A RESOLUTION OF THE MIAMI CITY COMMISSION
RELATED TO A CONCERT ON JULY 29, 2000,
ORGANIZED BY CHURCHILL'S AND MIAMAGINATION
FOR THE BENEFIT OF SIERRA CLUB AND THE MIAMI
GROUP EVERGLADES PROGRAM, GRANTING THE
REQUEST OF THE ORGANIZERS TO DECLARE AN
EXEMPTION FROM THE PROHIBITIONS AND
RESTRICTIONS CONTAINED IN SECTIONS 36-4(a)
AND 36-5(a) OF. THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, AS THEY RELATE TO
THE LEVEL AND HOURS OF NOISE CONCERNING SAID
CONCERT, WITH SAID GRANT CONDITIONED UPON THE
ORGANIZERS: (1) PAYING FOR ALL NECESSARY
COSTS OF CITY SERVICES AND APPLICABLE FEES
ASSOCIATED WITH THE CONCERT (2) OBTAINING
INSURANCE TO PROTECT THE CITY IN THE AMOUNT
AS PRESCRIBED BY THE CITY MANAGER OR
DESIGNEE.; (3) ADVISING ALL ADJACENT
BUSINESSES, PROPERTY OWNERS, AND RESIDENTS OF
STREET CLOSURE OF 75 YARDS OF NORTHEAST 55 T11
STREET, BETWEEN NORTHEAST 2' AVENUE AND
NORTHEAST 2ND COURT UNTIL 3:00 A.M.; AND (4)
COMPLYING WITH ALL CONDITIONS AND LIMITATIONS
AS MAY BE PRESCRIBED BY THE CITY MANAGER OR
HIS DESIGNEE.
WHEREAS, Churchill's and the Miamagination have organized a
concert at Northeast 55th Street, between Northeast 2nd Avenue and
Northeast 2nd Court on July 29, 2000; and
WHEREAS, the organizers invite the community to attend the
concert to benefit the Sierra Club and the Miami Group Everglades
Program;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The request of the organizers to declare an
exemption from the prohibitions and restrictions contained in
Sections 36-4(a) and 36-5(a) of the Code of the City of Miami,
Florida, as amended, as they relate to the level and hours of
noise concerning said concert is hereby granted.
Section 3. The herein grant is conditioned upon the
organizers: (1) paying for all necessary costs of City services
and applicable fees associated with the concert (2) obtaining
insurance to protect the City in the amount as prescribed by the
city manager or designee; (3) advising all adjacent businesses,
property owners, and residents of street closure of 75 yards of
Northeast 55th Street, between Northeast 2nd Avenue and Northeast
2nd Court until 3:00 a.m.; and (4) complying with all conditions
and limitations as may be prescribed by the City Manager or his
designee.

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.1/

ad If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
