PRESENT HIS REPORT AND
RECOMMENDATIONS TO THE CITY COMMISSION WITHIN
120 DAYS FROM THE ADOPTION OF THIS RESOLUTION
REGARDING THE PROCEDURES NECESSARY TO EFFECT
SUCH ACTION, DETAILING COST ANALYSIS,
ESTIMATED TIMETABLE, FILL-IN CONFIGURATION
OPTIONS, AND ISSUES ASSOCIATED WITH THE
DEPARTMENT OF ENVIRONMENTAL RESOURCES
MANAGEMENT, THE ENVIRONMENTAL PROTECTION
AGENCY, AND THE CORPS OF ENGINEERS; FURTHER
DIRECTING THAT THE CITY MANAGER PRESENT HIS
REPORT TO THE WATERFRONT ADVISORY BOARD
THIRTY (30) DAYS PRIOR TO PRESENTATION OF THE
REPORT TO THE CITY COMMISSION.

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager is hereby directed to
investigate procedures to cause the deepwater slip area, known as
the FEC (Florida East Coast) Property located north of the
American Airlines Arena and east of Biscayne Boulevard in Miami,
Florida, to be filled in.

Section 2. The City Manager is hereby directed to
present his report and recommendations to the City Commission
within 120 days from the adoption of this Resolution regarding
the procedures necessary to effect such action, detailing cost
analysis, estimated timetable, fill-in configuration options, and
issues associated with the Department of Environmental Resources
Management, the Environmental Protection Agency, and the Corps of
Engineers.
Section 3. The City Manager is hereby further directed
to present his report to the Waterfront Advisory Board thirty
(30) days prior to presentation of the report to the City
Commission.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/
1� If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

Summary of Comments from the Urban Environment League

* Action is premature and should not be decided in an ad hoc manner in that all matters
pertaining to .design and uses at Bicentennial Park should.be_dictated by themes Bicentennial
Master Plan, which is currently under development by the newly formed Committee to Redesign
Bicentennial Park. This committee was _created in.March. b_y this_ Commission. The Committee,
chaired by Commissioner Johnny Winton, has met only once but will be working cooperatively
with representatives _of many city departments, the DDA.and_citizen_groups such.as UEL in an
open, public forum to discuss and determine the future land uses of Bicentennial Park; land uses
that will hopefully take -into consideration public use -and _enjoyment of this public park.
For example, the deep water slip, which offers excellent waterfront land for public access
and creates beautiful view corridors both toBiscayneBay-and downtown Miami, could be .once
again used to dock tall ships, military exhibition vessels for tours by the public, generating traffic
into the park and -infusing the area with additional tourist activities. The slip could be part _of a
public marina facility for other tours and water taxis that link Bayside, Virginia Key, Miami
Beach. The slip could also_serve_.asa_backdropfor_aA4aritime_Museum. There -are -myriad
possibilities that need to be examined by the Bicentennial Park Committee.
It is not in the best interest of our_community_to.make_a_decisio"ow to _proceed _with the
filling in of this distinctive feature in Bicentennial Park.
This is public parkland and _any .decisions -related -to the use of thisland should keep in
mind that there are important public property rights issues at stake here. The "FEC tract" where
the slip is locatedisPart of the waterfront. -public -park system that was -acquired by -the City of
Miami after extensive legal proceedings, including a costly eminent domain action. The cost was
paid for by _citizens who elected to tax -themselves- through thel'arks_for-People bond -issue _to
create a great green swath of public parks along the waterfront. In fact, acquiring this parcel was
so costly -- but considered so -important -- that _almost .all the monies collected under .the bond
program was dedicated to its acquisition -- gutting funds that were supposed to go to acquire and
refurbish inner city parks in the Culmer-0vertown-and .other_inner.city neighborhoods.
* Please also consider these issues:
1. Has there been an environmental impact study done of the impact of filling in the slip?
What will it cost? How long will. it take?
2. What permits will be required and what federal, state and county agencies would have
to be consulted and cleared before: the -action-can be -taken? -Have the -Environmental Protection
Agency, the Army Corps ofEngin' eers, DERM, etc.. already been notified or. consulted?
3. What will it -Cost to acquire permits, fill in the_bulkhead .and -slip? How will the City, of
Miami pay for it?
